The complainant’s telephone number was provided as a contact number for an account assigned to this office for collectionOn September 29, the complainant informed us that this was not a correct contact numberWe immediately removed the number form the accountNo further calls were placed to that number

We have had one conversation with an individual that we assume is the complainantWe cannot be certain because the individual we spoke with on August 30, at the telephone number listed by the complainant in this complaint refused to identify themselves and refused to state whether or not the
person we were attempting to contact was availableThe telephone number was removed from the account as it did not appear that it would be productive to call the number againThis was the only contact we have had at the telephone number ###-###-####The complainant’s allegations of multiple contacts and people telling him that they will keep calling his number simply did not happenWe keep complete and accurate records of all telephone activity as well as automatically recording all telephone callsWe can say with absolute certainty that the activities alleged by this complainant did not occur

I am rejecting this response because: I do not accept being called a liarI paid this collection as well as ones in the past when I knew about themYet, this company responds to this buying calling my complaint untruthfulThey did remove the account from my credit report, after I submitted this complaintThey in no way responded about their employees lying and only abiding by the agreement because I recorded the phone callsThey in no way directed their customer service attitude towards me even after I paid the debt offInstead, they blame me and call me a liarWhy would I need to lie about paying a debt off? In no way did the apologize instead blame and accuse meThis is not a business that should have a Revdex.com positive ratingYou can tell from the responses to other complaints they only blame and accuse the customersThey even lied in their response to the complaint saying the delete order had been issuedWhen they told me they can not remove accounts from credit reports and that it was updated as paid and that is all they could doWhen I confronted them about my recording of the phone call with them agreeing to delete it if I paid it they denied the ability to remove itLIES LIES LIES and Accusations

The complainant definitively states that he did not apprise his creditor of his new addressI find it surprising that anyone acting in good faith would make such an assertion and then deflect all blame for the consequences of their action from themselvesOnce we had the complainant’s new address we issued a placement letter which the complainant should now haveThe complainant has also admittedly received the itemization for the amount owedIt would seem that if the complainant is truly acting in good faith the only action item remaining here is for the complainant to remit the $3,that is owed

The complainant’s outstanding debt in the amount of $1,was referred to our office for collection in May of I have listened to all of the call recordings for this account and I can state that the allegations stated in this complaint are simply untrueThis appears to be a case where the
old adage “no good deed goes unpunished” is trueOur employees worked with the complainant, extending payment arrangements far beyond our norm to accommodate the complainantAt no time was the complainant ever told that we would not report to the credit bureaus until the account was paidThis simply did not happen and, in fact, we have made multiple reports to the credit bureaus with the reported balance reduced by any payments applied to the account prior to that reportIf it is in fact true that the complainant’s credit score has dropped it is certainly not due to any activity on the part of this office. We report accurate information to the credit bureaus, we do it regularly in the ordinary course of business, and we have done so on the complainant’s account.We have acted in good faith to work with the complainant to resolve an unpaid debt within the means the complainant has alleged to be possibleIt is unfortunate that the people who worked with the complainant are unfairly accused of actions that simply did not occur.Sincerely,Peter M***General Counsel

Diversified Adjustment Service claims in their response that they don't report credit activity for *** ***That seems odd seeing as they send collection notices in the State of California (for which they are not licensed to collect) on behalf of *** *** and threaten to report "unpaid debts" to the major credit bureaus.https://imgur.com/a/HYl0zDiversified Adjustment Service did not take any action nor did they address my concernsThe item remains with their office for collection and could be sold to another debt collector. They have not verified the debt with the original creditorAdditionally they did not send the collections letter to the correct address for proper debt validation practices within the State of California

I am rejecting this response because:This is just a flat out lie, and unfortunately there is no way to prove it since they are the only ones that have access to the recorded phone calls that would tell the real storyI’d be happy to review the phone calls and upload them here so you could know what happened if they’d like to release them to me or maybe they could release them directly to the Revdex.com to clear their name if they are the ones telling the truthI was treated extremely rude on nearly every call and hung up on twice that I remember simply for trying to ask additional questionsI was wanting to know if they had even talked with *** about my offerit was clear they hadn’t and had no intention of doing so which is why I eventually called *** myself Also, another flat out lie that I “chose not” to provide them with proof of my conversation with sprintI did, and gave them a reference number provide by *** to reference the conversationI’ve attached a copy of the email I sent to themAt least I can prove they’re lying about thatI also have a recording of my last phone call with *** I could upload if needed

First, please specify who is responding to my complaintYou didn't specify, and I'm unsureAre you a debt collector and is this an attempt to collect a debt? Are you a 3rd party hired by the debt collector to respond to their complaints?Second, I must demand that you cite specifically when and where the courts have held that each referred debt is a separate matter under the Fair Debt Collection Practices Act and that any request from a consumer to cease communication is effective only as to debts that have been referred to the third party collector as of the time of receipt of the consumer’s request for a cessation of communicationHow do I request that you permanently cease communication with me?Please be aware that any debts you claim I owe are still disputedI also want to state that it is NOT acceptable to contact me via telephone on any past, present, OR future accounts or mattersI also request that you cease all collection activitiesThis includes any negative remarks you may have placed on my credit report

complainant gives in this complaint and have not received the letter back from the US Postal Service as undeliverableWe have never received an answer or a response to our calls to this numberWe will accept the complainant’s representation that this is would not be a correct telephone number for the party that gave it to our creditor client and have removed the number from our account

Complainant: Where are you calling from?Diversified: I am Tyler from Diversified Adjustment ServiceIs this ***?The call was then terminated by the complainant.We placed another call to the complainant’s number on July 18, at 12:PMThis attempt resulted in a No Answer.These are the only two call attempts to the complainant’s number and it is clear that the actual facts here bear no relationship to the allegations made by this complainantThis complaint is clearly filed in bad faith for spurious purposesThis complaint is an abuse of a useful forum and has clearly been filed in bad faithDiversified Adjustment Service, Increquests that the Revdex.com purge this complaint and not list it in reference to our company

The telephone number at issue was provided to a creditor client of ours by a consumer debtor as a contact number for that consumer debtorWe attempted to reach said consumer debtor at the phone number that was providedWe had no contact at the telephone number until November 14, when a party
who refused to identify themselves, which I now assume was the complainant, requested that no further calls be placed to that numberThe number was removed and no further calls have been made to that numberThe complainant’s suggestion that calls occurred after her request to cease calls is simply not accurate

Our records show that we have not placed any phone calls to the complainant’s number as provided with this complaintIf it is a different number that is being called in error we request that the complainant provide that numberIt is not our intention to call phone numbers that are not for
accounts referred to us by our clientsWe do not show the complainant’s name in our records.If the number to which our calls are ending up with is the complainant’s number and we have not been calling the complainant’s number then the calls must be forwarding to the complainant’s number from elsewhere; from a different number we are callingI have seen this situation before with refurbished phones where the phone has not been fully cleared or with newly issued numbers where someone has automatic forwarding to that number from a different phone.If the complainant were able to give us the exact time for a number of calls we may be able to determine whether a common number has been called at those times which may lead us to the number that is causing the forwarding of calls to the complainant’s phoneThis is not something that is within our control but we are willing to do what we can to resolve the issue

complainant agreed to a 60% settlement for the account, a total of $The complainant alleged that she had no present funds so our employee accommodated her by authorizing a post-dated MasterCard payment for December 7, Our employee entered the MasterCard information, read the required disclosures to the complainant, and placed a hold on credit reporting with the pending paymentOur employee cautioned the complainant to ensure that the funds would be available on December 7, and if there were to be a problem to please contact us hours ahead of the payment dateOn November 28, a reminder notice for the December 7, payment was sent to the complainantOn December 7, the complainant’s MasterCard payment was declinedWe placed numerous telephone calls to the complainant and received no responseOn January 10, the credit reporting hold was removed and the complainant’s delinquent account was reported to credit bureausIt was only after her account was reported to credit bureaus that the complainant appeared to take interest in paying the accountHad the complainant kept her word and paid the settlement as agreed there would have been no credit reporting of the accountThe complainant’s still unpaid account was held from credit reporting for over a month while we attempted to contact the complainantThe fault here lies solely with the complainant and her failure to honor her agreement to resolve her delinquent accountIf the complainant wishes to consult an attorney we are certainly fine with that choiceIf a frivolous and baseless lawsuit is filed we will certainly seek monetary sanctions

This complaint is purely frivolousThis specific “complaint” is a recent trend being seen throughout the collection industry. The complainant is simply wrong in her allegation that a signed contract with our company is required in order for us to report her delinquent account on behalf
of our creditor clientsOur credit reporting is in full compliance with the Fair Credit Reporting Act. This is simply an improper attempt to have accurate information deleted from a credit report There is simply no basis for this complaintIt truly appears to be a case of “everything you read on the internet is not necessarily true”!
