I have been contacted by the Better Contractor's Bureau's Executive Director {*** ***) and wehave worked out a satisfactory solution between MrDobbins and myself

I am in receipt of your letter and complaint from my customer Mrs. [redacted]. I will sta11by stating that l have been in business since 1982. This is the Grst Revdex.com complaint I have had.My business has been built on the foundation of providing quality workmanship and excellentcustomer service....

Today, 90% of my business comes from past customers and referrals. Tama current member in excellent standing of the Better Contractor's Bureau and a past memberof Rochester Home Builders Association,After working on Mrs. [redacted]'s job for a few weeks, I called and asked if 1 could stop by tocollect a contract draw (which was overdue). She pointed out a few trim items that neededattention along with a door she felt was crooked, a window she felt 11! in the opening tootightly and needed the caulking c.leaned up.We had been delayed in completing our contracted work due to Mrs. [redacted] changing frompainted trim to stained trim. She was supplying the stained trim. In addition the granitecounters were delayed 30 day~ due to her problem with the Sl.lpplier. She was supplying thecounters along with most of the other material on the job.My draw at this time was to be $5,000.00, she paid me $2.000.00. I told her. we would returnin two days to address the issues. T texted and e-mailed multiple times to ohtain access tocorrect the issues. My attempts to obtain access were ignored.In response to the issues she mentioned in her letter:l. Door needing adjustment: I was unable to confirm there was a problem, since I wasdenied access. l would have adjusted, if needed, had r been given the opportunity.2. Window; Th.e window was tit with close tolerances and caulked. The caulkingneeded to be cleaned up, the window needed to be trimmed !Uld final caulked when thestained trim was available from Mrs. [redacted]. There was no "rotted wood" throughoutthe existing window jamb. The jamb had a split in it !Uld needed repair before finaltrinl installation.3. Electric: We installed additional plugs and switches that were beyond contractspecifications and I was billing $200 for these. extra plugs and switches. Final electricwas to be done when the tile ba.cksplash was installed. I was not allowed to completethis work.4. Used the wrong tile. The tile was supplied by the owner. She asked us not to use the"orangey" tiles. There were slight variations in the tiles. We d.id the best we could.5. Plumbing- wrong drainage pipe. We installed a temporary sink and counter top forher convenience. l did not charge her for this. The iinal hook-up and finish plumbingwas to be completed after the countertops were installed. We were not given theopportunity to do this work.6. Injury to dog: The single car garage was only used for owner's materials (cabinets,trim and tile) and a few of our incidentals (drop cloths and tile saw). We have a worktrailer and stored the majority of our material outside. She kept the dogs in the garagewhile we were working. Myself and my 2 C!U'penters on the job were instructed byMrs. [redacted] at the beginning ofthe job to let the 2 dogs out htto the 4' high fenced yardoccasionally during the day. On the day the dog was injured, we were going in andout of the garage for the owner's materials. The pup was trying to escape. We putboth dogs in the fenced yard and the young dog tried to jump over the gate section andgot caught on top. My lead carpenter rescued the pup and called the owner. It isunfortunate this happened. I was informed by Mrs. [redacted] that the vet bill was$1 ,400.00.Mrs. [redacted] informed me she had another contractor take care of her issues and completion ofmy contracted work. She said she was sending me a check for what she felt she owed me. Iasked for a detail of the charges she was deducting. She has not given me a detailed accountof what she is deducting from the contract price. I have sent her an Invoice (which I amincluding here) of the Total Contract price, payments she has made, and deductions for thework I was not allowed to complete.I have made several attempts to meet with her to negotiate an. agreeable fmal payment. I havetold her 1 was will.ing to compromise. She informed me she will "not pay me anything else".I have consulted with [redacted] of the Better Contractor's Bureau. They have amediation service available to members. He has contacted Mrs. [redacted] to set up a meeting withtheir mediation team to see if we can review the numbers and settle this amicably. I amincluding his letter to Mrs. [redacted].Attached is a run down of where we stand to date. I deducted the wCJrk we were not allowedto do to complete .my contract. I sent this to Mrs. [redacted] and she refused to pay.I pride myself in customer satisfaction. In this case, I was not allowed to rectify the situation.This is unfortunate.Sincerely,Thomas .T.
