[redacted] is the owner of [redacted] Heating and AirThis has really been between his company and the customer [redacted] has agreed to change their unit from a 1/ton unit to a ton unitSizing of an A/C unit is not a guessing gameThe new Energy Code enacted years ago requires HVAC contractors to enter the square footage, the direction the home faces, and the window sizes, in the computer system and it sizes the unit for the homeThe Energy Code properly sizes the unit for the best energy consumptionAccording to [redacted] ***, the 1/unit is the proper sized unitAdditionally he has hooked a monitor to the system to ensure the system is operating properly and it isHe says the recommended temperature setting is degrees and they are keeping their home in the / degree range and their expectation is that the home will stay at degrees all the time, the unit won't run all the time to keep it there, and there utility bill shouldn't be higherWith days in the 90's and trying to keep your home at degrees (to degrees colder inside than outside), the system is going to run all of the time and the utility bill is going to be highEvery degree a thermostat is moved below degrees makes a significant difference to how hard the unit has to work and also to the utility billHe has agreed to change the unit out because the customer is convinced that there is a problem, but the higher tonnage unit takes more energy to run and that is why the Energy Code does not want you to oversize a unitIt will get the home cool quicker on the real hot days but on a day to day operation it will cost more to run due to the larger compressor [redacted] has been in touch with the customer and will change the unit out when they return from vacation Thanks [redacted] ***

We were not able to grade and sod the yard due to the amount of rain and the yard not being dry enough to move the equipment on the soilThe home was on the contractors list to repair as the conditions were favorable for the work to be performedThe yard is now completed

We did accidently remove this home from our outstanding warranty list and we had no record of these repairs needing to be doneI was not aware that he had any problmes until I received this letterWe have taken care of every item with the exception to the pocket door and it is scheduled to be fixed on SaturdayI would ask the customer to just contact me if there are any further problemsWe certainly will address any warranty items that he might have Thanks [redacted] Dogwood Homes

I believe the homeowner filed this complaint prior to talking to meOnce I received the call from her, we took care of her concernsThe water issue was from a defective faucet from *** Faucet*** ***, the distributor, handled the replacement of the carpet with *** FaucetWe contacted
the manufacturer and addressed their concerns and between Dogwood Homes and them, the issue has been handledThanks*** ***

Mr*** emailed me two weeks ago about the spot in his front yard that needs sod that is approxft by ftWe told him as soon as we were able to get sod that we would put sod on that spotWhen it was graded the contractor put straw on the spot*** requires bare spots to be strawed unless
sod is going to be applied within daysThe sod companies have just started cutting sod and we have not been able to get any sod at this pointWe are on the list and they are saying we are still about two weeks outWe have yards that were completed over the winter that need sodSince this was such a small area we went ahead and pulled sod off of a spec home that was laid last October but had not rooted in yetThis letter is the first we had heard about bushes or mulchWe took care of that as wellMulch is not really a warranty itemMost homeowners freshen their mulch every fall and Spring

When their home was purchased the home was not in the flood plainWe can supply them the letters from FEMA that shows that their home was not in the flood plainAdditionally if they look at their closing statement they will see where their mortgage company and title company performed a flood
certification to verify that the home was not in the flood plainDogwood Homes did not lie to them or misinterpret anythingFEMA is updating community flood maps all over the country and in April of they changed the flood maps for ShepherdsvilleWhen they updated the map it changed the flood elevation by inchesWhen they changed the maps it then required any property that had a previous flood letter to update the flood letter based on the new flood elevationThis affected the majority of the homes in Shepherdsville, being approx2,homesThese 2,homeowners either have to have a surveyor perform a flood certification to show they are not in the flood plain or they have to pay flood insuranceThe majority of the homes are not actually in the flood plain, so most homeowners are having a surveyor perform a flood certificationIn Mallard Lake our goal is to make sure that all of our homes are not in the flood plainWe have hired a surveyor to shoot elevations and update the mapping for the entire communityThis is not individual flood certifications for each property but will be a change to the FEMA maps to that areaThe surveyor submitted data to FEMA that showed that every home in the community is not in the flood plainFEMA has now came back and is questioning the decks on the homesThe surveyor now has to go back and shoot elevations on over decksOnce this work is done he will resubmit the data to FEMA and we then will get the updated letters that will show the homes are not in the flood plainWe are doing something that no other builder or developer is doing by having this worked performedThis process does take time because the entire community is being doneIf a homeowner needs this updated quicker than this will happen they can contact the surveyor and have an individual flood cert performedThe surveyor that is doing the work for us can do this at a very good price for them because we have already paid him to shoot the elevationsHis name is *** *** and his number is ***I have also been told that a homeowner can pay the flood insurance and when they get the updated FEMA letter they will cancel the policy and refund the amount they paidThey should verify that with the insurance companyThis is obviously a hassle for all of us and we are taking a very proactive approachWe are pushing to get the letters updated as quickly as we canAll other homeowners in Shepherdsville are handling this percent on their ownWe are the only builder attempting to help.Thanks...*** ***

For your reference, details of the offer I reviewed appear below.We still do not have seed or straw on the back yard so we are still unable to have a fence installed. The contractor did lay sod on the front yard (in the dark at 7:pm on the night our temporary occupancy certificate was to expire)

Sizing of an A/C unit is not a guessing game. The new Energy Code enacted 5 years ago requires HVAC contractors to...

enter the square footage, the direction the home faces, and the window sizes, in the computer system and it sizes the unit for the home. The Energy Code properly sizes the unit for the best energy consumption. According to [redacted], the 2 1/2 unit is the proper sized unit. Additionally he has hooked a monitor to the system to ensure the system is operating properly and it is. He says the recommended temperature setting is 74 degrees and they are keeping their home in the 69 / 70 degree range and their expectation is that the home will stay at 69 degrees all the time, the unit won't run all the time to keep it there, and there utility bill shouldn't be higher. With 50 days in the 90's and trying to keep your home at 69 degrees (20 to 30 degrees colder inside than outside), the system is going to run all of the time and the utility bill is going to be high. Every degree a thermostat is moved below 74 degrees makes a significant difference to how hard the unit has to work and also to the utility bill. He has agreed to change the unit out because the customer is convinced that there is a problem, but the higher tonnage unit takes more energy to run and that is why the Energy Code does not want you to oversize a unit. The yard is now 100% complete. Most homes completed this time of year will have a Temporary Certificate of Occupancy and will require extensions until March or April, before the yards are complete. The weather has allowed us to get their yard complete
