because the deal states “one to two hour photo shoot”, and I simply knew my

out anywhere in the Groupon that there’s even a price difference between a one

mind I have no reason to do so because I just purchased a Groupon to satisfy
that, according to what is listed on the deal.
Again, nowhere on the Groupon does it state that you have to reference
prices on their website to find out the real cost.During all of our email correspondence
regarding the payment of the $149, it wasn’t until AFTER I stated that this was
a scam and I would be reporting Divno to Groupon for misappropriate information
that she offered for me to pay the $AFTER I viewed the photos. She made it sound like “well of course that’s
been an option the whole time”, but how was I supposed to know that if she
never said it, nor was it in writing anywhere?
If *** would have INITIALLY explained that the $could be paid
either at the time of the shoot OR at the time I wanted to place an order, I
would have gone ahead and kept the appointment and things would have turned out
just fine The reason why I found this
whole situation so misrepresented was because she continually asked for $
upfront. As a merchant (photographer in this
case), you cannot just assume that people know how your small business works;
what your booking or payment policies are; I’m quite certain others run their
photography business differently than yoursOf course I knew I’d be paying an
additional fee(s) for the photos that I selected from the viewable gallery, but
in my mind, that payment would be expected at the time I chose what I
wanted. From a simple search online, I see the
Groupon deal is still being advertised and available for purchase In my final email to *** I suggested she edit
the wording in the Groupon deal, to reflect what is actually included as well
as direct potential customers to her website to find out the prices for a one
or two hour shoot, so as not to mislead anyone elseThis has not been
done. For someone who admits to the miscommunication,
I find it interesting that this has not been rectified.
I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me.

I would like to explain that this situation has been our
first, thank God, complaint of any sort.  We have had two different deals with Groupon and this exact deal has
sold over 20 Groupons.  Our deal is to
basically give our customer a little break on the sitting fee: for us to...

meet
them, take up to 30-40 images, edit them and give the customer their choice of
a 8x10 print. put together this ad for us.  We had
little say in what would exactly read in the text, they asked what we were
offering and then put it together. I don’t disagree with what is
written.  I have had over 20 people
purchase the same Groupon with no issues.  Feel free to visit our Facebook page or read over our Groupon
reviews.  We have 5 stars because we have
earned it.  Mrs. [redacted] never made
it passed a telephone call or an email.    When [redacted] contacted me directly I
shared with her that we come to a specific location where the clients feels the
background will suite his or her wants for their professional photo
session.  We then take a good amount of pictures
(never under 500 raw images) with tons of variety (inside/outside) until we all
feel the session is complete.  Our next
step is to edit the images.  After that
we put all image in a VIEWABLE gallery.  NOT a DOWNLOADABLE one.  I
specified this to her.  So far everything
that is written in the Groupon is exactly what she would be getting.  Whether she paid the day of or after viewing
the images there would be no difference.  Not to me at least.    Below I have attached the two
complete packages off of our website.  One of our packages has 10 digital images for $149 and the other is for
all the images from the session for $249.  Only because in an email she mentioned purchasing a one hour session I
assumed she was referring to the 10 images.  I am a business owner that pays taxes, relies on my business for income
and uses this hard earned money to put food in my children’s mouths.  I would not jeopardize all of that for
$149.  We have a family that comes
first.  I encourage my clients before booking
with us to visit our website, checkout our packages and our work if both are a
fit, let’s do business.  If not, I always
wish them luck in finding the right photographer. We offer the following Complete
Packages.  You will receive an email approximately 1 week following the
date of your session with a link to your own personal viewing gallery.  After
we receive your payment you may then download directly from your personal
gallery.

package.  Well in two hours you can take
more pictures than in one hour.  I
assumed that she was referring to the $149 package.  I specified to have the cashier’s check or
cash available that same day if she already knew what she wanted.  Most people look into their photographer’s
work, the prices and then book with them.  It was entirely my fault for jumping to conclusions without confirming
first that, that is what she was referring to.  After the miscommunication I had
written her a message on how to fix this situation and she was frustrated and
did not want to hear from me any longer.  I haven’t had a client react this way but I understand no two people are
the same.  Again, we aim to please and

what the Groupon entailed. The Groupon saves you $30 off of your sitting fee.
The typical rate we charge is $50 for us to drive to your location, edit your
images and with your Groupon deal, give you a free 8x10 of your choice. After
the images are complete you purchase your photos of choice for an additional
price. When you said I want a hour session I assumed you looked over our prices
and wanted the 10 images for $149. The other option would be to spend $249 on
print rights to the other 20 or 30 images we take for a longer session. You get 30 or 40 edited images in a viewing
gallery not a downloadable gallery.  We provide a print released if asked
by our clients and all the images they purchase through downloadable galleries. I thought I went over all of this with you on
the phone so I apologize if you misunderstood. If this is something you are not interested in
please contact Groupon and return your purchase. I wish I could come to your home, take
pictures, edit them and give over all print rights for $20 plus throw in an
8x10 print but we are a business and that wouldn't be beneficial for us.  I'm sure if you keep searching Groupon you may
come across someone in that price range but the end product and results would
not be at professional level. Again, I apologize for any inconvenience our
miscommunication might have caused. If there is anyway I can help. Please let
