This case closed in April 2014 and broken down for storage. We had to retrieve the file and review. Mr. Dollinger was dealing with heart issues which involved testing during this time period and resulted in bypass surgery on December 17th. He is in recovery but authorized this response. Our investigation shows the following: DollingerLaw represented [redacted] for an auto accident of 12/5/10. The case was referred to DollingerLaw by Attorney Cassaundra [redacted]. Cassaundra [redacted] had issued an LOP to Wellness Associates of Houston so that Ms. [redacted] could treat. We told Cassaundra we would honor the LOP, though the LOP is not ours. Below is a timeline of the case and our efforts to contact Wellness Associates of Houston to satisfy the LOP. 7/2/13 DollingerLaw faxed Wellness Associates of Houston a request for reduction on LOP issued by referring attorney, Cassandra [redacted]. The request was faxed to: VIA FAX: 281-940-0777 The Wellness Associates of Houston ATTN: Michelle [redacted] 440 Benmar Drive, Ste. 1205 Houston, Texas 77060 7/3/13 Scot Dollinger spoke with Kyle [redacted] at 832-767-9419 Wellness Associates of Houston about a reduction of up to 45% but would need some hard numbers. 11/12/13 Defendant on this case notified DollingerLaw that they have been unsuccessful in obtaining medical and billing records from Wellness Associates of Houston. Defendant's record retrieval company, [redacted], attempted to obtain records by sending request to P.O. Box 1347, Spring, Texas 77383 and by physically going to the address of 440 Benmar Dr., Suite 1205 but the name of the business at that suite was "[redacted]". 11/13/13 DollingerLaw tried contacting Wellness Associates of Houston regarding the LOP but could not get in touch with anyone. DollingerLaw contacted referring attorney who issued LOP to see if she had any information on Wellness Associates of Houston. Referring attorney, Cassandra [redacted], said Wellness Associates of Houston was closed and she would try to get in touch with owner. We let defendant know that we had no other contact information for Wellness Associates of Houston. 11/21/13 Defendant on this case notified DollingerLaw a second time that they have been unsuccessful in obtaining medical and billing records from Wellness Associates of Houston. Defendant's record retrieval company, [redacted], attempted to obtain records by sending request to P.O. Box 1347, Spring, Texas 77383 and by physically going to the address of 440 Benmar Dr., Suite 1205 but the name of the business at that suite was "[redacted]". 3/6/14 Scot [redacted] emailed referring attorney to tell her that Wellness Associates of Houston went out of business and that we have tried to contact them but have gotten no response. With that being said, Scot [redacted] stated in the email that, based on Wellness Associates being out of business, he was not going to honor any account of Wellness Associates of Houston. 4/9/14 Case settled and closed. Never heard from Wellness Associates of Houston or referring attorney. 5/7/15 Mickey [redacted] with Wellness Associates of Houston faxed back the LOP reduction request with signature authorizing reduction to $1,048.75. The address that was typed on the request had been whited out and hand written in place of was new address of 1790 Hughes Landing, Suite 400, The Woodlands, Texas 77380. Under the signature was handwritten phone number of 832-767-9419, the phone number we had been trying to contact the entire time. In our search for The Wellness Associates of Houston - neither Cassandra [redacted] or our office received any response. We searched for them very diligently and thought they had closed. As of May 7, 2015 it has been almost 2 years since we requested a reduction. 5/12/15 DollingerLaw faxed the signed reduction request back with a note on it that said, "File Closed 4/9/14 sjd" Funds have been released to client without recourse due to Wellness Center breaching its duty to keep us informed of its whereabouts.
