This is in response to MrJohn Di Spirito’s distorted explanation to the Revdex.com regarding my original complaint against him I am not going to go over my original complaint because it is already posted in the Revdex.com websiteYou can also see MrDi Spirito’s responseI don’t want to be sarcastic about this, but it doesn’t take a rocket scientist to figure this one outI learned my lesson by not following proper protocol in hiring an independent contractor Let me introduce myself; I am a retired U.S Army paratrooper who served this Great Nation for yearsI am now a Federal Employee working as an Analyst for the third largest [redacted] located in Jacksonville Florida John Di Spirito is a local resident of Orange Park, Florida, who is NOT accredited by the Revdex.com and has similar complaints against him (including from others states where he previously lived).His Business “Di Spirito Masonry & Tile “received a grade of “F” by the Revdex.com, and is labeled by the rip-off report as “DI Spirito Masonry & Tile John Di SPirito Scam Artist Orange Park Florida”You can also see who Di Spirito Masonry & Tile reputation by watching a report aired by our local channel in last year explaining how MrDi Spirito basically conducted “Theft By Deception” to one of our local senior resident in Ponte Vedra You can also go to the webpage and check the ripoff report, just type key words with his company nameI will now tell my side of the story and you be the Judge The contract that John Di Spirito prepared dated Feb purposely did not have a start date and a completion date (lesson learned), but in his response to the Revdex.com he stated that I agreed on a start date of March 15, which is not true He also falsely stated that I was aware that he had another project to complete before stating on my project—but if you read the same response he wrote “customer was well aware of the start date for this project, Feb 17, He stated that I was not leery on giving him a deposit for $for labor and materials, but the fact of the matter is that he told me the same day that I signed the contract that he required a $Deposit to purchase materials only ( not labor) John Di Spirito did not purchase any materials specifically the pavers required do the main part of the job He cannot produce any receiptsJohn Di Spirito did not deposit the check I gave him on Feb 15, instead he went to my Bank and immediately cashed the check for $( RED FLAG)After he chased out the check is was virtually impossible to get him to start the project It was clear to me based on what I read about Di Spirito’s record of scams in the city, particularly when I saw the channel report that I was in fact another victim Because of my calls and strait forward talk to him he showed up and removed square feet of lawn, and removed one sprinkle head, he then departed and did not returnHe deducted $ from the $deposit He then showed up a different day and dumped about square feet of gravel, and did not come back to fill the remaining square feet, and for that he deducted $of my depositAgain, as previously stated the $deposit was for materials not for labor I’m not sure how much the paid for the gravel, John Di Spirito can’t produce any receipts He falsely stated that I breached the contract when in fact he is the one who breach itIn addition, the license number on the contract is BOGUS-Upon checking with local authorities I was told there is not such a license number( Lesson learned) I trusted him and didn’t ask him to prove that he in fact had a valid contractor license MrDi Spirito on several occasions said that I was going to receive a refund shortly but did not specified exactly when or how muchOn Apr 15, MrDi Spirito send me a text telling me that he had worked in the patio and sent me a picture of some type work he performed for someone,( basically he was warning me that I would not get a reasonable refund) I fol***d by sending him a text telling him that I was not playing games with him and that I was also going to file a complaint with the Florida attorney General and with Small ClaimsSo here we are, the contract was signed on Feb and today is April almost two months later Mr Di Spirito knew that I was serious about taking him to court and decided to stop by my house perhaps minutes later and dropped off envelope containing a money order for $and an itemized contractI incurred an expense of $for sod and top soil including labor to replace what MrDi Spirito removedUnfortunately I don’t have an extension of my current pavers nor do I have a fire pitI also incurred a loss of $in engaging in contract with Di Spirito Masonry & Tile John Di Spirito will not accept my allegations, but the fact of the matter is that other states are in fact prosecuting folks like him, putting them in jail and then on probation If you want to read about it, google it by typing (contractor sentenced for Theft by Deception”) I learned my lesson, never again I will hire someone until I do a complete background check with Revdex.com and other valuable sources Sincerely, [redacted]

I have dealt with Thousands of Clients over the past, I am the 5th Generation of Stone Artisan in my family, from ItalyAll my work is executed with meticulous attention to detail quality, and structural integrityI have worked with Billionaires and Millionaires that have handed me over 50k for Deposits and have done projects for over 150k that have been completed with SatisfactionThe Ripoff he is stating was also Refunded, then she posted a complaintThere are two sides to every storyHis allegations towards my Business are False, His statement "Di Spirito will not accept my allegations, but the fact of the matter is that other states are in fact prosecuting folks like him, putting them in jail and then on probation" I have also learned a lesson by being real careful who I accept as a Client.The fact that he said that he has someone else that can build him a "CUSTOM" Patio and "CUSTOM" Fire pit in One whole day, well I have told him that it does Not take one day to do, that's when he got mad and breached my ContractBy telling me to Refund him the Full Amount, when the work was already dug up, materials were bought, which the deposit was used forBottom line: He was Refunded a Partial Refund because the project have been started and Refund Was Accepted

Customer was well aware of the Start Date for this project, Feb, 17th, Contract signedHer husband and I agreed on start date of March, 1stHe was aware that I had another project pending and needed that completed before I started hisHe was not leery on giving me a Deposit for $for the materials and labor for this job, because it was discussed before handHe was very excited to startI did prior work for him and he delayed me Whole Monthsdue to his materials being in back ordered from ***'sGoing back to the Start date; Unfortunately due to massive rain for the straight week of March, This project was delayedPhone calls/texts were coming in 2x (him and her), responding to both messagesSo then Both projects, my existing one and theirs, were both now delayedThere are no excuses as of what she is stating on here, when I was dealing with himAlso they have Complained about Every Contractor they have dealt withEvery One of them.The day the job started, we tore out the grass/digging, capped and fixed the sprinkler line, went to the dump site to unload, which has to be unloaded by handHe stated work was mins on his response, when in fact that takes a day to doHe calls and said their is not enough work done todayHe indicated that "You work for me, I am your Boss!" and if I don't see more progress done to my property I will get someone else to do it faster than youthat can do it in One dayBuilding a brick patio and to build a Custom Fire pit does NOT take One dayHe then said he has someone else to do it in One day, I said fine, Once I receive my refund from my Supplier for his bricks that he will get his partial refundHe AgreedYou cannot ask for a Full Refund when someone has worked for it, so he also agreed with a Partial RefundIn this Claim he wanted over the amount of his depositHe claimed he had someone do the job, he lied and breached my Contract, he was refunded and the job is still not doneI was willing to finish it up for himbut he declined the service.His Partial refund has been Issued along with Itemized Bill for the work performed and Refund check was also Accepted

dated 17 Feb 15 purposely did not have a start date and a completion date (lesson
learned), but in his response to the Revdex.com he stated that I agreed on a start
date of 1 March 15, which is not true. 
He also falsely stated that I was aware that he had another project to
complete before stating on my project—but if you read the same response he
wrote “customer was well aware of the start date for this project, Feb 17,
2015.   He stated that I was not leery on
giving him a deposit for $800.00 for labor and materials, but the fact of the
matter is that he told me the same day that I signed the contract that he
required a $800.00 Deposit to purchase materials only ( not labor).  John Di Spirito did not purchase any
materials specifically the pavers required do the main part of the job.  He cannot produce any receipts. John Di
Spirito did not deposit the check I gave him on 17 Feb 15, instead he went to
my Bank and immediately cashed the check for $800.00 ( RED
FLAG). After he chased out the check is was virtually impossible to get
him to start the project.  It was clear
to me based on what I read about Di Spirito’s record of scams in the city,
particularly when I saw the channel 25 report that I was in fact another
victim.  Because of my calls and strait
forward talk to him he showed up and removed 100 square feet of lawn, and
removed one sprinkle head, he then departed and did not return. He deducted $300.00
from the $800.00 deposit.  He then showed
up a different day and dumped about 50 square feet of gravel, and did not come
back to fill the remaining 50 square feet, and for that he deducted $100.00 of
my deposit. Again, as previously stated the $800.00 deposit was for materials
not for labor.  I’m not sure how much the
paid for the gravel, John Di Spirito can’t produce any receipts.  He falsely stated that I breached the
contract when in fact he is the one who breach it. In addition, the license
number on the contract is BOGUS-Upon checking with local authorities I was told
there is not such a license number. ( Lesson learned).  I trusted him and didn’t ask him to prove that

 Mr. Di Spirito on several

reasonable refund).   I fol[redacted]d by sending him a text telling him  that I was not playing games with him and that
 I was also going to file a complaint
with  the Florida attorney General and
with Small Claims. So here we are, the contract was signed on 17 Feb and today
is 14 April 15 almost two months later.  Mr.
Di Spirito knew that I was serious about  taking him to court and decided to stop by my
house perhaps 45 minutes later and dropped off envelope containing a money
order for $400.00 and an itemized contract. I incurred an expense of  $125.00 for sod and top soil including labor
to replace what Mr. Di Spirito removed. Unfortunately I don’t have an extension
of my current pavers nor do I have a fire pit. I also incurred a loss of
$525.00 in engaging in contract with Di Spirito Masonry & Tile.  John Di Spirito will not accept my
allegations, but the fact of the matter is that other states are in fact
prosecuting folks like him, putting them in jail and then on probation.  If you want to read about it, google it by
