Diesel Forward sells product through a distribution channel
and, in most cases, does not sell to the end user.  In this case, Mr. [redacted] would have purchased
this turbo through one of our Service Dealers in his area.  Diesel Forward does back it products with a
warranty, but there is a...

process that the customer, going through the Service
Dealer, needs to follow in order for a credit to be issued to their account.  In addition, we do require that the product be
returned, to verify that it is truly a defective product and not an
installation error or some other issue being caused by the vehicle.  To date this process has not been followed, so
we are unable to process a refund to Mr. [redacted].  If Mr. [redacted] would follow this process, Diesel Forward would
be glad to honor his warranty, given that our analysis shows it as a product
failure.  We sincerely apologized for any
inconvenience this may have caused him and will do all that we can to expedite
his claim once it is filed.

Corey [redacted]  The process, through the channel of distributors, was never conveyed to the purchaser. In fact, it is unfair and a deceptive trade practice. Diesel Forward has the original turbo belonging to complainant and therefore they are subjecting the livelihood of the complainant to economic loss and trying to insure that the complainant  to purchasing another turbo though their company. The complainant does not want any other product from this company due to the fraudulent misrepresentation, fraudulent inducement of a contract and unfair and deceptive trade  practice of the said "distribution channel." Asking the complainant to purchase another product is not realistic. In addition, the the actions of the "distribution channel" are liable for fraudulent conveyance of a contract under Tennessee Law. The scheme is set up by the "distribution channel" to take your old rebuildable part so that you have to keep deal with the "distribution channel" whether you like their product or not. Moreover, it is impossible to tell how the turbo failed if it was installation issues, although the product installed was by a certified diesel mechanic, or a product defect. In the end, it's a subjective opinion in which Diesel Forward plays both judge and jury that renders a subjective opinion to defraud unsuspecting consumers out of money and to keep the same consumer dealing with the "distribution channel" and suffer economic loss while they decide if they want to refund the money belonging to the consumer. All they had to do from the start was to send a replacement and take the defective part back. However, if they choose to litigate the matter in General Sessions Court in the State of Tennessee then that will be the next step.
