In order for me continue to progress with my renovations, I had to hire another contractor as DK Home Improvement informed me that it would take approximately three to six more months to secure the workers' compensation certificates of insurance, which is not the responsibility of me, the homeownerThis additional failure to secure the certificates of insurance compounded the additional fines and associated costs against my property levied against me by the Department of Buildings and the *** *** ***It is my position that the fines and additional living expenses incurred by me as previously stated are due to me from the contractor to remedy the situation

I am responding to the rejecttion notice I have recievedThe payment term is what DK Home Improvements can do to resolve. DK Home Improvements will make one addtional payment of to handle the additional that is dueI was asked to leave the job as of Jan***anything beyond that point is not a matter for DK Home ImprovementsThe fact that I decided to have surgory when I did is not a matter that is relavent and also the fact that I took a vacation is also not relaventAgain I will stat that while I do feel some sense of obligation for some of the issue's that transpired DK Home Improvements is not completly at faultDK Home Improvements did not hire the architectDK Home Improvements was never informed that any other paper work was required therefore did not know of anything else that needed to be filedALl this information was proovided to DK after the fact
DK Home Improvments will be willing to pay per month for months for a total of DK Home Improvments would also ask for a leeter stating they are no longer responsible for any fee's from NY DOB or any other charges from any other entityDK HOme Improvements wanted to go to complete job but again was asked to never call again or step foot on propertyDK Home Improvements had equipment left on the job that were never permitted to pick up
I hope this will resolve all issue's and DK can begin to send payments to home owner to help recover some of the expenses

In response to your request to have the payment of $500.00 amortized over a 10-month period, due to the length of time already involved, I believe it is more than fair on my part to request $1,000.00 per month over a five month period in order to bring the matter to partial resolution. His payments for services were given in a timely manner for a total of approximately $80,000. Contractor never had to wait for payment from me. During his lack of progress on my home, contractor decided to have surgery and also decided to take a vacation cruise.
The certificate of correction that was supposed to be completed as promised by contractor was never done; and thus, leaves my case open with the Department of Buildings subjecting me to further fines from the Department of Buildings and the [redacted]. Through legal representation, I have discovered that there is still a $400.00 fine levied by the DOB due to a failure by contractor to complete the certificate of correction. Therefore, I am requesting payment of this additional $400.00 and any residual fines that I have to pay that may still be pending or levied as a result of contractor's negligence.

 The Contractor proposed a settlement approximately three months ago which I accepted, and as of this date, I have not received any payment as per Contractor's Agreement through the Revdex.com. Therefore, the Department of Consumer Affairs and the Attorney General's Office will be contacted to lodge a formal complaint as well as the filing of a civil action claim through legal counsel.

I am writing in repsonse to complaint filed by home owner [redacted]. Work started on 4/**/13 to her home after terrible damage from Hurrican Sandy. On the second day of work a stop order was issued and were told permit needed to be secured before work could begin again. We were under the...

impression that permits were not needed due to the inmpact on homes from storm so home owners could get back in there homes as fast as possible. When in fact the Building Department was forgiving the fees but the permits were still required. I informed the home owner that I did not know any architects but would try and get a recommendation. I found one that woulud secure permits and told homeowner what his fee would be. She said she would use him. I understand the home owner was under duress and options were limited. Homeowner decided to go forward with him and paid him directly. After several weeks of waiting we finally got started again and then again a fter sometime an inspector stopped in and again issued a work order for interior work based on the fact there were some itmews being done that were not on the permit. These are things that were found as job went on and were not know when job started. So again we contacted the architect and told him what happened and he needed to submit new plan with additional work. It was not know that once you answer stop order and pay fine there is still paperwork and other items that need to be completed. We were not made aware of this by the architect and failed to do items and forms. I was not informed of this as homeowner was not informed. This was one big mess up after another. WIll I feel very bad for all this I did not have the architect working for me but was the go between for the homeowner. I understand home owners position but I did not hire architect I only tried to help. While all this was going on Workmans Comp cancelled my policy and would not re instate until audit was co mplete and there was nothing I could do to spead up this process. Everyday I called my insurance broker to find out if he heard something and everyday I felt terrible that I could not do anything and I did not know waht to say to homeowner other then the truth. I in no was intentially trying to criminally scam homeowner and would never do such a thing to anyone especially a senior citizen. I wanted to complete work but could not do anything to spead up The [redacted] with my audit and a new policy could not be wriiten without it. Home Owner told me if I did not get back to work by a certain date I was fired and asked never to call or talk to her again. I feel very bad over all this and wish none of this ever happened. This was one mishap after another and homeowner had to sufer because of it. This was beyond my control. And I wanted to complete work and would have had I been allowed to do so. As homeowner was not informed by architect of all the Build Department r equirements I did not even know most of them were accuring

Review: Contractor failed to secure the necessary building permits for repair work resulting in numerous delays and Department of Buildings fines against my property at [redacted]. The renovations started on 4/**/2013 with an estimated completion date of 5/**/2013. On 4/**/2013, the Department Buildings issued a stop work order due to contractor's failure to secure a permit resulting in a fine of $1,602.00, which the contractor failed to pay. My property received another violation dated August **, 2013 in the amount of $726.00, which the contractor failed to pay. My property received another violation dated October *, 2013 in the amount of $400.00, which the contractor paid. My property received another violation on 1/**/2014 in the amount of $1,500.00, which the contractor failed to pay. My property received another violation subsequent to October *, 2013 in the amount of $684.80, which the contractor failed to pay. Additional residual fines issued by the [redacted] totaling approximately $240.00. There was an additional delay due to contractor's failure to secure the legally required Workers' Compensation Insurance. This occurred in the fall of 2013. Contractor informed me that Workers' Compensation Insurance certificates may not be secured to at least March 2014. As a result of contractor's failure to remedy the financial costs of the violations, it resulted in inordinate delays and the incurrence of additional housing fees to my income totaling approximately $12,000. The resultant effect on me as a senior citizen of 78 years of age has been emotionally stressful and criminally tortious to a direct victim of Hurricane Sandy. I believe I was criminally scammed and kept out of my home as a result of the contractor's negligence. In January 2014, contractor's services were terminated. A new contractor was secured through the [redacted] (a charitable volunteer organization which came to my rescue). An additional $4,500 was required to complete the work.Desired Settlement: Complete and full restitution of all costs mentioned above, inclusive of the work costs that [redacted] required me to pay to complete DK Home Improvement's owner [redacted]'s incomplete work. As of this date, construction is not complete, and I am still not able to live in my home.
