D.L. Malarkey Construction

DL [redacted] was hirec in March of 2012 to work on a property purchased by my husband and I. There were several contracts that [redacted] provided, using an invalid address. These contracts were never completed and were altered with materials other than those mentioned and the contracts were not adjusted accordingly. Permits were never filed with the city for work being done on the house by [redacted]. A contract for siding, roofing, and windows was never finished and what was done, was done poorly. The siding is falling off the house, the windows were never insulated or sealed, when the roofing was started, [redacted]'s crew kicked out boards in the roof to provide footing for the employees and those boards were never replaced. New gutters were also in a contract and they were never finished and what was hung leaks and the water runs in the wrong direction and pools in the gutters. Thus still leaving an issue with water getting in the cellar. A support wall was removed without a contract and heating ducts were removed that delivered heat to the second floor. This project was never finished and there was also no permit filed for. [redacted] hired another contractor to replace an electrical panel in the cellar. He had the wrong ampage put in and we had to hire a contractor to replace the whole unit. We were not reimbursed for his mistake which cost us more money. Whenever my husband (who suffers from minor brain damage) talked with [redacted] would call me at work and complain that my husband would yell at him. We tried several times to get [redacted] to fix things and to make things right with us. Sixteen months later he still said he would make things right and has not. We had to fired him and asked him for months to remove his items from the property. He finally did remove things but several projects are unfixed and he has left us in a terrible state. I contacted the local Attorney General's office who told me they don't handle issues with contractors, but to let [redacted] know "who's boss." Well that did nothing. [redacted] is a gypsy. He showed up when he needed money and requested more and then would disappear again and again. He totally took advantage of my husband and I. From talking to other contractors in the area to come and fix this mess I understand he has done this to several people. I called a law firm and they told us it would initially cost us $4,000. to start to try to sue him and there would be no guarantee that this would be resolved. I feel like we are victims and I believe that [redacted] should be investigated and appropriately charged with failure to apply for permits. I also believe that we should be reimbursed for any repairs that need to be made to his work and for all work he didn't finish and was paid for.
