It is reasonable to request that the permission for a third party to file a complaint on behalf of the contract holder be in writing? The reason for the concern is that communication with the contract holder has been frequent, open and productiveCommunication with the third party has been combative and non-productiveWe tried to communicate professionally with the third party and even warned that I the communication didn't improve we were going to cease communication with the third partyWe were hesitant to do this but when the harassing phone calls and texts continued to occur in evenings and on weekends and included screaming and profanity, the third party forced us to cease communication with herWe continue to communicate regularly, but only with the contract holder.? As stated previously, our contract has a completion date between January and January The written schedule provided in December included the items that would be complete by January Those items were completed on timeThere are items contingent on the client's portions of the project that were not promised to be completed by January The client is responsible for items such as painting and flooringAs the client mentioned, there are a few final items that can't be done until the client completes their portions of the projectWe will be available when the client completes their portions of the project and we will promptly finish our remaining items.Even though our contract does not include leveling the floors, we did spend numerous hours and use a great deal of material to do what we could to level the floorsWe were limited in several locations due to the large beams under the floor.? This was all done at no additional cost.The contract does include rebuilding a foundation in the southwest cornerThe contract does not include raising the foundation because it is not practical to raise a foundationThe foundation was rebuilt, and numerous attempts were made to raise the houseDue to the condition of the existing walls, raising the house was not successfulThe contract holder was made aware of this and agreed to allow us to raise the floor onlyWe agreed it was practical to raise the floor about half of the amount it has settled over the yearsWe were able to raise the floor to within 1" of levelThis is well within the discussion agreed to by the contract holder.There is no truth to the assumption that many of our projects end up this wayOur company reputation and the reputations of all our project managers are outstandingWe've been in business for years and we've learned that difficulties and challenges arise during many projectsWe always conscientiously and to the best of our ability work with our clients in a positive and professional manner to resolve these issues, and we would have in this case also without the involvement of the Revdex.com.? For your reference, details of the offer I reviewed appear below.I was given permission by the contract holder to file the complaint against the business and the company was told from the beginning that I was to be included in all design, decisions, etcAs far as I’m concerned anyone can file a complaint against a business with their experience about them contract holder or not, so this is not relevant information from the businessWe were told from the very beginning that the first completion date of January 1, was going to be a valid completion date and was not hastened by our end, only the businessThey will not be completing the project by this Friday, January eitherOur ends of contract have been held up with company and we were told to have the flooring installer out this week by project manager, Chuck W***We find the company very deciteful for not providing sufficient updates on the completion datesThe missing metal was not returnedThe company gave us a non-functional air conditioner that couldn’t be sold for the same price that we had already anticipated selling the other for above scrap pricesWe have not received any furnace parts back from themFrom the beginning, we were told and was written in the contract that we would receive timely schedules in which our renovation would play outWe were not given our first schedule until November 8thWe were also told that they would be using quality material in which they didn’tHad we not requested that they stop using the terribly constructed materials, they wouldn’t have fixed itMost matters have been addressed by the company only after the complaint was filed and they were trying to make up for what they have already messed upIf the complaint wouldn’t have been filed, nothing would have been fixed by the company making our reasoning for contacting the Revdex.com and our complaint validThe leveling of the flooring was never addressed by the company, in which the company hired to put down our hardwood floors ended up needing to be fixedWe would like for the construction company to pay for this additional cost since they were the ones to pull up the existing floors and not put them back the way the were to begin with and were to level the flooring as stated by the project manager, Chuck W***The project manager was also not the one that discovered the vanities not being able to fit in outlines spotsThe homeowner discovered this mistake as well as the electrical wiring to the vanity not being correct eitherWhy does the homeowner need to discover this and not the project manager when the vanities has been on site from the start of the project? The contract holder did give permission to contractor not raise foundation per contract agreement but the work completed was not same so a refund should be given since the amount of work was not equal, with the floors left being 0.5-1inch slope instead of being leveled as stated above.We believe our complaint is fair and validThe homeowner and contract holder did all demo work to open up home and show contractors what home entailed, so there were absolutely no surprisesThis is an 1870s home and always has been, even when the contractor looked at the home to begin with and has not changedThe home was never neglected by homeowner or contract holderIt is also very unprofessional that the project manager blocked homeowners phone calls and text messages after the complaint was filedIt is to my knowledge that many of the projects that have been overseen by our specific project manager have ended up this way and the president of the business does not address the problem when we specifically asked for a different one at least two timesMany of these problems wouldn’t have occurred nor would the Revdex.com have been contacted had our request for a new project manager been fulfilledWe do not trust this company nor will we backdown from them about this matter.? We have recently received notice of a consumer complaint about our business, case ID ***, and we wish to respondIn support of our response, we have enclosed copies of the Proposal, Contract Items, Scope of Work, and a drawing, which we provided to our client and which were signed and/or
initialed by our clientIt is important to note that the consumer making the complaint is the daughter-in-law of our clientnot the client with whom we have a contractHowever, we understand that the home is being renovated for the consumer's benefit and she does have a significant interest in the projectIt is also important to note that this is an ongoing project and isn't scheduled to be completed until Jan26, We are responding to the complaints in the order they were presented in your letter to us: 1. Missing items from our home that were asked before start of project to be keptThe client did ask us to leave on-site metals removed from the home so that he could recycle themThis was not successfully conveyed to our workers and the metals were removed from the siteWhen the client reminded us, we acknowledged our mistake and returned the metals2. Subflooring not leveled after it was said to be leveled; still not repaired after said contractor removed floors & did not fix them; [sic] It is important to understand that this is an 1870s farmhouse that has been neglected and unoccupied for several yearsTherefore, the floors are understandably uneven and out of levelWe were not asked to level the floors nor does our Scope of Work include leveling the floorsHowever, where possible we did attempt to improve the evenness of the floors at no charge to the client3. Closet walls were wrong by 12in[sic] This has been correctedThe closet walls were built according to the contract drawingsHowever, when reminded that we had been asked to build the closet differently during the initial discussions, the wall was moved the ne 4. Bathroom vanities were placed in areas that they would not fit even with knowing said dementions [sic] of vanity prior to start of projectOur project manager noticed the vanities were not going to fit well in their original locations and suggested a solution which was agreed to by the client and completed by us.5. Trim around floors were supposed to be rounded at edges; currently flat & not repaired; [sic] At the time the consumer made the complaint to Revdex.com we had been told of the oversight concerning the rounded edges on the trimWe agreed we had made a mistake and had made arrangements to correct the errorThe complaint to Revdex.com was made before we had corrected the error.6. Electrical wiring to vanities was not completed after being told to wire said vanities before start of projectThe electrical wiring to the vanities has been in place since the original electrical roustageIt will be connected during the electrical finish stageThis has bccn explained to the consumer more than once.7. Walls were not going to be provided on laundry room; has been fixed only by arguingThe laundry room walls were framed according to the contract drawings approved by the clientAdditional walls were added with the client's approval with no additional charge to the client.8. Date of completion passed without communication from contractorOur contract was signed Sept11, It included a tentative schedule which states "...construction to begin to weeks after commitmentConstruction duration will be to weeks." With this schedule, the tentative projected completion is to be between January and January 29, This is an on-going project and, with the exception of items that are contingent on the client's activities, is on schedule to be completed on Jan26, 2018.9. Drywall not finished properly and had to be repaired after arguingThe drywall is being done in two phasesThe consumer is referring to the second phase and it simply was not completed at the time the complaint was madeIt is now completeFoundation not repaired as stated in contractUpon starting the foundation work, severe wood rot was discoveredThe foundation plan had to be altered and it received client approvalThe carpentry portion of the foundation is completeThe masonry portion has been delayed because of the recent severe weather and will be completed as soon as weather allowsThere will be no additional cost to the client.Bradford Builders believes this complaint is unfair and unfounded due to several factorsFirst, this is an 1870s farmhouse that has been neglected and unoccupiedUnexpected problems ariseWhen they do, the client and contractor must work together to come up with acceptable solutions while working within the intent of the agreed-upon Scope of WorkBradford Builders has done this in good faithAny verbal misunderstandings have been resolved quickly and at Bradford Builders' expenseBradford Builders has followed the contract and drawings as agreed upon by the clientThe contract states a projected start time and completion time and we will complete our portion of the project within that time frameFinally, it is worth noting again that we have no contractual agreement with the consumer who filed the complaint.Thank you for the opportunity to tell our side of the storyPlease let me know if I can provide any additional information.
