I am rejecting this response because:Offered loaner forklift: what do I tell my customer if a [redacted] comes to pick it up?offered to transfer purchase price: I was told nothing was available that met the specifications of the machine I purchased.Offered: $1,000 discount $360. This was interest for 60 days we are another 30 days past, 90 days into the transaction. I asked for a cashier's check because you are in Chapter 11 bankruptcy & according to bankruptcy records are operating at a loss. You have had my $26,470 for 90 days without delivering a product, I don't find it unreasonable to ask for $1,360 now because you refuse to give a delivery date.

lift was dropped off and when the forklift was picked back up.  Because [redacted] is not here, I can only attest for the facts and I can’t entertain any “he said, she said.”  The claim of only having the forklifts for just one day simply isn’t true.  I see tow logs documenting the forklifts were delivered on Friday 9-23-2016 and picked back up on Tuesday 9-27-2016.  So the bill was adjusted to a (3)-day rental.  However, I don’t believe this is more cost effective for Mr [redacted]. We cannot attest for how many days the forklift was actually used but I know how many days they were in his possession.  While in his possession we are not able to rent the forklifts out to anyone else.   What Mr [redacted] needs to understand, as you rent the forklift at the day-rate, it becomes cheaper to just pay for the week.  No different than renting at the weekly-rate, it quickly becomes cheaper to rent for the month.  The more you rent, the larger the discount.  You lose the savings by shortening the rent.  Please see rental rates attached. We’d also like Mr [redacted] to understand, when he signs paperwork to rent the forklifts for week, he is committing to that even if he changes his mind.  The forklifts are removed from the system (off the market) so nobody else can rent them.   When we correct the invoice to reflect renting the machines for (3) days, the complete total is $10,336.91.  The grand total that Mr [redacted] paid for all (4) of his rentals was $7,511.70.  Mr [redacted] isn’t owed a refund but in fact should actually owe Discount Forklift more.  I feel that [redacted] gave Mr [redacted] a more than fair deal.  In the interest of good customer service, we currently are not looking to pursue any collection efforts against [redacted] and Associates. Sincerly, [redacted], President - Discount Forklifts

Good morning,On behalf of Discount Forklift, I apologize for the delivery delay! This response will summarize the conversations between Discount Forklift and Equipment Jockey, LLC.Discount Forklift purchased this lift in As/Is condition. Our process to make this lift ready for sale includes...

mechanical work as well as paint and body work to return the lift to "Wholesale" condition, the condition indicated on Equipment Jockey's paid invoice. In point of fact, we have made significant investments into the lift in excess of $20,000 and now approaching Equipment Jockey's purchase price of the forklift itself. When complete, the forklift will more closely resemble a much higher quality "Rental Ready" condition forklift (definitions attached in Intro Letter which is sent to every customer upon invoice receipt). As is notated in the invoice which was paid in full by Equipment Jockey, LLC; "No cash returns because in the past we have had customers abuse our gracious & accommodating return policy. Now "all sales are final"." (attached)Additionally, as we have previously stated and Equipment Jockey is aware, good lifts take time! Transcription of this email is fouond below.        "Thanks for checking in.  We are in the same boat because I’m excited for you to get your forklift!  My goal is for us to be on the same page throughout your purchase.Please know upfront that our first priority is YOUR best interest.  We can never promise a specific timeframe or deadline.  Any timeframes you may hear are very, VERY rough estimates.  Allow me to explain more thoroughly and help you understand exactly why that is.Unfortunately, we deal with the REAL-world and forklifts do usually take some time to go through the full process which usually includes freight, repairs, service, paint and body work, etc.  This process varies significantly from lift to lift and it’s impossible for us to predict what each lift will require.  Example: When we perform our 80-point-service we may determine we must order fuel system parts to get the forklift running.  Once the parts arrive and are installed, we can then test drive your machine.  At that point, we may realize your forklift needs brakes, so then parts get ordered for that repair.  Once the brakes are installed and functioning properly, we drive the machine around more at operating temperature.  We then discover an antifreeze leak requiring the radiator to be sent to a specialist for repair.  Sometimes the process can be multiple stages and we cannot predict what will be required every time for every lift.  Some forklifts come through the shop and only require the thorough 80-point-service and the machine moves into paint and body within one day. Since most of our machines are sold “As Is”, it’s crucial that we deliver the best machine for your money.  After you receive the lift, it will be up to you and your company to operate it correctly, service it, and perform the needed repairs for years to come.  As long as the machine is in our custody, everything is free to you, meaning we are spending OUR money on YOUR machine (that’s a good thing for you!) Because forklifts and equipment are a 20+ year investment, it’s always worth the wait if we need additional time to prepare your forklift.  We often get pushed by customers that want the forklift “yesterday.”  Even if we prematurely shoved the forklift out the door to meet an unrealistic deadline, if the forklift arrives and is not in proper working condition, meeting that deadline is irrelevant and we’d have an even MORE upset customer.Remember, our first priority is YOUR best interest - if I feel we need more time, it’s because your machine is not ready to go to work for you yet.  Something else to keep in mind; my team works on commission!  They only get paid AFTER you receive your forklift and are happy with it!  I’m just like any other hard-working American trying to make an honest living for my family. We all have rent, groceries, bills, etc, so trust me when I say I have my own motives to be 100% on your side getting you your forklift delivered because only then do we get paid. We are allies, not enemies!We pride ourselves on transparency, so what I will do is keep you updated throughout the process.  After your forklift has completed all the stages, [redacted] will personally test drive your forklift so he can give it his personal stamp of approval. Once this is done, we will shoot a [redacted] video of it in operation and email you that video before it ships to you!Thanks! I look forward to getting you your forklift soon!"Discount Forklift has made several offers to Equipment Jockey to date:- Offered a loaner forklift to Equipment Jockey's customer provided at our expense until this forklift was complete- Offered to transfer his purchase price to a different forklift of comparable value with him only paying the difference in cost- Offered $1000 discount and $360 (stated value of Equipment Jockey's bank note) as a gesture of good faith and customer service upon delivery and acceptance of the forklift- Stipulated to an inspection by an outside expert hired by Equipment Jockey to inspect the forkliftThe first two (2) offers were denied. The second two (2) offers were partially accepted with Equipment Jockey attempting to demand more unreasonable concessions including the $1360 payment tendered in person by cashier's check before delivery was completed and the outside expert showing up at our shop unannounced to examine the forklift.At this point in time, Discount Forklift has gone above and beyond to try to solve this unfortunate issue. Our proposed offer has been and will remain as follows:- Delivery of the forklift to the customer upon satisfactory completion of mechanical, paint and body work to restore the forklift to 'Wholesale' condition- $1000 discount and $360 (stated value of Equipment Jockey's bank note) as a gesture of good faith and customer service upon delivery and acceptance of the forklift- Additional inspection by an outside expert hired by Equipment JockeyWe are looking forward to completing this deal soon!

Discount Forklift prides itself on being an honorable company & is offended having its integrity challenged.  Discount Forklift has an A+ rating & is proud of being a reputable company.   “Standing behind your product” is a very fine line to walk.  On one side, Discount...

Forklift wants to protect its reputation & provide good customer service for their clients to strive for repeat business & referrals.  On the other side, Discount Forklift doesn’t want to be taken advantage of either.  Just because Discount Forklift sold the forklift it’s not our responsibility to “babysit” this forklift forever.  It’s now Island Granite responsibility to service, maintain, & repair their own machine.  Discount Forklift is not operating the forklift, we can’t control the proper usage of the machine.   An example of this…  This used forklift was sold “As Is” by Discount Forklift.  The machine left working properly but a few days after the forklift arrived the alternator failed.  Alternators are a wearable item that no one can predict would wear out.  Regardless, to the “As Is” sale, Discount Forklift spent a significant amount of time trouble shooting with tech support to diagnose this issue.  With no legal obligation, Discount Forklift then bought a new alternator & freighted it to Island Granite in good faith.    Island Granite’s frustrations are not with Discount Forklift, but with [redacted] & [redacted].  Allow me to explain…  [redacted]’s effective warranty date is April 20th.  [redacted] Cat made a service call on April 27th.  Hence, warranty into effect.  Island Granite needs to file their claim with [redacted].  [redacted] would then determine if this repair is covered by the “warranty inclusions” based upon their policy of warranty coverage.    [redacted] really took advantage of Island Granite.  The service bill is absolutely absurd!  They charged thousands of dollars for putting in a starter & performing service checks on the machine.  A repair that should only cost a few hundred dollars anywhere else.  If Island Granite opted to choose [redacted] Cat to work on their machine, then they are responsible for the bill & they at risk if the repair will be covered under warranty or not.       Discount Forklift has already shown good faith to appease Island Granite beyond their legal obligation.  The warranty is into effect with [redacted] & they will need to understand coverage “Inclusions VS Exclusions” per their warranty policy.  I would advise Island Granite to not use [redacted] Cat any longer as result of their overcharging.    Discount Forklift wishes Island Granite many years of success & prosperity!
