*** ***It is obvious that Mr *** has nor spent very much time in the world of big business. I program managed over $million of our business and contracted for whole site installations and we never paid until we were satisfied. That is why I know the construction business so well. I managed subcontractors from concrete flatwork to concrete buildings and everything in between. We never paid until satisfaction. I will put a check in the mail this evening to Diamond Fence and Concrete for $and get the work finished

I fundamentally do not agree with Mr [redacted]. The construction industry is one of the very few businesses which  does not ask for money at the time of the transaction. You can't buy a car, go to home depot, make a hotel reservation, buy a shirt, or any of a thousand other financial transaction, and have the expectation that you don't have to pay, nor do you not have to return the work. This is what Mr [redacted] has done. He has received his product and still has not paid for it 2 months later. I do not expect Mr [redacted] to cancel his vacation....but I do expect that he pays his bills as we all have to, despite our personal plans.  At the end of the day we will take the $2500, and all of us can move on.

[redacted] I need to disagree with the comments by Mr [redacted].I have not made it hard for him to come out and work on the issue.  I have received one phone call and that was from the concrete guy wanting to check things out and after that call I have heard absolutely nothing.  In fact I sent Mr [redacted] a letter and pictures and have never been given the courtesy of a phone call.  It was because of their silence that I was forced to make this complaint.I do not understand his comments about me being out of town.  Does he actually expect me to change my summer vacation schedule so he can come and fix the things his company messed up?  I do not think I need to do that.  I am the client that is paying and it is up to them to see that I am satisfied.I have paid full price for the fence portion and would have paid for the concrete portion had it been done to the same standards.  Since I have had a significant time without any communication, I have assumed Diamond Fence and Concrete was not willing to do a good professional finish.  It is because of that that I have looked in to hiring another company to fix this job as well as what it would take me personally to finish this job.  It is because of those costs that I have offered to pay less than the agreed upon price for this work.  It is an absolute lie that I have refused to allow his people on my property.  His crew showed up one Sunday morning while we were at church with no advance notice or phone call that they were coming.  They proceeded to make matters worse.  It is then that I locked the gates to my property.  I don't believe anyone wants workers to show up without prior notice. All it takes is a phone call to me to coordinate their visit and I will be more than happy to be here for them.  That is just good business practice.  Which I do not believe this company is aware of.As a counter offer, I will pay Diamond Fence and concrete $2500 and they can walk away from this job and I will finish it either by hiring it done or doing it myself.  I will also give up the one year warranty and won't bother Mr. [redacted] again.
