I am writing in response to the complaint made by *** against Diesel Dogs Fuel Service, Inc
In the interest getting all facts accurate, allow me to state the following
The last delivery Diesel Dogs made to *** (Mr
***'s business) was on 11/07/The Gasoline that was delivered cost $(invoice attached)
Diesel Dogs removed the tanks from Mr ***'s premises on 01/29/(Driver's log sheet attached)
The tanks were empty at the time and had been for several days before we removed the tanks
Mr*** believes that there was product in the gas tank, however the level of the fuel in the tank was so low that the pump could no longer pump any fuel out of itDiesel Dogs had installed a monitoring device on the tank, which reports to our office and lets us know when a tank is low so that we can schedule a delivery to that customerThese devices are not by any means considered accurate, they are not weights and measures certified, and only exist to give us an indication of the fuel level in a given tankMr*** believes that there was fuel in the tank because the monitoring device indicated that there was some product left The pump, however, would not pump any more fuel out of the tank For all practical purposes, the tank was emptyThe reason the pump will not completely empty a tank is that the suction stub of the pump in a fuel tank is approximately inches from the bottom of the tankThis is by design so that the fuel pump does not pick up the impurities that settle at the bottom of a tank Any moisture trapped in the tank also settles at the bottom of a tank(The water gets into fuel when air replaces the fuel that has been pumped out and due to temperature changes in the weather, condensation forms on the inside of the tank, in much the same way that condensation forms on the outside of a cold beverage on a hot day.) Regardless, the pump is designed to not remove the very last few gallons in a tank
When Paul, the Diesel Dogs sales rep, was on site to oversee the removal of the tanks, Mr *** asked that any fuel left in the tanks be returned to himPaul said that if there was any, it would be creditedThe pump was not pumping any more fuel out of the system when the tank was removed, and later once we had the tank back at our yard, it did not pump any more fuel out when Paul tried itThe only reason Mr*** thinks he is owed a refund is because the monitoring device indicated that there was something in the tankAs I have stated, the monitoring device only gives an approximation of the volume in the tankIt is not calibrated and is not accurate enough to determine exact gallons When the tanks were delivered and set up at Mr***'s business, they would have arrived from the previous application with the same amount of fuel in them as when they leftThe pump can only empty the tank to a certain level Paul has explained this to Mr***, and it was explained to him again when he called our office
I feel that Mr ***'s demand for a refund is unfounded However, In the interest of settling the dispute, I will agree to split the amount with Mr*** Mr*** claims there was gal left, the last delivery was billed at $per gallonThus $/=$ I would like to point out that it is my sincere and honest belief that NO refund is owed, but solely in the interest of goodwill and common decency, will I agree to split the disputed amount with him
Please advise on how the Revdex.com and/or Mr*** would like to proceed

It is not true that the tank was not pumping fuel when Diesel Dogs came to pick up the tanksI personally pumped fuel into my car till it was full when Paul came to pick the tank upI did not just come up with the gallon number out of the blue, I was told by a representative of Diesel dog that that was the amount leftI asked that they leave the tank there until it was empty and I was told they needed it at another place and they would refund me the money or pump it out into smaller drumsWhy would they tell me this if there was no fuel or if it was not pumpingAt this point I have no way of knowing if there was indeed considerable more fuel above gallonsLawn ranger purchased hundreds of thousands of Dollars of fuel with this companyI have given out their name to countless other companiesI am puzzled with the owners response
