A note to Revdex.com that is not part of my public responseI’ve attached an email from one of the board members of Summer Winds to show the Board’s position that this complaint is not a safety concern/hazardThe Board and DNI agree that this homeowner has a valid parking complaint, and actions and steps
are being taken to resolve this matterThis process involves notification letters to the resident, monetary fines, posting no parking signs, consulting the association’s attorney and most recently Board approval to contract with a towing companyPlease note that the included email is not part of DNI’s public response DNI Properties and the Board of Directors for this Association (who DNI reports to and takes direction from) are very concerned about the safety and security of the communityDNI and the Board do not believe that the parking issue is a safety concern and that there is any material blockage that would adversely affect emergency vehicles from accessing the buildingThe area in question is a driveway in front of a 4-car garage and does NOT involve restricting access to fire hydrants or blocking street access to areas of the community or access to buildingsWith that said, the Community Manager is using the policies and procedures established in the Association’s Rules & Regulations for “unauthorized parking” to resolve this valid parking complaintA total of five violation notices have been mailed to two different residents and two monetary fines have been issued as wellAdditionally, no parking signs have been posted in front of these garage spaces, the Board met with the Association’s attorney to discuss the legal requirements involved in towing vehicles and in late March the Board approved contracting with a towing companyDNI is currently soliciting a towing contract for the Board to review and, if acceptable, approveOnce the towing contract has been executed and any additional required signage has been installed, DNI (with Board approval) will administer the towing of vehicles parked in unauthorized areas of the communityThe Board and DNI hope that by taking a measured approach to handling this issue that it will be resolved soon and without risk of liability to the Association

I spoke with *** was told and the old manager *** is no longer with the companyI explained that this has been going on for a couple of months and there has been no resolution*** stated that she had not gotten any of the
messages regarding my complaint but would reach out to the manager and see if I he could have the salt delivered either today or tomorrowShe will call me back

DNI is the managing agent for this homeowner’s associationThe Board of Directors, made up of homeowners of this community, selects the landscape contractor as well as approves the scope and frequency of services providedThe Community Manager responded promptly to this homeowner’s requests and
contacted the landscaping company with the homeowner’s requestI’ve attached a detailed list of the communication that occurred over this period of timeIn reviewing this communication list, I think it is important to highlight that the landscaper is using their professional knowledge of the appropriate time to trim various types of bushes to maintain their health and long-term welfareAdditionally, bush trimming is sto be completed in this community on time periods that the landscaper determines to be proper for the care of the bushesThe fall trimming of bushes by the landscaper occurred ten days ago and the Community Manager has confirmed that this homeowner’s bushes were trimmed and that she is satisfiedFinally, the landscape vendor is not a company affiliated with DNI Properties and is under contract directly with the associationDNI does manage the contracted services (per the agreement signed by the homeowner Board) and all of the homeowner’s requests in this case were followed up on by the Community ManagerIf the homeowner would like her bushes trimmed at time periods that the landscaper does not recommend, then DNI will need to have that approved by the homeowner board membersIn this case the Board may require the homeowner to take financial responsibility for the replacement of her bushes if they die

First, I'd like to say that there are several layers of documents required to complete a closing on a villa such as this homeowner's and it can be complicatedThere are documents that are required by the buyer's lender, documents that DNI is
required to provide by state law and documents that are requested prior to closing by the title companyAdditionally, the association where this homeowner lived required a First Right of Refusal for all sale contractsIn these situations a document waiving the association's right is typically signed by the Board and provided to the title companyWe did not receive a signed waiver from the Board so DNI has refunded the homeowner for that feeFinally, in this case the homeowner had pre-paid for two additional months of assessments past the closing dateDNI refunds these fees to the seller, however, we need to wait for the title company to mail us the documents showing the property was sold before we can issue this refund checkOn behalf of the association, DNI has issued a refund check for these pre-paid assessments to the seller
I understand the homeowner's frustration with the process and the multitude of required documentsIt is not DNI's intention to add to the stress that is involved in the sale of a home and we will be reviewing our internal procedures so we can better educate our homeowners on the process

DNI does not receive or process homeowners' assessment payments for this community or any communities that we manageThe Association where this homeowner lives has their own bank account and all assessment payments are mailed directly to the
lockbox at their bankTheir bank reports to DNI when these payments are processed and DNI is not involved in any wayI spoke to their Association's bank and they monitor the processing of payments which on average occur in business day for standard processingFor payments with missing information there's an additional to business days to processThe homeowner must mail their monthly assessment payments with sufficient time for the United States Post Office to deliver them and for the Association's bank to process themDNI does offer all homeowners the option of using ACH withdrawals (at no charge) for their monthly assessment payments which guarantees on-time payment
Regarding the homeowner's concern about the amount of the monthly assessment, DNI does not set her Association's monthly assessmentA Board of Directors elected by homeowners in her community approve the annual budget, monthly assessment amount and contracts for recurring services and special projectsThe budget is distributed to all homeowners and there is an annual meeting of owners as wellWhen the homeowner was looking to buy in this community they had the opportunity to review the budget and monthly assessment fees to determine if they wanted to purchase a home within this AssociationIt's also a misrepresentation to suggest this Association has nothing to maintain, the community provides landscaping and irrigation for all of the homes and the common ground; snow removal of streets, driveways and walks; maintains most of the exterior of the building including roofs, gutters and siding/brick; street repairs and driveway sealing; property insurance for all of the buildings (homeowners carry only condominium type policies); professional property management of the community: as well as a reserve fund to save money for future major maintenance projects
The Community Manager for this Association has spoken with the husband of this consumer and explained to him the process and options to make monthly paymentsAn ACH form has been emailed to him as a payment option and the late fee has been waived to allow the homeowners time to sa system for monthly payments that works best for them
