In our rules and FAQs, it states that you must sync your devices within hours of the end of the week otherwise you are disqualifiedShe did not successfully do soWe asked if she could send us her Apple Health Data to verify the steps, but she never didDue to the technical difficulties, we
offered credit to use towards our products, however she was not satisfied with thisWe tried to further assist her and we haven't heard back since

Thank you for the updated information. After reviewing this case it looks like Jason had submitted an incorrect weiand there for gameThis caused them to not receive winnings for the roundDue to this the user asked to be removed from the game, the refund period had already passed so
we were not able to refund. Since there was another weisubmitted within that time window I would be happy to do one of two things: -apply the weito the round and reinstate the user into the game -issue a chip refund for the entire game (which cannot be paid out but can be applied towards another game) Would it be best to reach out to the user directly or since there has been a case filed should I submit this through you. Thanks Again! *** *

I am rejecting this response because:
The fact that this small company has absolutely no willingness to work with someone, and refuses to take into consideration that a customer would incur further expenses to hand over what should be a confidential medical record to them, is a very poor business practice I would think a company preparing to go public through their IPO would have better customer satisfaction practices I'm not asking them to make an exception for "all players." I'm asking for an exception, one time, for myself To have to go and pay a second $copay to my physician in order to get a $refund is absurd I'm sure if I surveyed other users that are part of this game, they'd be perfectly fine with the company refunding meThey are, in effect, telling me that my options are to either a) work out while injured and hurt myself worse so that I don't lose my money, b) make a second trip to my physician to get them the doctor's note which would put me $in the hole, which makes no sense, or c) just be perfectly accepting of them taking on such a rigid corporate stance, and refusing to let go of such a small sum of $
I've worked in Customer Service all my life--currently as the Customer Service Manager for a company that the Revdex.com gives an A+ rating to We've gotten there by working with our customers when they have issues, not by calling their integrity into question (as this comapny has in the email trail I have with them) and acting as if $will bankrupt the company and put paychecks on hold Word of mouth goes a long way for building a customer base, which this company apparently has not learned

She reached out to us and we issued her a payout of $105.71 to her PayPal account on 6/23/17. She was having issues logging in, so we did this on her behalf after she was unable to log in despite troubleshooting with her. She should be happy and consider this resolved. This should not be held agains...

We do offer our Membership program that allows weekly progress weigh-ins. These specific weigh-ins have no bearing on your actual game as you do not need to even be in a game to participate, as stated in our rules here ([redacted]):Progress Weigh-ins. DietBet Members may submit weekly Progress Weigh-ins for extra accountability and motivation. Progress Weigh-ins can be submitted through the My Membership screen at any time during the week. The history of this specific player’s weigh-ins are as follows:1/5/18 – Initial weigh-in - XXX pounds (weight not provided for privacy of user)1/11/18 – Progress weigh-in - 9-pound loss – 3.25% weight loss1/24/18 – Progress weigh-in - 28 total pounds loss – 10.1% weight loss (still in winning range)2/1/18 – Final weigh in – 38 total pounds loss – 13.5% weight loss – (disqualified weigh in)The weigh-in previous to February 1 had the player within qualifying range to win her bet. We cannot predict the outcome of a player's weight loss. In this case, she lost an additional 10 pounds in the span of a week. It is in this final week that she was disqualified. We do have our rules available on our website and our app that are easily available before, during and after a bet.

I am rejecting this response because: during weekly weigh-ins their "referees" either accept or reject your "Official" weigh-ins. The only rejections I ever received were due to photos being blurry. Since the company waited till the very last day to disqualify me, I believe their data is built to always be in their favor. I did not pick this company to organize the group bet that I participated in, it was chosen for me. I also downloaded the applications on my phone. None of the rules and regulations pop-up during enrollment. I have photo approval on all my other weigh-ins. The fact that I consistently lost weight over a period of a months time under the care of a physician and a dietician means I was  doing this safely. There are also no warning that generate during the game that tell you are not being "safe" or that you have the potential to be disqualified (example: 3 strikes and your out). All I am asking for is a refund of the $40.00 dollars that I paid the company. I should have investigated the company further during the sign up process to see all the negative feed back I have found about the company on line. Please rule in my favor on this issue. The company is in the wrong. Had I lost fair and square I would have no issues. They are picking and choosing who is eligible. I feel like they are fixing the games to their advantage.

ALL players.

Winning status in our games is based on initial and final weigh-in photos. To win the type of game in question, players must lose between 4-11.99% of their initial weigh-in. If a player loses too little, they are not a winner. If a player loses too much, as was the case here, they are disqualified...

for unsafe weight loss. This rule can be found here: [redacted] under points 13 and 14 and here: [redacted] under winnings. We have these rules in place to ensure that all players are participating in a healthy and safe manner for the game. Most doctors recommend 1% of your weight to be lost each week, for a total of 4% over the length of our games. In this case, the user lost 13.75% of her weight. While this user did submit weekly weigh-ins, these are not used to monitor progress. These weigh-ins are solely used for a chance to win prizes. Details on membership can be found here: [redacted]Additionally, although the user submitted these weigh-ins, none of these submissions had a weight low enough for disqualification until the final weigh-in, on February 1. Therefore, even if our system was monitoring for this, no warnings would have been triggered until that final weigh-in. It is a player's responsibility to read and adhere to our rules.

I am rejecting this response because: I still do not agree with their finding. I also say that they disclosed the winners in our group. We had a total pool of $735.00 the stated that their were 4 winner, which is great. The prizes they handed out were for $68.91 each winner. If I do the math correctly that is a total of $275.64, where did the other $459.36 from the pool go? I find this business practices to be very unusual.
