6-6-16 We financed $7877.42 he was supposed to pay the other $4000 to me he have me $2000 he said I couldn't cash for a week or 2. Then he gave me 2 other checks (post) dated for 7-9-16 for $1000 and another check post dated for 7-23-16 $1000. Then he called me 2 weeks after the purchase date he had signed a as is no warranty on the truck, he had driving it and said there was all kinds of repairs, and never could cash the other $2000 checks. So he told me that he did not want the truck anymore and he wanted the $2000 back that I had cashed being he still owed me $2000 more. I said you could bring it back but I am not refunding the $2000 back being he signed a as is no warranty form and drove it for 2 weeks at least. I don't know what he could have done to the truck, I tried helping him out and that's the thanks I get. Any questions please call Darin, I canceled the financing once I got the truck back also

I am rejecting this response because:
First, the estimate came from a mechanic I had never met before the day the truck wouldn't start and I took it to him to diagnose, it has always been the same amount, and the problems covered by the estimate could not have been caused in two weeks under any driving conditions. Yes, I drove 200-300 miles during those two weeks... I needed the truck for work and I needed it to be RELIABLE because I drive a lot. Every dealer I have spoken to about this situation is dumbfounded at your unethical, unreasonable behavior. I couldn't say anything right away, because I didn't have the problem right away. "... he wasn't willing to work with me either." Your first response said you tried to work with me... this seems to suggest otherwise, as I have stated all along. I was in no way trying to get out of buying the truck - I need it for work, and have since purchased a reliable vehicle from a stand-up dealer (who, by the way fixed a brake problem two weeks after I purchased it, at no cost to me) and am making payments on it. Westlake (finance company) told me directly that you tried to resubmit the loan without the additional $2,000 - I'll contact them to see if they can provide that in writing. Plus, who sells a customer a vehicle with almost as much money in problems as the sale price, and then blames the customer???? That's just bad business. As I've stated before, you have the truck AND my money. You should do the right thing here and give me my money back. Even a rental for 2 weeks wouldn't be $2,000 and you have the item in your possession to sell again. I want my down payment back. That's the only acceptable resolution.

Received follow-up response from business via e-mail, 8-29-16 -- scan is attached; includes copy of estimate from [redacted]'s Auto & Truck, copy of NADA Guides printout. Text of accompanying letter reads as follows: "The policy is when you sign the as is no warranty its as is. I take a bigger chance everyday when I buy vehicles, how do I know that he didn't beat the crap out of the truck. Any dealer would have done the same thing nobody would have gave the down payment back if he owned it for at least 2 weeks and did not say anything right away if it would have happened in the first week that would have been different. I never tried running application financing again hes making that up I have proof from my finance company. I cancelled the financing as soon as I received the truck back, he wasn't willing to work with me either he was not being reasonable. Of course I listed the truck for sale again but had to fix a couple things but was not even close to $8000 bid he proposed. I had my mechanic check it out he is a great mechanic he has been doing mechanic work for 15 years for me especially on diesels. I absolutely did not know of anything wrong with it when I sold it or I wouldn't have sold it to him or anyone else that's the way we operate. Also I drove the truck at least 200-300 miles and he drove it for 2 weeks at least before he said anything. Also I think he was trying to get of buying the truck by writing a high estimate. Also I sold him the truck (thousands) below NADA trade in value also attached. There on Craigslist for the same truck $15995. I will send an estimate attached. Thanks Darrin"

In response to the owner's statement he never offered to look at the car or have anyone else look @ the car. The owner was made aware twice that the car was having problems. After the oil change on 9.25.15 and again on 10.15.15 the car will not start to be moved and he was made aware of that on 10.15.15 when I spoke to him face to face with my daug and grand daughter with me. The day after the oil change my granddaughter drove the car down there to make him aware and he stated the car was find when he sold it to me but the oil change was done days after the car was bought. The owner refused to work with me on anything to do with the car repairs stating he sold me the car as is and its not his problem. He also state there was no lemon law on used car purchases. So I was just out and could call whomever I wanted. Which is why I contacted Revdex.com as well as the Attnory General.

noticed during an oil change at a different business.  Consumer refuses to bring her vehicle to the business according to owner.  cmm
