On October 12, 2017, District Contracting Services, LLC (hereafter refer as DCS) received via US Mail notification that a past customer of DCS had filed a complaint with your organization, in which the customer identified her allegationsI would like to thank you for giving DCS an opportunity to respond to the Customer's allegations.BackgroundAs a brief backgroundOn or around December 5, 2016, DCS entered into a Contract for Services at the Customer's house; however, DCS Commenced the work on January 9, From January through May 2017, DCS worked in the Customer's house in the main level and basementFrom June through early August, 2017, DCS did not work at Customer's houseOn August 8th and 9th, DCS returned to the Customer's house to complete a small section of a wall and ceiling inside a closet after the Customer had changed the house electrical panel, which was completed by another provider, DCS did not receive payment for switching the electrical panel; therefore, DCS services ended in May 2017.Response to the AllegationDCS is not disputing the customer's position that a 1-year warranty was giving to the Customer, it was written into the contractHowever, DCS dispute the time requested by the Customer that her 1-warranty Commence On August 8, The warranty given to the customer is for the workmanship performed by DCSHowever, it is DCS's position that the customer warranty timeframe is from May through May 2018.DCS Completed the work at Customer's house in May As a result of Completing the work, DCS submitted final invoice on May 9, via email to the customer, (Exhibit 1) On May 11, 2017, DCS deposited the final payment(Exhibit 2) DCS would not have taken the customer's final payment if the work was not completed, nor the customer would have paid DCS for the workThe Customer had possession and access to all areas of her house on May 8, Therefore, the warranty timeframe is from May through May 2018.On May 8, 2017, the parties agreed that DCS would not charge the entire amount for the final payment because a small Section of a closet was not Completed due to fact that the Customer was changing the electrical panel(As a note: Switching the electrical panel was not part of DCS Services or any payment was giving to DCS for the switching electrical panelTherefore, DCS does not see a Continuation of Services during that time from June and August, 2017.) And, the incomplete area was equated by DCS to the amount of money not charged to the Customer,In or around July 2017, the Customer notified DCS that the electrical panel has been changedThereafter, DCS scheduled a date to go back to Customer's house to complete the section in the closetWork was completed August 8-9, On this time, the customer utilized her warranty by informing DCS that there was an issue with the kitchen's floorOn August 8-9, 2017, DCS addressed the Customer's Concern about kitchen floor with no cost to herTo date, DCS has not received a request to perform any additional work under the warranty time frame.DCS does not have a problem in proving warranty from August through August for the Small section of the work completed in AugustHowever, the work completed in May is cover until May per the one year warranty for the Workmanship as indicated in the contract signed
