payment needs. When a customer is unable to make a timely payment, it is our policy to extenä the payment date, to a mutually agreed upon date. In many cases, customers have received multiple extensions without payment. Based on our database our past due letter sent via mail went unanswered along with numerous calls to you. We are not able to resolve these matters without your cooperation and at that point we can only assume that you are unwilling to make your obligation. Review: On 01/31/14 I took out a title loan with Cashpoint for $1,000 on my 1997 [redacted]. I made Feb(02/05/14), March(03/05/14), April(04/09/14) and May's(05/21/14)payment to Cashpoint via my debit card over the phone with Adriana. I received payment confirmation numbers for allpayments except for April. On June 24/25,2014 Cashpoint repoessed my 1997 [redacted] for "Default of Payment for the month of February". I have not missed any payments nor did I receive any notice to Cure Default from Cashpoint. I was told by Andrea from Cashpoints Repo department on June 25,2014 that 2 certified default letters were sent to me one in May and one in June but I did not receive any notice of these letters from my postal carrier. I have contacted my local post office who does not know where exactly the notices could have been left in my apt building. I tried to speak with Andrea at Cashpoints Repo Dept(###-###-####) on June 25,2014 to determine why my truck was repoed only to be told that I allegedly missed Februarys payment and that that's why my truck was repoed. I explained that I have no notice of this an had made the payment and provided Andrea with the confirmation #(241471) that Adriana had provided me with on 02/05/14 when I called in to make the payment for $233.82 Andrea informed me that there was no trace of my payment and that the only way I could get my truck back was to pay Cashpoint $1325.84 and to pay the repo company $375. I explained that they had no right to repo my truck as I have made all of my required payments and she became hostile with me and told me that my only option was to pay or my truck will be sold at auction approx 15 days. I was refused the opportunity to speak with her supervisor Mr Rob G[redacted] at that time. I called on June 25,2014 and June 26,2014 to multiple Cashpoint locations to try to contact Mr G[redacted]. I was finally able to reach someone named Erica (@###-###-####) who took down a message and said she would have him call me. On June 26,2014 at 2:14pm Mr Rob G[redacted] returned my phone call from his cell phone (###-###-####) and proceed to ask me "What do you want?" In a sarcastic voice (he was on speaker phone and my spouse and family heard the whole conversation)When I explained the situation and my reason for contacting him his responses was "Well its not my problem what do you want me to do?You should make your payments and you wouldn't have lost your truck [redacted] " and when I explained to him I had made all of my payments and had proof for all months (except for Feb as my prepaid card statement only allows 60 days previous transactions from the current date) he called me a liar and stated that "Cashpoint only accepts cash, money order or cashiers checks". I explained to him that I have made all my payments via prepaid debit card per their flier(which I have a copy of) that was provided to me at the time of my contract signing in which he informed me was impossible as the "Motor Vehicle Title Lending in the Commonwealth of Virginia Borrower Rights and Responsibilities" prohibits that which after furthur review does (Prohibition on Obtaining Funds Electronically:A motor vehicle title lender is prohibited from electronically debiting your deposit account or obtaining any of your funds by electronic means) which I also have a copy of as well as copies of my debit card transactions showing where Cashpoint has debited my cards for the monthly payments. I further explained to Mr G[redacted] that I did not owe any payments and they(Cashpoint) had no right to repo my truck to which his response was that the burden of proof was on me to prove I've made the payments and that according to him "their system" showed no payments so my only option was to pay the $1008.81 principal and the $375 repo fee (which is a completely different amount than what Andrea stated) or my truck will be sold 15 days from the date or repo at auction. When I explaned that I would be filing complaints with all appropiate agencies Mr G[redacted] snarkly remarked and sarcastically laughed and stated " Go right ahead the burden of proof is on you and you have nothing and now you definitely won't get your truck back and I will make sure of it" Upon which I became upset and hung up on Mr G[redacted].Desired Settlement: Return my truck without me having to pay the $1325.84 to Cashpoint and $375 Repo fee as they had no right to repo my truck to begin with. Eliminate remaining "profit" balance
