Don Witt Tax Service Reviews (2)

August 31, 2017Dear Revdex.com Representative,Thank you for your recent letter regarding Don Witt Tax Service client, [redacted]. I'm sorry to hear that she feels she did not receive proper care regarding her 2015 & 2016 Tax preparation. We take great pride in providing to notch customer service. We...

have received an A rating on [redacted] as well as 5 Stars on our [redacted] Page. Please see my response to her complaint below.[redacted] contacted my office around March 4, 2017. She requested my services to complete her 2015 & 2016 Federal & State personal tax returns. At that time she brought all her paperwork for both years to my office and left them to be completed as soon as possible. We discussed her Oil Royalties, her Social Security benefits, charitable donations and other applicable tax documents.I completed her 2015 personal tax return; however she fell below the income threshold for filing taxes. I provided her a copy of the return and kept a copy in my records. I advised her she did not need to file a tax return.I then completed her 2016 personal tax return. In this year she was required to file the following forms:o 1040, Form 1099-Misc Line 2 (Royalties)o KY740o CO104All royalties were originally reported on a 1099-MISC Form, line 2 (Royalties) along with her Form 1040.[redacted] arrived back to my office on March 9, 2017. At this time I reviewed both 2015 & 2016 Tax returns with her. She signed both documents and paid her fee of $160.00. I provided her with all of the above copies in an envelope, along with her payment voucher and envelope to mail it in. Her 2016 taxes were electronically filed with the IRS, KY & CO on March 9, 2017.[redacted] did call the office a couple of weeks later and said she had filed her taxes because she needed to apply for some type of government assistance and that her income was too high. She questioned exactly what was included in her income for the year. At that time I explained to her all the documents she provided and where to find the totals on her tax forms. She was upset with me and claimed her income was much higher in 2016 than prior years. I explained that in years past she only had income from Social Security and her Oil Royalties; however in 2016 she received a settlement from BP. This significantly increased her income for the year. She claimed some of her royalty income was incorrect. At that time I advised her to please have a corrected form Submitted to me from the Oil Companies and I would be glad to prepare an amended return for her. [redacted] never called back and never submitted any corrected copies.Around April 18" I received a call from a gentleman representing [redacted]. We discussed her Tax Return and he explained that she would like me to prepare an amended return and claim all royalty income on Schedule E. We both agreed this would decrease her tax liability somewhat. On April 19, 2017 I completed the following forms:o 1040X, Schedule EMy office assistant called [redacted] on April 19, 2017 and left a voicemail letting her know that her amended return was completed and that her fee was $40.00. She instructed her to call the office to notify us of a good time for her to stop in, pick up her copies & pay her fee. [redacted], as of August 31, 2017 has never returned our call or come to the office to pick up her amended return.I spent several hours serving [redacted]’s needs. All her tax returns as well as the amended tax returns were completed within the federal IRS guidelines. Therefore, I will not refund her money. There is no reason for her to have to take her taxes to any other tax professional at this time. Of course, it is within her right to do so and I support her decision. I will be happy to provide whatever copies [redacted] may need to follow up with another tax professional.I actually credited [redacted] the $50.00 fee for her 2015 Tax Return and only charged her to complete the 2016 original return as well as the 2016 amended return.Sincerely,Michelle C[redacted] Owner/Operator Don Witt Tax Service 748 Cox RoadIndependence, KY 41051 859-356-7208 ID # [redacted]

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
[To assist us in bringing this matter to a close, we would like to know your view on the matter.]
My first response to Ms. C[redacted]'s letter is that I spoke mostly with her assistant. I don't know her name. I did speak with Ms. C[redacted], but I would hardly call it a discussion. I spoke briefly with her about her knowledge of oil royalties. She and her assistant spoke in a defensive tone and stated she has done taxes for 20 t years and knew what she was doing. Ms. C[redacted] was with another client both times I went to her office and I spoke with the assistant upon leaving my taxes and picking them up.I wanted to apply for food stamps is the only reason I even looked at the tax papers or I would not have found her mistake. She did not provide any paperwork for 2015, therefore, I have no idea she even looked at it, but I was charged $50 and that money was not refunded. She lists 3 forms filed:   1040    yes   KY740   yes   CO104  noShe also filed:   2210K   Schedule M    Other forms are listed on a voucher, perhaps they were used electronically, but I have no copies of them. This also listed the cost.In her 7th paragraph she goes into detail, which is not accurate.  The issue is she filed a DR0021W form as a 1099. It is not a 1099. It is Colorado Severance Tax form which is to be filed with Colorado. The amount on the form is Cash Basis $5708.70 and Accrual Basis $5323.02. In fact there are 3 of them, as I have 3 oil companies. She insisted I was wrong and had a check somewhere and I needed to call the oil company to get a corrected 1099. It is not a 1099, therefore, I had no reason to call and ask for one. She included $5709 as a 1099 showing income that was not to be included as income, but filed with Colorado as Severance Tax which I may have received a refund. I had included a packet that had instructions for filing Severance Tax, which she apparently did not look at. I am also entitled to a depletion. She is unaware of that.I had a gentleman call her to help her, but she assured him she had done everything right.  He told me to call her in a couple weeks, which I did. That call was never returned. I did not get a call from her or her assistant regarding an amended form or a charge for it.I have since filed an amended form since she is not capable of it not knowing what a DR0021W form is. I didn't expect her to refund the money since she is portraying herself as right.Regards,
[redacted]
