I am rejecting this response because:
It seems strange that when I called to inquire about the complaint the employee who answered the phone said it was another tenant who had called it in, but now that I am choosing to complain through a third party, Diamond Mesa is saying it was an employee. It seems like that would be something that would be mentioned during a phone call. Even if this employee did see vehicles parked near the garage, they were not ours. There are 8 garages in very close proximity, and with the amount of vehicles claimed to have been seen, it could have easily been from another tenant. Again, me and my roommates have receipts and tickets showing we were not at home that night. Furthermore, did the employee not think to call security after he/she saw the alleged commotion? That would seem like the logical step to take and would remove any ambiguity from the situation as far as to which tenants were allowing people to park and party in a manner violating the lease agreement.. The story being presented now is not consistent logically, or even with the initial story told by an employee over the phone. As far as the work order issue, the complaint was not that it did not get completed. The complaint was that the "24 hour" maintenance line was called 4 days before any repairs took place, as is evidenced by the description of the problem on the work order reading, "[redacted] knows". Furthermore, the complaint was about the rude treatment by the person answering the phone on the maintenance line, who went as far as the hang up the phone when we called the day before repairs took place to complain that we had been out of our garage for far too long.

Her story is not consistent and is all over the place. I have attempted to contact Ms. [redacted], with no return call. We do refund $, not all, should the applicant be.declined. I am rejecting this response because: Using your contract verbiage - termination fee is 'full compensation' and does not include accrued rent or other charges that are due.  There was no accrued rent or other charges due at the time of notice.  Contract should read, termination fee and pro-rated tent for the notice period - it does not say that?.

I apologize for any confusion; however, there is a termination fee that is to be paid along with any concessions the resident has received throughout their stay at Diamond Mesa.  As stated in "#11 Early Move-out" section of the lease - you may terminate this agreement, even during the Initial...

Term, on 30 days written notice, accompanied by payment of a termination fee of $_________ as full compensation for our expenses of re-renting the premises and los of rental income as a result of Resident's early termination of the Agreement.  The Termination Fee is not compensation for accrued rent or other charges which have already come due or for damages, cleaning, or other charges which cannot be determined until you vacate the apartment".  Also, please understand our Early Lease Termination Agreement provides detailed information in regards to the total amount due (which consist of Settlement Fee, Concession Repayment, and Rent due through the notice period).

Attached are two recent service requests the resident made.  You'll find the dates as to when they were completed and what the maintenance tech did to resolve the issue.  Unfortunately, a staff member (that was off the clock) witnessed the lease violation.  There was some...

activity occurring that night with several cars parked illegally.  Unfortunately, this incident violates "#19 - Prohibited Conduct" in our lease.  It states "You and your occupants or guests may not engage in the following activities behaving in a loud or obnoxious manner; disturbing or threatening the rights, comfort, health, safety, or convenience of others (including our agents and employees) in or near the apartment community; disrupting our business operations..."Our staff member actually picked up a bunch of broken glass bottles around the exterior of the unit the following day.  Unfortunately, we will not agree to their desired outcome.  They have the option to terminate their lease; however, there will be additional fees if they wanted to terminate.
