-In response to the "Complaint Background", it says the problem accrued on 5/6/ That was the first day I began excavating the job site The customer referred to the excavation as a "mess" I asked the customer where he wanted me to place the dirt that was removed I
asked he wanted me to haul it off or if wanted to keep it on his property to use as backfill or spread elsewhere on his property The dirt was placed exactly where he requested it The pool location originally had several large trees that the homeowner said he would remove He had cut down the trees but had removed the stumps and root basses which were excessively large and required extra work to remove I had to bring out additional equipment to remove the tree stumps and roots before I could continue the excavation If Mr*** had an issue on the 6th of may he certainly did not address it As far as the complaint report reads, it does not address the problem that apparently took place that day.-Further, the report shows that Mr*** talked with Donnelly Pools on 5/18, 6/6, and 6/ I was in communication with Mr*** nearly every single day since 4/25/and have the records to prove so However, it doesn't go into any detail about what was corresponded on those dates and what he felt was wrong For him to say that the excavation was a mess is a play on words The first time that I had any confrontation with Mr*** was on 5/when gunite was shot in Multiple times throughout that particular day Mr*** interfered with the project Through his unknowledgeable communication with the gunite crew he was directly contradicting what I had instructed them to do His interference with the gunite crew ultimately caused confusion which, once again, lead more work on everyone's part That was the first time Mr*** became combative with me His interference was the sole cause of his dissatisfaction.-At this point in the project Mr*** was already a week behind on his payment for the excavation stage of the build To continue progressing his project forward, and in a timely manner, I continued to coordinate all labors, personnel, and material deliveries necessary in good faith that he would pay I reminded Mr*** that I still needed payment for the excavation stage that day 5/and asked if he could also make the gunite stage payment that day as his contract stated He wrote me the check for the excavation stage that evening, which was already days behind, and post dated the gunite payment for days later 5/although it was due at that point in time.-Mr*** states that I did not return to his property for weeks The gunite requires a one week minimum to cure before continuing the project During that time span I was in contact with Mr*** several times In that week span I had been out to their property to deliver tile and coping samples for them to view and choose from Tile and coping was the next stage of the project Also, during that week span I had one of my emplyees break the forms off of the pool shell and pick up around the job site We also experienced bad weather a few times during that time span.-On Saturday 5/Mr*** contacted Donnelly Pools via text requesting an itemized read out of his contract and prices of such stating that his bank needed a more detailed document The contract is already itemized and has a bottom line contract price not a micro specific itemization This is the first time Mr*** has mentioned anything about a banks involvement This request seemed odd to me at this stage of the build All involvement of any bank that I've dealt with in the past with previous customers is done well before a project even breaks ground I asked for the bank representatives email address and he wouldn't give it to me, which made things even more suspicious I received a suspicious phone call/voicemail from a female stating that she worked with the bank requesting such information I explained to Mr*** that I would not give out a customers information to any 3rd party without the customers consent or without formally communicating with the 3rd party in person with the customer present.-When I received Mr*** stating that he wanted to terminate the contract he never stated a specific reason why Upon asking him of a reason why he wanted to cancel the contract he couldn't giving me a reason why Shortly after he began sending harassing group text messages to me and my employees The dialect in his messages was crazy, inappropriate, and unfounded I asked Mr*** to stop messaging my employees and stated that if he needed to talk to me he could contact me directly Yet he continued contacting my employees and myself in crazy manner -If you need more information or this seems inadequate please let me know-- *** *** Donnelly Pools, LLC*** ***

I am rejecting this response because: Mr*** response is very inaccurateWe have documentation to rebut his statements, and can get written statements from Modern Method, gunite crew and Mr*** employees if neededWe have an itemized list of work and equipment costs, that was provided by Mr*** office personThis is what we used to determine what is a fair refund to us for work not completed prior to us terminating the work agreement, (incomplete work agreement I might add.) It is no concern of Mr*** where our funding for the pool comes fromAll payments to him cleared when presented to the bankWe still request a refund of the amount over paid for work not done.Specific reason for termination: Inexperience on the part of the contractor and his crewLesson learned: We will be more diligent in back ground checks, the next time we sub out a project

The customer says that my response is very inaccurate.  If so they should supply a detailed and thorough response that reflects that.
