Review: On August 5, 2014 the Plaintiff, [redacted], entered into a written agreement with the Defendant, [redacted]. The terms of the agreement are as follows : I hired the defendant [redacted] who owns the company Discount Swimming Pool Services of Delaware to install a new 27 millimeter vinyl pool liner in my swimming pool. His work was to include minor touch up on the concrete bottom, replacement of the main drain face plate, return face plates and four truckloads of water as well as removal of the old liner and removal and replacement of the pool light during the install of the new liner. I signed a contract with him on August 5, 2014 . I provided a check to him on August 7th in the amount of $2100 for him to order the liner per the contract. He took measurements and ordered the liner and finally attempted to install the liner on the 11th of September. During the period up until the 11th of September I had to call Mr. [redacted] several times to ask about the delivery date of the new liner. During the installation of the liner he asked me for the second installment of $1000 per the contract and I so I gave him a check for the amount owed. During the installation of the liner on the 11th of September it was apparent that the liner was the wrong size. Mr. [redacted] did not convey this information to me as he left the job and I had to call him several times over the following week and he finally explained to me that the liner was not the correct dimensions. He told me he was in touch with the factory McEwen Industries to see who may have been at fault for the mistake. He explained to me at a later date that the way it works is that he sends the measurements to the factory and they send them back and he has to sign off on them before they will make the liner. I was told by Mr. [redacted] they sent him the wrong measurements and he signed off on them without noticing the mistake. He also told me at a later date that the factory would not absorb the cost of the mistake and so Mr. [redacted] would have to incur the cost. It is at this point that I was misled on many occasions about when the liner would be reordered. I finally found out through Mr. [redacted] that he was waiting until the prices of the liners would come down in the fall so he would not lose as much money. After many attempts over several months to contact Mr. [redacted] through telephone calls and e mails I have been unsuccessful in convincing him that I am not happy with his service because of the delays in ordering the liner. I also expressed to him that once the liner was ordered I would like to take possession of the liner until he could install it in the Spring when the weather is warmer which is recommended by the factory for proper installation. He has gone weeks without returning my phone calls and emails. He has not ordered the liner to this day nor has he returned the $1000 installment I paid him for the installation and truck loads of water that was not delivered because of the liner mistake. I have been very patient throughout this process but Mr.[redacted] has not shown due diligence in trying to rectify the situation by ordering the liner and has promised multiple times that he was ordering the liner only to find out weeks later he never followed through. He has not communicated to me when he will order the liner nor has he made any attempt to call me without me having to initiate dialogue to try and resolve the issue. Mr. [redacted] has not provided the services that I have paid for. I would like a complete refund of my $3100 and dissolve any agreement I have for his services as I have lost complete trust in his ability to follow through with a quality job in a timely manner. The Plaintiff met the requirements of the agreement on August 7, 2014. The Defendant, [redacted], has failed to meet the requirements of the contract agreement and is no longer responding to my telephone calls or emails.

The Defendant has not paid the Plaintiff. The balance owed is $3,100.00.Desired Settlement: I would like a complete refund of my $3100 and dissolve any agreement with this company. Mr. [redacted] has misled and deceived me throughout the entire time I have tried to have him install the pool liner that I paid him to install. He has stopped returning my telephone calls and e mails requesting him to fulfill his contractual agreement. I have discovered that he has other victims that he has done this to and I want to make sure other unsuspecting victims do not have to endure his criminal business practices.

Review: The Discount Swimming Pool Service of Delaware started to build our pool in the fall of 2013. Due to the weather we had to stop. He was suppose to re-start in the spring of 2014.

For many months he was telling us all kind of excuses why it is delayed. Finally, in July of 2014 he admitted in the text that he doesn't have our money any more and can't continue.

Based on our written contract we over paid him almost $15,000.00.Desired Settlement: We want to get our money back.
