I am rejecting this response because:The desk was already defective prior to it being delivered, please see attachements one is the
desk prior to stain and the other is of what the condition currently isDoors by Ty knew it was defective and put adjustable risers on the desk legsI contacted them weeks after deliver after seeing the desk was crooked, Ty never contacted me after his wife said she would have him reach out to me but only offered at the time excuses as to why this happenedA desk sitting on carpet for weeks does not cause this kind of issueIf a full refund is not reach I will file a small claims court filing and bring all my documentation with meI have confidence that once the court sees the desk was already off prior to stain it will be in my favorI would rather not have to waste my time or this companies in doing so but will if neededI do not want a store credit as the quality already received is terrible and I do not accept $as it still causes a loss of $plus delivery for an unusable piece of furniture

We have attempted to remedy the situation by offering a partial refund or store credit in this case, both of which the customer has declined

We attempted to settle in good faith, however, the customer declined all of our offers and also refused to sign a settlement agreement with our attorneyAt this time, we have retracted all offersWe are prepared to provide any and all documentation regarding this matterWe advised our attorney to discontinue communication since all settlement options had been presented (and declined) by the customer

The customer purchased an unfinished wood wall, meaning, we would not be finishing the wall - no filling, no mudding, no staining, no painting literally the wood and the labor to put it on the wallPeriodThe invoice outlines the project to a teeShe was told multiple times that all sales are
final - it also states that on the invoice that she paid throughShe didn't like how some of the boards looked after install and sent photos; offered to fix it, she declinedShe then defamed our business on a public forum by spreading falsehoods and also had others do the same - we have documentation of reviews from her friends including photos and statements from them such as "you didn't even offer to fix it for them"- "I saw the work you did for *** *Ridiculous and pathetic".We had a cease and desist drafted because she is ultimately impacting our business reputation by making claims and we do not take that lightly.We will not be issuing a refund; we completed the work, offered to fix the work, she declinedIn addition, we did not stop communicating with her, we do not conduct business matters after 3pm on Fridays or at all on Saturdays or Sundays; this is our standard business practiceWe have been in communication with her throughout this situation with our last communication being yesterday evening via emailWe have done everything we can to remedy the situation

Both parties involved are in the process of resolving this matter by settlement.  Thank you.

We have attempted to settle with this customer several times since 11/17/16 when the initial complaint was filed. We have offered a $1,000 refund ($100 initially, which has been granted, and then three installments of $300 over the next three months). When the customer declined this offer, we then offered a $900 cashiers check along with the initial $100 refund (which had been granted) -- the customer has declined this offer as well  numerous times, in writing, (email) demanding a refund of $1100 instead. After the customer declined our offers and also refused to sign a settlement agreement with our attorney, stating that she would take us to court for more money if we did not give her the full, $1100, we retracted our offers. We have attempted to settle In good-faith since 11/17/16. We are prepared to provide any and all documentation regarding this matter. We advised our attorney to discontinue communication since all settlement options had been presented (and declined) by the customer.

I am rejecting this response because:We have tried to come to an agreement on a settlement but now the business and their attorney's are refusing to speak to me. Still want to settle.

The product was delivered with no defects, in good, working condition as there was no issues with the desk, as the complaint states, until 10/29/16 - 6 weeks after delivery. We received several photos of the desk in her home, on carpet, four days prior to 10/29/16, on 10/25/16, stating that she couldn't post the photos on our page but that she could send them to us to post on our page on her behalf...no mention of any issues. On 10/29/16, we received a short video and photo of the desk, on hardwood flooring, that showed the desk was uneven. Since our products are made from real wood, we explained the reasons why this type of issue could have occurred including, but not limited to, uneven flooring, moisture in th air, the desk being next to a vent, the weight of the items on the desk prior to it being moved from carpet to hardwood, etc. This was not an organic issue with the desk, it was environmentally caused by one of more of those factors.Following our conversation on 10/29/16, there was no further communication regarding the issue for an additional 8 weeks, until 12/26/16, when the customer sent another photo requesting a full refund. We offered a partial refund or store credit considering the customer had now had the product for close to 14 weeks. Attached are photos of the desk on the day of delivery.
