from: [redacted] to: [email protected]: Mon, Oct 19, at 2:PMsubject: RE: You have a New Message from Revdex.com Regarding Complaint # [redacted] Hello, I just wanted to provide an update on this dispute It is still not resolved and the lies / deceit continue After my complaint to the Revdex.com, I heard from Anna B [redacted] at Don King Landscaping (DKL) on Tuesday, 9/ On Friday 10/2, she came out to my house looked at all my issues and agreed to replace all my dead plants and grasses, as well as the sprinkler heads that had been swapped out in June In addition we made plans to replace the Aspen tree I wasn’t happy with, with a new Beech tree that she was going to sell me for half price She agreed to come the following Monday, 10/in the morning to do the planting work and that she’d have someone there in the afternoon for the sprinkler work Right before she was supposed to arrive on 10/5, she sent me an email cancelling Several days later I reached out to her to set up another time I told her since we had lost a week, I wasn’t comfortable planting anything new this late in the season; it could wait till early spring However, I still wanted my sprinkler heads swapped out, since two other landscapers had told me that the new heads never should have been used for the areas that they were She told me she’d have someone there Tuesday morning, 10/ No one showed up with no explanation On Wednesday, 10/I asked what the new plan was I was out of town at the time, scheduled to be back home the next day She responded and said she’d be there that week (last week) and that the job would be done by the time I returned home As of Saturday, no one had been there to do the work, so I sent another email, asking about the plansThis morning, I emailed and left her a voicemail that have not been responded too Even if the sprinklers were to be fixed this fall, I do not trust this company or its employees to honor the deal to show back up in the spring to replace the dead plants / grasses Therefore, I would like a full refund of the $I paid to DKL in JuneThis resolution would get me off their back and would allow me to hire another landscaper to resolve my issuesThanks, [redacted]

Complaint: ***I am rejecting this response because:MrKing has once again lied about our interaction in an effort to conceal his wrong doing and shed the best possible light upon himself. Regardless of his selective memory, our up-front agreement was to use commercial grade *** *** parts. We would not be here had he abided by this agreement.** Comments on MrKing’s response: “Mr*** *** requested that we come over to his house on saturday, which we promptly did.”I first contacted MrKing on August with an urgent request. I don’t consider five days to be a prompt response. s/a SMS log, attached“We then went over to the plumbing supply store but realized that they were closed for labor day weekend.”He’s referring to *** ***, his primary supplier. Had he responded promptly, the store would have been open. Furthermore, after thirty five years I would expect him to know his supplier’s hours and know better than to start a job on the Saturday before a national holiday.“we then got matching parts from *** *** which we then brought back to the project.”‘matching’ implies equivalent. Let’s compare on price alone so as not to get too technical: The consumer grade *** valves he attempted to foist upon me cost $12.97/ea.***The commercial grade regulated *** *** valves I now have installed are p/n *** and cost $55.00/ea. “He explained that he didn't want to *** *** parts and that he wanted *** parts from the plumbing supply store and would wait till tuesday"The use of *** *** parts was clearly established and agreed upon before work started.“He then called me up on sunday furious with the fact that we hadn't fixed his property...”This leaves the reader to make an incorrect assumption due to omission of facts convenient to his narrative.“Mr*** then stopped payment on the check where I then informed him that we would be taking him to small claims court.”These facts are not in order and once again convenient to his narrative. I did not stop payment on the check until Tuesday, 9/8. MrKing threatened suit on Sunday, 9/via SMS text. s/a SMS text log** The following is a narrative I prepared for my attorneySaturday 9/: I was not home when his crew started installing parts and when I did arrive they were installing cheap consumer grade valves from *** ***, *** Jar Tops. I instructed them to stop immediately and called MrKing to express my dissatisfaction that he did not seek my approval before making a part substitution. He had a gall to make the lame excuse that he didn't know the operational hours of his primary supplier! After pointing this out, he begrudgingly agreed to return the system to an operational state until he could obtain the parts we agreed upon previously. I had to leave the premises before his crew finished, but that evening I went out to water the lawn. When I turned on the system a geyser of water shot out of the manifold. Not only was the system left open, but he stole my old valves so it couldn't be put back together. I immediately called MrKing to ask when he would return the system to an operational state and he indicated that he would have his crew come out the next day. s/a photos, attachedSunday 9/: The crew did not show up and I called MrKing at 1PM to inquire as to when the system would be operational once again. His gruff response indicated to me that he had no intention of following through on his promise. At that point I told him he was in breach of contract, that I would no longer require his services and would be stopping payment on the deposit check I gave him the previous day. His response was "You're an (ah) and I'm gonna to sue your sorry (a)", to which my response was (fu) and then hung up. At 1:07PM I received a text message from him that stated "Note to ***I'm filing a mechanics lien on you (sic) property and talking (sic) you to Erie court." I consulted with my attorney and he encouraged me to offer a small payment to avoid the cost & hassle of defending a lien. I offered $on the conditions (1) that he return my check, and (2) he sign a release. His response was "Fine." s/a SMS log Tuesday 9/: *** *** stopped by at 10:30AM to conclude our business. She did not return my check and stated that MrKing had attempted to deposit it. Once again MrKing went against his word and acted deceitfully. She signed the release and accepted a check for $that I wrote solely for the purpose of avoiding a legal battle. In my mind, this is extortion, not a settlement. s/a executed release** ConclusionsSo we can see that MrKing is adept at shedding the best possible light on his actions while bending the truth to suit his motivations. His response to customer service is not one of collaborative problem solving, but reliance upon intimidation and deceit. MrKing has proven to be the most dishonest service provider I have run across - maybe even criminal due to the theft of my valves. The internet contains numerous negative testimonials and I have since contacted six of his past customers to understand if my experience was atypical. Unfortunately, their experience & sentiments are similar to my own. My motivation in filing this complaint is two-fold:To ensure that MrKing's actions are on record so Revdex.com can begin to establish a pattern of egregious actionsTo seek relief in the amount of $for a returned check fee and the two valves that MrKing stole in order to hobble my system.I hereby request a call back at *** from a Revdex.com representative to discuss this matter in detailRegards,*** ***

Mr. [redacted] stated that he didn't want to buy cheap [redacted] parts and said that he would pay us for the labor that we had already done and wait until tuesday after the holiday to buy matching parts from the plumbing supply store. He explained that he didn't want to [redacted] parts and that he wanted [redacted] parts from the plumbing supply store and would wait till tuesday. He then called me up on sunday furious with the fact that we hadn't fixed his property, we reminded him that the parts store would not be open till tuesday and that he had agreed to wait. he then became belligerent and told me to "go fk myself". I m the oldest licensed landscape contractor in the town of erie and have been doing this for 35 years and I have never been talked to that way. Mr. [redacted] then stopped payment on the check where I then informed him that we would be taking him to small claims court. I am personaly requesting a call back at [redacted] from your Revdex.com representative to discuss this matter in full.
