I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait until for the business to perform this action and, if it does, will consider this complaint resolved.

I am writing you with regards to the letter I had se nt you dated 08/22/2015. The President of the above company contacted me and explained the situation to me. It seems that his company was not at fault. The processing company had charged me fees, which I felt we re not fair. He has tried toreverse the charges in my behalf by asking the processing company to refund me what they havecharged me.  They have agreed to do so.Iam pleased that [redacted] (President of DPS) took these steps in my behalf and was successful.I am sorry I filed the complai nt against DPS. I would like to correct this situation. I am withdrawing my complaint aga inst DPS, since they were not at fault. Please correct the record and reverse my complaint from yo ur files.Finally, Iwould like to express my satisfact ion and I am ext remely thankful to you for helping mebring this issue to the responsib le party. Unfortunately, the merchant left out severaldetails in his recitation of the facts surrounding this issue. 1.      The rates for Almost New Auto Rental with [redacted] are adjusted over time based on the industry...

costs2.      They have actually been reduced over the timethey have had an account3.      The rate is currently 1.49%, not 4.8%4.      The cancellation form was received on June 30,2015 at which time [redacted] of our office discussed the cancellation with the merchant. She advised the merchant that he hasnot been able to see the saving on the rates that had  been adjusted because he didn’t give enoughtime. The merchant agreed to stay with just for the month of July so he couldsee the saving of what we have changed on his rates. Nothing was heardback again from the merchant. No cancellation form was resubmitted. Wetherefore assumed that he was now content with the pricing reductions. 5.      No charges were fraudulent. All charges wereaccording to the terms of the processing agreement.6.      The $75 annual PCI DSS fee is not fornon-compliance, as is claimed in this dispute. It is the payment for theservice provider, [redacted], to complete this certification. The existence ofhis certificate is validation that service was provided for the last year forthis PCI DSS Certification service through [redacted]. This annual fee ischarged by [redacted] and remitted to [redacted]. Discount PaymentServices has no participation in this fee and does not have the authority torefund this fee. With no reasonable justification to refund this fee, [redacted] asserts that the fee will stand and service was provided.7.      The request for cancellation that was attachedto the complaint has now been sent in to [redacted]. The contract was with [redacted]directly and they will process the request. We have no authority to cancel acontract between two third parties.The fees that were charged for the month of July were as a result of the merchantagreeing to continue withthe service in order to evaluate savings. The annual fee is not fornon-compliance as it is an annual fee charged for the service provided.

Review: We have been with DPS for more than 10 years. At the beginning they gave a

reasonable rate to process our credit card business. Then slowly they started to

raise their rates until they got to 4.8%. So, we got fed up with them and cancelled

their service (see enclosed cancellation letter) and went with another company. The

rate the new company is charging us is 2.8%, a very reasonable rate, saving us a

whole 2%. As a small company, Oust myself and my son) any savings would be very

helpful to us.

When we cancelled with DPS, we told them make it effective end of June 2015 and

faxed to them several days before the end of the month as per their request (fax

went to them June 23 rd). We were charged for two transactions in June $121.15 of

which $46.15 were fees for the two transactions and $75.00 wee fraudulent charges

for something called PCI DSS fees (copy of merchant statement enclosed). Even

though we were in compliance (please see certificate of compliance for 2014 and

2015). We asked them to refund the $75.00 they refused.

On top of this they charged $35.93 for July 2015, even though we had no transaction

with them in July since we closed our account in June. Again, we asked them kindly

if they could refund the above items they refused, which shows how far they will go

to cheat us because we found a much better deal than what they were charging us.

This is a free country where competition is the basis of a free society. These people

wanted to gauge me up to the last minute.Desired Settlement: I am asking a refund of $75.00 and

$35.93 a total of $110.93. If they refund the above amount I will withdraw my

complaint, otherwise I will insist that it be part of your permanent file.
