Dear Hawaii Revdex.com,
I have attached to this email the email trail with the ***'s dated 1/24/- 1/26/where we informed them that having to cut concrete, trench, back fill and patch concrete 35' to tie in new bathroom addition to the cleanout is over and above what is included in our contract
If the cleanout location was known, we would have been able to provide a price, however, *** and *** did not know where the clean out was We did a walk through with *** around the property looking for a clean out prior to the contract being signed, we were unable to locate I had asked *** to ask the dad where the clean out was No information came back on this matter
I also had a plumber come out and he could not locate the cleanout either If I hadn't come upon the drain by accident, we would have had to inform the owners of an additional change order to have a plumber come out and tone-out the ground to locate the pipes and cleanout
Currently, I have presented them with a change order to complete the work and they rejected it
NOTE: Unable to see actual attached files which I attached, will also email directly to ***
Sincerely,
*** *** ***

I am rejecting this response because:Aloha Hawaii Revdex.com,Let us begin by saying that most home owners would not know where the clean out is located on their property.  We did ask our 88 year old dad and he did not know where it was either so that was why no information came back to Dave.  It makes sense that if the homeowner does not know where the clean out is then it is the responsibility of the contractor to find out through whatever means he has at his disposal to locate it.  Instead Dave chose to ignore this issue and went ahead and wrote up the contract for our addition, not mentioning anything about pending the location of the clean out there may be an additional cost at a later time.  If we knew this would be an issue later on down the road, we never would have signed the contract until Dave figured out the location of the clean out.  For him to not let us know that this could be a potential issue before we signed the contract is unethical.  Dave has been in the contracting business for 20+ years, how does this kind of thing happen?   It is extremely unprofessional.Yes, Dave did present us with a change order to complete the work but we feel that we should not have to burden the full cost, since we believe this to be an oversight on his part as well as on his architect who drew up the building plan.  As a gesture of good faith and to keep this project moving, we even offered to share in the cost of this issue with Dave and gave him a few days to reply to our offer by email.  We never received a reply from Dave.  We also asked him verbally as well and resent the email and again no response from Dave. It is apparent to us that Dave does not want to take responsibility for his mistake and to share the cost to resolve this issue. Our offer was not a standing offer therefore it is no longer valid. The email trails dated 1/24/16 - 1/26/16 that Dave sent to the Revdex.com is incomplete.  He omitted the latest two emails dated 1/27/16 & 1/31/16, therefore we're re-sending the complete email trails.
Sincerely,
[redacted] & [redacted]  [redacted]
