Initial Business Response / [redacted] (1000, 5, 2015/08/28) */ The person who filed this complaint is a member of Diamond Heights Village Association an HOA that I manageThe Board of Directors, Management and the HOA's Attorney, [redacted] have received Mr***'s list of grievances with respect to the Association's non-enforcement of the DHVA CC&RsThe Board is in the process of drafting a letter in response to his harassing and disruptive behavior and conduct toward the Association and its ManagersMr [redacted] has repeatedly been notified that he has a right, within reason, to bring issues to the attention of management staff or to submit maintenance requestsHe has a right to attend Board meetings; but he does not have the right to harass the staff, in person or via email, or take up unreasonable amounts of our time or the Board's time with the same repetitive complaints The HOA's attorney requested that he cease and desist from such repetitive and harassing communications with the Management StaffHe was warned that if his conduct persisted, the Association would have no choice but to hold a disciplinary hearing and consider imposing fines and or a reimbursement assessments for cost incurred, and suspending his membership rightsIn retaliation, Mr [redacted] filed this complaint against me and the HOA's Attorney, [redacted] Case ID: XXXXXXXX Initial Consumer Rebuttal / [redacted] (3000, 7, 2015/08/31) */ (The consumer indicated he/she DID NOT accept the response from the business.) This is behavior from DHVA management which has been harassing me and has advised that I move as I have complained against non-enforcement of CC&RsThey have taken retaliatory action to claim that I have violated the CCURs and thus will suspend my membership rightsThey are posing fines for cost incurred because of their non-enforcement of CC&RsManagement fails to acknowledge and/or follwith requestsConditions at DHVA are deterioratingExamples of this is recent job of painting over areas with a long time contractor where paint does not last and paint underneath showsThis was also evident on elevator areas, on railings on bridges where rust is showing through, etcBecause of lack of communication, which they seem to be restricting to board meeting, where membership generally just sits through the meeting without any action being taken, documentation has been submitted to show to the Attorney and Management where I have received limited responsesWhy would repetitive complaints be made if complaints have been resolved?

the Association's non-enforcement of the DHVA CC&Rs. The Board is in the process of drafting a letter in response to his harassing and disruptive behavior and conduct toward the Association and its Managers. Mr. [redacted] has repeatedly been notified that he has a right, within reason, to bring issues to the attention of management staff or to submit maintenance requests. This is normal behavior from DHVA management which has been harassing me and has advised that I move as I have complained against non-enforcement of CC&Rs. They have taken retaliatory action to claim that I have violated the CCURs and thus will suspend my membership rights. They are posing fines for cost incurred because of their non-enforcement of CC&Rs. Management fails to acknowledge and/or follow-up with requests. Conditions at DHVA are deteriorating.
