Revdex.com:I have reviewed the response made by the business in reference to complaint ID 10815432, and have determined that this does not resolve my complaint For your reference, details ofthe offer I reviewed appear below.I see two problems in MrD [redacted] 's response:1) He does not understand the nature of a warranty complaint, so I will attempt to explain.WARRANTY COMPLAINT - Customer's claim for repair or replacement of, or compensation for non-performance or under-performance of a service or item as provided In my original complaint I've outlined a number of problems with the work performed in the bathroom renovation This is a complaint of unacceptable workmanship that needs to be corrected, periodMrD [redacted] did not address the warranty issues in his response to the original complaint.2) It seems MrD [redacted] does not have his facts straight and prefers to tell a story rather than address the warranty issues, so I'll also tell my story to set the record straight.Yes, I did fail to order a sufficient amount of tile to finish the entire job That issue was discovered on the fourth day (Thursday) of the bathroom remodel that was to take four days At that point in time the floor and base tile were not installed or grouted, the toilet was not installed, the sink drain and fixtures were not assembled to the new vanity top, the old vanity top was still affixed to the existing vanity, the vanity was not installed and trimmed out, the wood transition from the bathroom tile floor to the hall was not installed or on-hand, and the bathroom walls and ceiling were not yet painted MrD [redacted] had informed me that he had provided for a fifth day to complete the job (Friday) and that he had another job scheduled to begin the following Monday How he intended to get all of the incomplete work completed in one day without coming back is a mystery to me.There were a number of issues that occurred during the remodel that contributed to delays in timely completion of the job that were beyond my control and could have been much worse had I not noticed them when I looked over the work completed at the end of each day a) Incorrect shower fixtures were installed that had to be removed, re-installed, and re-plumbed These fixtures were brought in by the crew even though we had purchased the necessary fixtures ahead of time and had them on hand as noted in MrD [redacted] 's response to the complaint b) On another day I noticed that one of the wall tiles that had been placed that day had slipped and was out ofposition leaving no room for grout between it and a lower tile That tile was immediately removed with the quickset that had not yet fully cured on the wall and the tile That tile had to be re-installed the next day c) On yet another day I noticed that one of the wall tiles on the opposing wall was significantly protruding beyond the rest of the tiles on the wall - thetiles were to be installed flush That tile had to be broken out, re-cut, re-installed, and re-grouted.The bathroom was painted on Friday - the wrong color – it was to be painted white My wife and I purchased new paint and repainted the bathroom walls and ceiling the next night - the two of us completed the work in one hour Note that I had asked to have the bathroom painted in addition to the work outlined in the original contract MrD [redacted] agreed to do the painting and I agreed with MrD [redacted] to settle up the additional charges at the end of the job This is the ONLY additional charge I authorizedAfter completion of the painting MrOrr asked me if I would like to have the toilet and vanity installed until the tile came in I have only one bathroom so, of course I agreed I was not informed of any extra charges before or during the temporary installation.I ordered the additional tile which was shipped in one week later During the time I was waiting for the tile I noticed deficiencies in the workmanship outlined in my original Revdex.com complaint and informed MrD [redacted] that there were problems that were in need of repair.I called Mr D [redacted] and informed him that the tile had come in and to find out when he could return to complete the remodel He informed me that there would be extra charges that would have to be paid before he would come back and finish the job: a $charge to come back and set up, a $charge for temporarily setting the toilet, another $charge for temporarily setting the old vanity, additional charges for conditioning the toilet drain, and nine hours labor to prep and paint the bathroom walls I contested the scharge and the charges to temporarily set the toilet and vanity A standoff ensued that lasted for a number of days during which I offered to pay for two hours labor for the temporary installation the toilet and vanity which I felt was fair for a temporary set - Mr.D [redacted] rejected the offer and threated to take me to court I continued to attempt to negotiate taking on more of the work that should have been done by MrD [redacted] under the original contract. In the end I paid MrD [redacted] in full the remaining balance of charges from the original contract, the full nine hours charged for the prep and paint of the bathroom walls, and the additional charge for the work done on the toilet drain based on the following conditions:MrD [redacted] would complete installation of the tile floor and base tile according to the original contract and fix the warranty problems I have listed in my original Revdex.com complaint Note that the base tile on either side of the vanity was not measured correctly and had to be removed to install the vanity, that tile needs to be re-cut, re-installed, and re-grouted.For my part I would set the toilet, assemble the sink drain and fixtures to the new vanity top, remove the existing vanity top, install the vanity base to the wall, install the new vanity top to the vanity, and hothe sink supply lines and drain Mr D [redacted] did not believe re-installation of the toilet paper dispenser, towel bar, sink mirror, and shelf were his responsibility even though he removed them from the walls, so I replaced them as well I also purchased a piece of oak, made and installed a transition piece from the tile floor to the hall as the top of the existing transition was lower than the new tile floor - that work was also disregarded by MrD [redacted] and the gap between the tile and the transition has yet to be grouted. To date MrD [redacted] has not addressed the listed warranty items and refuses to return my calls.Regards, [redacted] ***

I am responding to the allegations in the Complaint Mr*** filed with the Revdex.com against my Company, D*** Contracting on September 15, 2015. Mr*** hired us to remodel his bathroom, but he wanted to order his own tile,
fixtures and shower doorWe almost completed the remodeling when we ran out of tileWe had to tear down and return in a few weeksMr. *** asked us to temporarily re-install his toilet and sink/ vanity, so they could use the bathroomWe told him there would be an additional charge for installing fixtures twice, and setting up twiceHe said that was fineUpon returning, we finished everything, except for one piece of wall base tile, because Mr*** sent his register grate out to be paintedWe at this time, repaired a few small items that concerned Mr***At this time I presented a final invoiceAs the Contract clearly states, any additional work or repairs are additional, at an hourly rateNot only would Mr*** not pay that amount, he gave me an itemized invoice of his own, telling me how long he thought it should take, and naming his own rate and total amount, along with not paying to come back, and re-set upI just told him we would except that amount and hurry up and leaveHe did pay that amount at this timeThen when his register came in, weeks later, he wanted us to come back, reset up the wet saw, and install one piece of tile baseI would notSo he turned us in to the Revdex.com with his version of a fairy tale story! We have great record, and we intend to keep itWe do not get complaintsIt's a shame some people act like children.Thank you,Gary D***

Per our discussion 5/10/15, MrD*** has suggested that there might be an issue with the shower door causing the problem I've asked him to repair- water running out of the shower and onto the bathroom floor. I did some homework and have included my findings in this email. Note that the shower door is a two part frameless door installed with the pivoting section hinged to the left hand shower wall, and the stationary section secured to both the right hand shower wall and the shower curb.I contacted the business I purchased the door from for assistance relating to MrD***'s concern, *** ***, Erie, PA. The representative at Trumbull looked up my purchase order finding that the door is a RODA model CELA-and directed me to contact ***, the manufacturer of the door, for any warranty complaints.I phoned *** and was put in touch with *** *** to help with technical assistance for the door. Ms*** asked if the door was damaged in any way and proceeded to explain that the door set is not guaranteed to be leak free, but explained that water should not be running out onto the bathroom floor if the door was installed correctly. She attached a set of the installation directions for reference which is attached to this email.Ms*** suggested I check the pitch of the shower curb to ensure that the curb slopes inward toward the shower so that any water striking the door would run back into the shower as opposed to out onto the bathroom floor. She further stated that the top of the shower curb should drop at least 1/inch from the outside edge to the inside edge to establish the proper pitch. I have attached a two pictures to illustrate that the slope of the shower curb does not meet the manufacturer's installation recommendations. I placed a level on top of the curb as shown in the attached picture titled Level.jpg and then took a close up of the level's bubble shown in the attachment Bubble.jpg. It can be clearly seen that the bubble in the level is toward the interior of the shower indicating that the interior edge of the curb is higher than the exterior edge - exactly opposite the manufacturer's recommendation. The shower curb is sloped the wrong way._________While I was taking pictures of the door I thought I might illustrate another issue I have with the shower door, that the pivot section of the door was not properly aligned with the stationary section of the door during installation.1) I took a measurement of the distance between the door glass and the front of the shower curb on the left (pivot side) and right (stationary side) of the doors in the shower opening. These measurements can be seen in the attachments LH Door.jpg and RH Door.jpg. The measurement clearly shows that the doors are off by about 1/inch. It's a noticeable and unacceptable misalignment that can also be verified with a straight edge.2) I also took two photos of the top center of the doors to show that they don't come together either in height, Door Center1.jpg; or inside to outside, Door Center.jpg.2a) Door Center shows the difference in height between the pivot and stationary doors. Both door sections should be the same height.2b) Door Center is a photo of the top of the doors shot from the left hand side. The black vertical band in the center of the picture is the edge of the stationary door showing that the pivot door, closest to the lens, is both lower and tipped inward in relation to the stationary door (note that the bottom of the left and right doors were carefully lined up prior to taking this picture)

Review: D[redacted] Contracting was contracted to do a bathroom renovation including a walk-in tiled shower, shower lighting, tiled floor, installation of toilet, vanity, and associated plumbing and drain fixtures. There are four outstanding issues with the renovation:

1) The shower leaks over the curb with water running out of the shower, onto the bathroom floor, and into the basement. The contractor made a failed attempt to fix this problem.

2) One of the two lights installed in the shower ceiling does not work properly.

3) The shower door was not installed straight.

4) Some of the pieces of base tile have not been installed.

I have made repeated attempts to contact the proprietor, Gary D[redacted], and the project manager, Jason Orr, by telephone and email. Neither the proprietor or project manager are returning my calls. D[redacted] Contracting has been paid in full for the renovation.Desired Settlement: Correct the problems with the renovation as detailed in the complaint.
