[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: Dear [redacted] ; I am writing this letter to inform you that I reject the letter dated May 19, from D&M Auto Sales located at [redacted] ***, York, PA *** Below is a list of items, concerns and facts pursuant to the purchase of my [redacted] Truck*I may have owned the truck for five months or so, however, I have only managed to get it thru Maryland State Inspection on January 5, Therefor the truck was sitting still in my driveway and not being used at all for farm or recreational use The only times it was driven was to take back to D&M Auto Sales to address various inspection issues *The truck was Tagged in the State of Maryland on January 31, 2015-then and only then did I start to drive it The fact is that from January 31, thru April 8, was the only time the truck was legal for use by myself That is a total of days usageONLY days*Since April 8, the truck has sat in my driveway and I must continue to make the payments on a 17k loan as well as pay full coverage insurance and registration, etc...I was informed not to drive it anywhere because the pressure build up was too great and the motor could blow up at anytime Not fair to the consumer who trusted this Licensed PA dealership to sell them an operable and usable truck*This truck must be towed to PA for repair or towed to a local MD repair shop It can no longer be driven I was instructed to "park it" and so I did*I cannot perform the duties to run my farm without a truck I need to supply feed, hay, stone, etc...to my animals and for maintenance of my farm*Being offered for sale to the public in "As In" condition neither refutes, nor rebuts the assumption that under the Implied Warranty doctrine that the products sold and purchased will function in a safe and legal manor Especially since the product is obviously and normally intended to function in the public domain and on the public roads*This Dealer, D&M Auto Sales, has a license issued to them to sell cars and trucks in the State of Pennsylvania and there are specific guidelines to be followed under Pennsylvania Law*Definition of Implied Warranty: A promise, arising by operation of law, that something that is sold will be merchantable and fit for the purpose for which it was sold An implied warranty of merchantability is an unwritten and unspoken guarantee to the buyer that goods purchased conform to ordinary standards of care and that they are of the same average grade, quality, and value as similar goods sold under similar circumstances There is a Uniform Commercial Code*I ultimately want my truck repaired or replaced by D&M Auto Sales*I am interested and would like to obtain Mediation and or Arbitration concerning this matter I will be contacting my case worker directly to inform him/her of my intent in closing, I thank you for your time and patience with this matter Regards, [redacted]

May 19, To Whom It May Concern:*** ***'s complaint letter was pertaining to her need to have the head gasket replacedIn the second sentence of her second letter she acknowledges that she purchased this used truck AS IS on November 20, As we previously mentioned, warranties can be purchased as an option to buyers*** *** chose to purchase it AS IS with 177,miles on itWe can go back and forth disagreeing about timelines and such, however the bottom line is, any issues relating to inspection were addressed, to the satisfaction of both PA and MD Department of Motor Vehicles requirements(This includes the cab work she was reffering to) Not real sure why she is even bringing it up again at this point, as it is not related to her actual issue and has long since been resolvedHe complaint is about an unfortunate repair that has come about approximately months after her purchaseWe did not warranty this truckEven her idea of "Implied Warranty" is not feasible hereShe has owned it five monthsWe are sorry she is having an issue with it but it is her truck and her responsibility to repair it, not D & M Auto SalesPlease contact us with any questions or concernsThank you for your assistanceSincerely,D & M Auto Sales

September 16, To Whom It May Concern:*** *** purchased a used vehicle from usHe was not satisfied with it and we agreed, at his request, for him to return it*** *** returned
this vehicle on August 28, At that time, D & M Auto Sales and *** *** came to a settlement that both parties were in agreement withEnclosed you will find two separate, signed statements from *** *** showing his satisfaction.On September 11, 2014, two weeks later, *** *** filed an online complaint against us with your bureauIn good faith, we are enclosing $for *** *** inspite of that fact that he, by his own signature, left our premises on August 28th, a satisfied customer*** *** was difficult from the very first moment he came in to look at vehiclesWe have accommodated him throughout this entire situation, from start to finishWe BELIEVED him when he said he was satisfied on August 28th, As of today's date, we are giving him $and moving forward*** *** needs to look elsewhere for his used vehicle needs in the futureThank you Revdex.com for your assistance in this matter.Sincerely,D & M Auto Sales

I am rejecting this response because: The items referenced to in the letter by D & M Auto Sales is incorrect and they omit obvious laws and facts Firstly, I did purchase in "AS IN" Conditions, that is how most of their vehicles are sold There is a big sign in the car shop office However, there is a thing called "Implied Warranty" and "PA State guidelines for State inspection" that must be met to acquire an inspection sticker It is of my opinion that this PA State Inspection sticker that was on the ***, at the time of purchase, was bought by the dealership and not inspected at all It happens I put my trust in this Car Company I will give examples and time frames below In their letter they state that I came back a few days later with the speedometer issue, which they refer to as a dash cluster, but it was actually minutes after I handed them the check to purchase The speedometer worked for the one and only test drive, but did not work on the night I gave them a $plus thousand dollar check I immediately took the truck back to the dealership, that night I was instructed to wait for them to call me back, as this dealership consists of three or four partners and ALL had to agree to fix the problem Well it would not pass any State inspection with just this problem alone So it was not two and one half weeks until I informed them it was minutes It was two and one half weeks until we could connect with one another via phone calls I believe in "As In' purchases but the truck did not pass a true PA inspection, let alone a Maryland one With my job and their schedule it did take awhile to complete as the part had to be mailed and repaired in a different State I was patient and understanding and thankful When I took the truck to ***'s Garage, here in Maryland, for a State inspection I gasped at the outcome There were nine items wrong with the truck, all of which should have been taken care of if the truck had an actual valid Pennsylvania Inspection I was floored I was upset and scared that I got taken across I went online and pulled up the PA DOT Inspection guidelines and each and every item was a violation I found the Inspectors name for that area and phone number I did not report D & M Auto Sales in good faith, hoping they would fix everything The biggest and the most dangerous issue was that there were not any body mounts or bolts holding the truck on the frame The dealership put me and my family in a very real danger We could have been killed! In the letter they refer to the issues as "some bolts and bulbs", quite an understatement
Lastly, I bought the truck for farm use and so far have not pulled my horse trailer at all They sold it to me without a towing package and after the initial cost of the truck I could not afford to get one put on till January 23, by Adams Jeep of Maryland I have the inv needed I could not pull my trailer as my trailer is not operable and has not been moved for over two years That was a complete assumption on their part that I have been hauling with the truck I really haven't driven it much because I have "Farm Tags" here in Maryland and they have strict mileage restrictions I have picked up round bales or so with the truck I can only haul two at a time, each weighing about hundred pounds, a drop in the bucket for a *** *** diesel
The current major problem with this truck was there when I purchased it and it is not fair that I cannot use a truck that I owe thousand on and looking at a $repair bill There is an "implied warranty" law in every State and I feel as though these set of circumstances fall under the guidelines Thank you in advance for your consideration and research work with this matter

May 1, 2015To Whom It May Concern,In November *** *** *** came into our lot from Maryland, looking to purchase a diesel truck to pull her horse trailer withShe chose to purchase this *** truckShe purchased it in AS IS condition on November 20, She was
offered the option to purchase a warranty at that time but chose to decline it.A few days after her purchase, she called to tell us the dash cluster was not workingThe dash cluster was working at the time she test drove and purchased this truckIn spite of her AS IS purchase, in good faith towards a customer, we had her bring it back and had the dash cluster repaired, at no cost to herApproximately one and a half to two weeks after she purchased the truck, she called again with a complaint about it not passing MD inspection because of some bolts and bulbsThis truck had already been PA inspected and had passed the PA inspection processWe again, in-spite of her AS IS purchase, had her return her vehicle to us and we had the bolts and bulbs replaced, at no cost to herNow, here we are at the end of April and she reaches out to you, the Revdex.com, to complain that the head gasket needs replacedSherry has had this vehicle for well over months nowThis is a used truck she purchased to pull a trailer with and unfortunately she chose to decline a warrantyWe did not warranty this vehicleAt this point, we have gone more than beyond our duty with SherryIf you have any more questions or concerns regarding this matter, please feel free to contact usSincerely,D & M Auto Sales
