i have a signed/notorized document stating [redacted] was selling the property to [redacted]. [redacted] listed the home for sale to be built under false pretenses. [redacted] did not have the funding for this project, and was not going to be able to build this home. This is false advertising on his part as well as his real estate broker [redacted] from [redacted]. By advertising this home and going under contract we put our home up for sale and have incurred large legal bills. [redacted] who is a pharmacist by trade takes a code of ethics and should not be involved in real estate schemes. I feel  he should have come to us when this occurred and explained the situation, not go into hiding. [redacted], [redacted] and [redacted] are all responsible for the losses we have incurred. [redacted] brought [redacted] in as his builder knowing this man was arrested in 2007 for a similar real estate scheme. I hold [redacted] and [redacted] responsible for false representation and advertising, and will be suing them for all damages that we have incurred since gEttinger involved with them in December of 2014.

Review: [redacted], a [redacted], Advertised under the title "[redacted]" of Diversified Real Estate Solutions, LLC. Advertised a home to be built on [redacted]. In January of 2015 we went into contract with [redacted] (Real Estate Developer) to build our new home. Weeks later, we were told that he did not have the financing to build the home and his contractor [redacted] was going to finance the project. Projected date of completion of new home was June *, 2015. In the meanwhile I went into contract with a buyer of my existing home. on March **, 2015 the contractor called us and told us he does not have the money to start the project and cannot build this home. We then tried to contact [redacted] and all numbers we had for him were disconnected and no new numbers could be obtained. We are out $9,000 for the money we gave to them to start the project as well as $25,000 we put down to go into contract, as well as all legal fees we have incurred in the past 3 months. We have tried numerous time to get in touch with the realtor [redacted] from [redacted] and she ignored all of our calls. When we called from an unknown number, she answered the phone and said she hadn't a clue what was going on. We know [redacted] is in with [redacted] on this scheme, as she as listed as living at the same address as him. As of now, we have not received our money back and [redacted] still has this house listed for sale.Desired Settlement: I would like all money returned to me as well as expenses occurred for my lawyer, as well as monetary damages as we will be out of our home as of June **, 2015 with no place to live.

The complainant lied in her initial complaint about not receiving the $25,000 down payment back and ignores that fact here. The complainant lied when she met with the real estate broker and myself when she and her husband informed us they had the funds to pay for the building of the house and the money would be released as the construction was done. When the binder was received and reviewed, there was no mention of this. At this time, no contracts were signed as a result of this issue. Neither myself nor [redacted] were aware [redacted] signed any contract with the complainant as he had no authority from Diversified Real Estate Solutions to do so. Diversified and [redacted] were unaware any contract was signed until the complainant called us about getting back her money. A notarized letter stating that Diversified will transfer its ownership interest in this property to [redacted] upon receiving money does not mean that I have been paid and does not in any way convey authority to [redacted] to sign on behalf of Diversified Real Estate Solutions. No monies have ever been received by Diversified Real Estate Solutions or [redacted] in conjunction with this property from the complainant.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[redacted] is the liar in this situation, not myself or my husband. On our first meeting with [redacted], his realtor/wife and my realtor we presented to them a Home Mortgage commitment letter from our mortgage company. This letter stated we were approved for a home mortgage, not a Construction loan/builders loan. [redacted] is showing his inexperience in the real estate development business by stating we lied. A family would not be approved for a construction loan, only a home mortgage. If [redacted] signed a contract with us unbeknownst to [redacted], I would think he would have pressed charges and brought this matter to the police. It was listed as a home to be built with architect plans included. [redacted] was not selling the land so a family could build a home on their own, he was advertising a 4 bedroom home to be built by him at a price of $589,000. If [redacted] felt we "lied" and did not have the funding for a mortgage, why would he then have two subsequent meetings with us at the [redacted] with my real estate agent as a witness. One of the meetings was when [redacted] brought two of his builders for us to meet and go over the plans that he had for this house. [redacted] being one of the said builders. If [redacted] believed we did not have the funding, why would he waste his time on three meetings? We were pre-approved for a home mortgage, only a liscenced builder or real estate developer can get a construction loan. What I am holding them responsible for is the $9,000 that was given to the builder for architect fees and building permits that should have already been paid by [redacted], the land owner, as well as my legal fees. If in fact [redacted] did not receive any of the payment we made to [redacted], then the Nassau County Police department will be contacted and the Nassau County court system will decide this legal matter. [redacted] caused us to incur legal fees for his misrepresentation of this home. [redacted] Residential cancelled the listing [redacted] had for this home because of the misrepresentation. If he wanted someone to pay to build their own home, then he should have advertised the land for sale for a home to be built, not a home with plans already drawn from an architect. We would have never responded to an add to build our own home on someone else's land. [redacted] should have done his homework to see what was needed to see this project through to the end. He is responsible for the false advertising and misrepresentation of this home as you can see from all documents submitted. Real Estate schemes are a problem in this country and we are filing a complaint against Diversified Real Estate Solutions to let the consumer be aware of this misrepresentation. I feel that if in fact [redacted], and his wife, [redacted] Hollingsworth from [redacted] were "unaware" that [redacted] signed a contract with us, once they found out they would have pressed charges against this builder for falsifying documents and to prove his companies innocence. We will now bring this matter to the police and the court system to let them work out the logistics.
