Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below [To assist us in bringing this matter to a close, we would like to know your view on the matter.] The property manager did make a visit to my home to look at the damaged drivewayHe would not agree that the damage was caused by the snow plow contractorMany other driveways in the community have similar damage to mine that was caused by incorrectly plowing the lower third horizontally across several driveways not vertical which is the correct way to plowI have photographs and video to prove my pointThe property manager and Diamond Realty have NEVER provided me or any of the homeowners with the contractors correct business or insurance informationI personally obtained the information on my ownThe contractor does not have a DBA or Liability insurance in his own name or the correct name of the business that the property manager and Diamond Realty stated [redacted] the name of the company is owned by a different individual, there is no record on file at the Albany County Clerks Office for Charles B***," DBA" [redacted] or [redacted] , or [redacted] ConstructionThese three names are the ones provided on different occasions by the propertymanager and Diamond Realty No Such business is on file anywhere by Charles B [redacted] as a DBAFurthermore I have obtained a copy of the snow plow contract through a source and the property manger, Diamond Realty and th [redacted] Association are all in violation of the contract requirementsAt our annual meeting in May the property manager stated in an open meeting that Diamond Realty would make good on any all repairs to ALL Driveways that were damaged by the snow plow contractorThey are now backing down from that statement and making excuses that the driveways were all damaged in some other manner or was pre- existing prior to the snow plowingIf my driveway is not repaired to the condition prior to the damage caused by the snow plow contractor I will have no other option that to take legal action against the Property manager, Diamond Realty and the Homeowners AssociationThe preponderance of the evidence is overwhelming Regards, [redacted]

May Concern:We are pleased to respond to *** ***'s complaint to provide further factual information and clarify some incorrect representations by the complainant in regards to water flood at her residence onJanuary 12, As the managing agent for the *** *** *** ***, ***, NY for over years, we recognize that as a relatively new owner since June 13,*** may have some misunderstanding with respect to her ownership in the HOA and owner responsibilities. We are pleased to inform Revdex.com that the matter has been satisfactorily resolved, due in large part to the understanding of the *** Board of Directors guided by contractual provisions that address circumstances such as this. The homeowner association is guided by the legally binding Governing Documents (By-laws, Declaration and Articles of Incorporation) filed in the *** *** ***'s office and governed by the community's Board of Directors annually elected by their neighborsThe Homeowner's Guide sets forth the important Association information in an easy to read format.Our office received an after-hours emergency response service call request from *** on January 12, at approximately 7:20amI spoke with *** directly and was informed that a water pipe burst and the town home was being flooded as we spoke and the background noise during the call indicated a level of commotion in the residenceA three person response crew was promptly dispatched arriving on site at approximately 8:00am. Upon arrival, the *** Water Department was on site and had already successfully stopped the water flowHowever there were gallons of water on the kitchen floor that spread to the adjacent living room and bedroom carpetsHaving significant experience with such floods I surmised that the extent of the damage would be far less than the Association's $5,insurance deductible limit for water loss and in accordance with the Governing Documents the remediation expense would be the responsibility of the ownerWhile this was clearly discussed with the owner before work commenced, in retrospect perhaps it is understandable how someone could not recall such a discussion in the midst of the confusion and commotion that is typically associated with floods, particularly those experiencing such catastrophe for the first time. As the invoice detail indicates, the work crew undertook customary procedures to roll back the carpet and remove and dispose the saturated pad in the affected living room and bedroomAccess to the affected bedroom areas required that the closet doors be removed.I must say, I am confused as to the owner's representation of rejecting services as we would have gladly compliedTo further illustrate this point, after work was completed a commercial blower was set up and left at the home to accelerate the drying process and a follappointment was set for personnel to return two days later to install replacement carpet padding after the area was dryThe owner contacted our office two days later on January 14th and requested to cancel the appointment and in the process thanking us for dropping off the washer hoseOn February 11th after receiving the invoice for services, the owner returned the washer hose and the account was updated(see attached supporting call log notes) Had our firm not responded to the owners request and promptly mitigated the flooded areas, the water would have further penetrated the carpeting, padding and eventually the floor trim and sheetrock leading to more extensive and expensive repairs and the possibility of mold formationI would surmise that the owner had neither the tools or experience to address such a flood and a service firm, either ours or another, would be required to remediate the flooded conditionHad the owner only submitted the invoice to her insurance company, we trust that an adjuster familiar with such circumstances would have found the bill for services quite reasonable and remitted payment. With respect to request to turn the outside water off (the main shut off to the house) the owner was previously informed that the mechanicals are the responsibility of the owner and not the HOA and she was provided a copy of the documentation from the Governing Documents, copy attachedThus, we do not understand *** as to her continued misperception of the facts. The business, Diamond Realty Management hired this contractor to perform the snow plowingThey have not provided me with the business license for the snow plow contractor *** ***, liability and workers compensation information for this contractorI cannot find that the contractor they hired has any required insuranceThis is a complete fabrication and lie as to the factsAt the community meeting John L*** stated that they would pay for any repairs or damage to any residents drivewayThey refuse to provide this in writing.

Received call from the business stating that they issue has been resolved.

Business responded stating that the consumer is not stable.  The business had to have police protection during a community meeting because of this consumer and his violent behavior.  However, to answer this complaint, we are not the one's he should be grieving with, he should be contacting...

the contractor not us.  We are not responsible for his damages.
