We are in receipt of your correspondence dated January 8, 2018, transmitting the above-referenced inquiryThe company appreciates the opportunity to respondPlease note the correct underwriting company for the above referenced Private Passenger Automobile policy is [redacted] [redacted] *** On November 8, 2016, a twelve month policy was bound for the complainant based on the information she providedAt the policy’s inception, the complainant disclosed her husband an excluded driver On January 2, 2018, the complainant contacted the company and advised that the vehicle had been involved in an accidentThe complainant stated that while her husband was operating the vehicle, he over corrected and side swiped a wall and a fenceDue to immediate concerns surrounding the complainant’s husband being listed as an excluded driver, the company opened a coverage investigation to determine if coverage would be afforded for this loss On January 4, 2018, the Claims Representative contacted the agent to verify that the insured was aware that she was excluding her husband as a driver on the policyThe agent advised that she had a long conversation with the insured regarding listing the insured’s husband as an excluded driver, and verifying that the insured was aware that her husband was listed as an excluded driverFurthermore, the insured did sign the driver exclusion form stating she was aware that her spouse would not be listed as a driver on the policyAs a result, the company denied the referenced claim, and a letter of denial was mailed to the complainant accordingly While we understand this is not the outcome the consumer was hoping for, it is our position that the exclusion of the complainant’s husband, and subsequent claim denial were handled appropriatelyThank you again for allowing us to address this issue Please don’t hesitate to contact me directly at [redacted] x: [redacted] or [redacted] should you have questions or require additional information Very Truly Yours, [redacted]
