Good afternoon- Thanks for taking the time to read our response to this case that was reported by customer who has purchased a vehicle from us via ebay motorsFORD EXCURSION which is years old with over 214,milesit was purchased sight unseen with out any pre purchase inspection by the buyer and sold with NO warranty or guarantee which we have (ATTACHED) copy of their signed contract on the purchase and we also have a disclaimer on our ebay listing as follow: AS IS - NO WARRANTY This vehicle is being sold as is, where is with no warranty, expressed written or impliedThe seller shall not be responsible for the correct description, authenticity, genuineness, or defects herein, and makes no warranty in connection therewithNo allowance or set aside will be made on account of any incorrectness, imperfection, defect or damageAny descriptions or representations are for identification purposes only and are not to be construed as a warranty of any typeIt is the responsibility of the buyer to have thoroughly inspected the vehicle, and to have satisfied himself or herself as to the condition and value and to bid based upon that judgment solelyThe seller shall and will make every reasonable effort to disclose any known defects associated with this vehicle at the buyer's request prior to the close of saleSeller assumes no responsibility for any repairs regardless of any oral statements about the vehicle This buyer was so demanding and picky from the start of transaction, they did not read the terms and policy and they complained about everything, they send us a list of items for wear and tear to a point that they expected the vehicle to be brand spanking newVehicle is 1-owner, clean carfax, shows perfect maintenance records (CARFAX attached), it was a local trade in by original owner at franchised storewe have inspected and serviced it, installed BRAND NEW TIRES, fixed a dent, fixed oil leak, a/c vacume pump and door lock actuators so we did take the time to go over the vehicleThe buyer said the vehicle broke down and it was due to loosen cam shaft position sensor and was immediately fixed and they complained about wear and tear item such as brake pads, ball joints and some seals and even they bought it as is with no warranty and we did not even notice any visual and felt anything on our demonstration we were willing to offer them $refund towards good faith of customer care and satisfaction but the forced to return the vehicle because wife bought the vehicle with out any home work and rush and then changed her mind so they encourage for us to get vehicle back or they will ruin our reputation online which the left us negative rating on ebay which we have disputed and negative rating on google which we have responded our side of storyWe have maintained a 100% rating on ebay for over years, sold thousands of trucks and vehicles all over the globe, we test drive all vehicle and do inspect and test drive them before advertisingThis buyer wanted everything their way and expected to have mint, pristine, brand new condition on a years old vehicle with over 200,miles We tried our best to keep a good relationship and positive deal but this one was very hard to deal withIf you have any questions or concerns about our response to this matter please call or email back Best Regards [redacted] (President) [redacted]

We have been a 100% ebay power seller since 2003, we have sold vehicles to every nation & state around to world we know this vehicle was in great running condition and had no issues and was sold with no warrantythe buyer's complaint was over some internal wear and tear item which we have offered to help with $and they refused and wanted to return or get heavy expensive repair bill that was made by their mechanicWe no longer have any further conversation on this matter since we could not agree in terms togetherSincerely, [redacted] (President) [redacted]

RevDex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint. Mr. [redacted] has abused this process and made no attempt at resolution in any of his messages. Not once did he offer anything but derision, finger pointing and blaming the victim (me) for my misfortune. For the record, we never rejected receiving $1,000, only stated that this amount was insufficient. Mr. [redacted] stated in writing in an email that he would not refund the rest of the promised $1,000 as punishment to me for lodging this complaint. However, prior to that, he immediately upon offering the$1000, before waiting to come to a mutual agreement as per eBay policy, returned the first $300 of that $1000 because it was the entire sum of the transaction that was completed through PayPal/eBay. eBay has informed me that his actions are a violation of policy (1. preventing a customer from filing a complaint on the site by removing the $300 paypal transaction from the record, 2. making a partial refund without mutual consent to a resolution and 3. suggesting to eBay's reviewer that his business volume with eBay be considered a factor in removing my negative review). I was told by eBay Motors escalation department that Mr. [redacted] 's business is under investigation for these matters (conversation 5/8/15 at 4 pm Central time). To resolve my complaint here, I state again for the 4th time, Mr. [redacted] should do the right thing and refund $5,000 of my purchase price to bring the vehicle to its advertised condition. I do not expect to hear another response from Mr. [redacted] unless he agrees to actually discuss resolution, as his most recent non-attempt message indicated he was not going to continue this process any longer, because as he clearly stated, he has no interest in negotiating a resolution to this complaint. I appreciate the Houston BBB's time and apologize for the lengthy back-and-forths that have been useless in reaching resolution with a business uninterested in doing so. If Mr. [redacted] continues to send non-resolution-seeking messages that do not begin with a clearly defined intent to reach a mutually satisfactory resolution, I shall save all our time, disregard further non-responses and just reply with "see prior messages." Mr. [redacted] 's strategy here is a mystery to me as a business owner. Not only has he been unwilling to make any attempt at resolution and has reneged on his own suggestion for resolution, he repeats contentions that he and I both know to be false. In other words, both parties know the truth about this vehicle, the ad, the issues, and the fair resolution of this issue, as these have all been discussed and documented. Mr. [redacted] doesn't believe his own conflicting assertions to the contrary to be true any more than I do, he would just prefer to bully a vulnerable customer (and is angry that I have stood up to him) rather than do what he very well knows is the ethical and correct action in this matter. To whom it may concern,
I will outline the situation which lead to this complaint to highlight:
This complaint is related to having a vehicle sold without depositThe
complaint puts Diesel of Houston in a bad light, when we actually made a good faith attempt to assist the customer on a Saturday It is difficult to close some deals, due to Financial Institutions limited hours during Saturday.The customer has buyer's regret, and should have made a decision whether or not to purchase prior to completing the transaction.
Initially, on Thursday, 4/07/Mr*** was interested in a *** *** *** with 2-wheel drive and a
short bed. This vehicle had a wide number
of modifications including a inch lift kit and 35” Mud tread style
tires. However, during a conversation later
that day he expressed an additional interest a *** truck with a welding bed and
4-wheel drive. At the time there was also
another party already interested in this particular *** truck. Mr*** indicated to us that he would be coming
to view both trucks without any deposit We explained to him without a deposit there was no way to prevent a vehicle being sold Mr*** declined to put a deposit down on either truck at this time On 04/08/16, the other interested party secured
funding and paid in full for the *** truck a day before Mr*** had planned to
travel without deposit. Out of courtesy
for his time and travel we called to inform Mr*** that this *** truck was no
longer available. During this conversation Mr*** indicated that he understood the situation and asked us to let him know if
we had something else similarly available.
We agreed to assist him and left the conversation at thatMy Executive Director, Anthony ** was witness to this conversation and will attest to my professional tone and demeanor.
On Saturday, 4/9/Mr*** showed up to our dealership
unannounced minutes prior to close He was with a diesel mechanic to look at the *** *** *** with a flat
bed and 4-wheel drive. We provided an
opportunity for him to test drive and inspect the truck prior to purchase. After his test drive and completed inspection
the decision was made to purchase this truck.
We assisted in sending paperwork to his Financial Institution on a
Saturday and stayed open until the deal was closed. The contract was completed so
that he could take ownership of this truck therefore, finalizing this
transaction Following this purchase on 4/12/16, Mr*** expressed the desire to
return this truck due to it not meeting his needs. This was through text messages time stamped on my phone Therefore, the information provided by Mr*** has been timed incorrectly In reference to my earlier conversation with Mr***, he wanted a modified truck with a lift, 2-wheel drive and a lower price point. Then he wanted a truck with a welding bed and
4-wheel drive. Regrettably, this was sold
due to secured funding from another party and no deposit provided from Mr***. Finally, he wanted a newer year truck with a
flat bed, 4-Wheel drive and a higher price point. Due the wide variance of his interests, we
provided him an opportunity to inspect and determine if this truck was suitable
for his needs prior to purchase I feel this complaint is unfortunate for Mr*** However, as a Business I believe I conducted myself in a manner in line with the Revdex.com Code of Conduct I attempted to communicate openly regarding what trucks were available to Mr***, therefore maintaining trust I also reached out to him when one of the available trucks were sold without a deposit being placed from Mr*** Finally, I made attempts to ensure he would be happy with his purchase prior purchase and prior to leaving our dealership Lastly, I have included a copy of Mr***'s Bill of Sale, which fully discloses the vehicle make and model, VIN number, mileage, and details regarding this vehicle This would have been reviewed prior the completing the sale I will also provide a link to our website listing to show that no, "advertising issues" are present for this truck he purchasedWebsite Link: http://www.dieselofhouston.com/2012_***%203500HD%20CC_Houston_TX_262237102.veh /> Best Regards,
