I paid for a five year subscription to his newsletter and was never refunded the difference when he stopped publication.I have four years of a subscription that should be refunded.Desired SettlementA four year prorated refund.

When I went to the web site http://www.fidelityadviser.com/ says they are closed also provided a link to request a refund for remainder of subscription. Link does not work and phone mailbox full no answer on line.Desired SettlementReimbursement for remainder of subscription.Business Response Complaint recorded- the newsletter ceased operations and the link was refreshed to not only provide the email contact but also now automatically generates an email to which the user may add their own specific content. Processing the subscriber's request as quickly as possible.

I paid several hundred $'s for a lifetime subscription to the newsletter. It has gone out of business, without notice or recourse.I've used the newsletter for several years. When it suddenly stopped, without notice, I searched to find out what had happened. The payment was several years ago and I'm not sure I have the records of my subscription. I do have a screen shot of their website noting that my subscription expired on 9/1/2032.Desired SettlementI'd like at least a portion of my subscription costs refunded, or a paid subscription to a comparable newsletter.Business Response The lifetime subscription was for the lifetime of the company and, unfortunately, with the closure of the FIA no additional newsletters will be produced. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)At the time I paid $595 for a lifetime subscription it was never suggested that the "lifetime" so intended was anything other than my lifetime. To say that it applies the lifetime of the business is a contrived and un-natural application when compared to how the term is commonly used. I consider their response to be fraudulent and fully at odds with normally accepted business practice. Final Business Response MA state law Section X-XXX: (X) Words or conduct relevant to the creation of an express warranty and words or conduct tending to negate or limit warranty shall be construed wherever reasonable as consistent with each other; but subject to the provisions of this Article on parol or extrinsic evidence (section 2-202) negation or limitation is inoperative to the extent that such construction is unreasonable.There is no way feasible to continue to force a non-profitable newsletter into existence based upon a warranty that regarded the lifetime of the company and not of the individual subscriber.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I consider this behavior to be deceptive and fraudulent. To offer a "Lifetime Subscription" and then construe it to mean the lifetime of the company is, from my perspective, deceptive. To offer a "Lifetime Subscription" and then terminate it after 9 years seems to be bad, even negligent, business practice. At best, it's easy to view this as a failure of the fiduciary obligation to maintain a going concern.
