Diggs Plumbing was contracted to complete HVAC work on my remodel project. They were to install 3 major appliances including 2 furnaces and one water heater. All 3 needed to be moved and reinstalled after they failed to comply with building codes or the building plans. They overcharged on projects that they did not attain change orders on. They were paid for finished work and did not provide the service. Other plumbers had to be paid to do the work Diggs was paid to do. They would not return 25 or more calls from myself and my contractor. They did not comply on their obligation to sign off on paperwork the county requires to complete the building code obligations. This amount will barely cover the replacement work I needed to attain to fix the problems they created. Business Response [redacted] has asked us to pay him $10000 and stated that we are a poorly run business. We would also like to see this matter resolved and here is a letter to explain our position. Diggs Plumbing & Heating submitted propsal July 2012 to owner of [redacted] for Hvac installation for $9175.00. Plumbing proposal submitted July 2012 for $10075.00 and an additional fixture allowance of $4000 . Proposal submitted September 2013 for additional of second furnace $4589. Other plumbing invoicing submitted for additional items per request of [redacted]. Existing water heater was relocated into crawl space as directed by onsite foreman. On November 14th 2013 additional plumbing not included in proposal was requested by [redacted] builders. This was to include adding shower to upstairs bathroom/ and add lav upstairs. Installed new washer box and install new dryer vent per request of [redacted]. All Plumbing was installed and tested. Inspected and signed off by [redacted] County. These change orders were requested and approved for work by owner of [redacted]. According to homeowner these were never approved on his end. Again, our contracts were with [redacted]. Not sure why we were asked to do the work by [redacted] if the homeowner did not want work performed or had approved it. Had a discussion with homeowner by phone who cursed and yelled repeatedly about the project and his unhappiness towards "all of the subcontractors" My response was that we were trying our best to complete his project as directed by [redacted]. Then spoke with [redacted] the following day to discuss homeowners unhappiness and his unwillingness to pay for work performed. Again our contract was with [redacted] directly and I instructed him that I would not negotiate with the homeowner on a contract between he and I. The agreement was made at that time that we would be paid for work performed and that [redacted] agreed to pay for half of stolen furnaces and we would cover the remaining amount in good faith towards the homeowner. In December we requested resolution from [redacted] as to why no payment had been received as promised. We have continued to send statements/emails regarding overdue monies owed with response at times of check is in the mail or no response at all. Received request for paperwork of completion and we responded that we were still awaiting payment and then have since discovered that the job was finished but not by Diggs Plumbing. Diggs Plumbing was not asked to complete job or make any corrections. We cannot sign off on a job that we did not finish. While we understand the frustration of the homeowner we think the request for $10000 in unwarranted. We still have $12897 that has not been paid to us for work requested and contracted through [redacted] for [redacted]'s project. We think that [redacted] is responsible for payment to Diggs Plumbing and Heating and we do not feel responsible for any additional expense for this job. [redacted] is responsible to resolve this issue with the homeowner and with Diggs Plumbing. Diggs Plumbing is also awaiting overdue payment from [redacted] on another project for $3635. Consumer Response These are unbelievable lies. They installed all 3 appliances all in the wrong places. Homeowner had to pay for them to be moved to their correct places. One furnace was installed on a Saturday when no foreman was on site. I would like [redacted] to produce one signed change order for this extra work he claimed he did. He can't because he never submitted one for review let alone for signing. He claims we did not call for finish work-- so far from the truth, diggs was both emailed and called, maybe 25 calls total with NO response. With respect to the theft, [redacted] was aware this was an unsecured site, he left the units in a garage with no garage door. I never cussed at him either.
