Dorning Const was contracted to replace a driveway and retaining wall for [redacted] and [redacted] On August 11th work began on their projectOn or about the 15th after removing the old concrete driveway upon inspection of existing sewer and catch basins it was revealed that there was several areas of existing sewer that was split and had become full of dirt and sedimentUpon further inspection it was revealed that the existing sewer line had no pitch to main line causing water to lay in the line and freeze during cold weather which caused the line to split and fill with dirt and sediment.At that time [redacted] was notified of the issue and inspected the sewer line himself and even expressed his concern about the part of the line that comes from the foundation drain which was also full of mud.It is my position that the homeowner was aware of the need for the repairs I personally spoke with the homeowner and informed them we would be replacing the sewer line and catch basins because of their improper placement.At that time in the interest of moving on we proceeded to replace the sewer line and catch basins.I felt comfortable with the customer and didn't feel the need for a written order.Because of this [redacted] and [redacted] have justified to themselves that they are not responsible for these charges.I have informed the customer that when I am paid $ for work already performed I will complete the wall and steps

We would like to reaffirm our position that we do not accept Dorning Construction's bill of charges in the amount of $as it violates the terms of our contract. We again affirm that the existing sewer boxes and drain lines were in proper placement and good working order at the time work began on our project. According to our contract Dorning Construction was expected to leave the existing sewer boxes and lines intact and make no alterations to them without a written approval. Our contract makes the following statements regarding the storm sewer boxes and lines.- "This proposal does not include any alterations to the existing sewer boxes located in the driveway they are assumed to be in proper working order and placement and any alteration of these boxes would be at additional cost to the home owner."- "No alterations would be made without homeowners' written approval."- "Any alteration or deviation from above specifications involving extra costs will be executed only upon written order." On August 8th, Dorning Construction began the removal of the old drivewayDuring the removal phase Dorning Construction demolished and removed the existing sewer boxes and damaged the existing drainage lines underneath the driveway with the excavating equipment. Please see the attached photographs which show that the existing storm sewer boxes were in proper placement and installed before work began on our projectPlease see the photograph taken on August 8th which shows that the drain boxes have been demolished and removed and the attached drain lines have been destroyed and removed. We did not authorize or give approval for Dorning Construction to demolish and remove the existing storm sewer boxes and lines. Eight weeks later on October 5th Dorning Construction delivered a written proposal regarding installation of storm sewer boxes and lines in an effort to charge us after the fact for work which we did not approve or authorize. These charges are in clear violation of the terms of our contract as listed earlier in this letterDorning Construction continues to refuse to comply with the terms of our contract despite our many attempts to reach a resolution. When we asserted that our contract protects us from unauthorized and unexpected costs Dorning Construction then abandoned our project and left work uncompleted despite the fact that Dorning Construction had already receivied full payment for the work in question.
