Dorns Towing received a call from [redacted] on Oct 7th around 7:30am asking for Road side service for her driver’s truck that had
broken down on the side of the Interstate with some kind of clutch or
transmission problem. I explained to her that we do not provide Road-side
service, we only...

provide towing services. She said that she would need a tow then
I explained to her that our truck and driver were working another call and it
would be a few hours before we could assist her with a tow. I also gave her the
number to a road-side service company to maybe assist in the time being. I was
contacted back around 10am by Mrs. [redacted] saying that the police
were making her driver move the vehicle from the Interstate and that he would
be driving to the next exit to a truck-stop to see if they could repair the
truck. The truck-stop shop told
the driver that they could not repair the truck, and then the driver called me
to let me know that he still needed the tow to Dumfries, VA. The driver was
very hard to understand since he had a very heavy Middle Eastern accent and I
really could not understand what he was saying was wrong with the truck. I dispatched
one of our experienced heavy haul drivers and when he arrived, he tried several
methods to remove the drive-shaft from the truck but the bolts would not come
out and this could have been from the age and poor shape the truck was in. The
tow driver spoke with the driver of the truck and explained to him the
situation and told him that he could start the truck, put it in neutral and
release the brakes and the truck would free roll while being towed. The driver
of the truck agreed and they headed towards Dumfries without any issues. When
the tow driver was about 1 mile from the Dumfries exit, he noticed some smoke
coming from under the towed truck. He pulled over immediately to find out what the problem was and
could not find anything visibly wrong.  The
driver of the truck told the tow driver that he thought that the brakes on the
trailer were locking up, so the tow driver unhooked the trailer airlines from
the tractor and hooked up the trailer to the tow truck air supply. When the
truck arrived at the repair yard, the tow driver tried to collect for the tow however
the truck driver just walked away. During this time, Mrs. [redacted] called me and
told me that we had damaged the transmission on the truck and that she would
put the driver of the truck on the phone via 3-way. The truck driver kept
saying that he does not know anything about how to tow trucks or work on them
but that our driver broke his transmission. I explained to both of them that
our driver tried to get the driveline removed but the bolts had seized up &
he could not get them removed. I explained to both of them that our driver
explained to the truck driver that if the driver started the truck, put it in
neutral and released the brakes, the truck would roll free & the truck
driver agreed. I told Mrs. [redacted] that I did not feel that we did anything
to harm the transmission on the truck that wasn’t already damaged from the
years of use. I asked her to have
her mechanics take the transmission to a certified transmission shop and have
them put in writing that improper towing was the reason for the transmission failure.
Mrs. [redacted] asked me if we would pay for the new transmission if the report
said it was our fault. I explained to her that we would review the information
and let her know our position. On Oct 8th, Mrs. [redacted] sent me
some information on removing the driveline for towing [redacted]s and said
that the driveline is required to be removed for towing, which we understand
that they suggest to remove the driveline on a truck that does not run due to
the air-system not working and the clutch/transmission being run off of a
pneumatic system. This type of move is normal and customary within the
transport industry due to so many variables in truck equipment conditions and
equipment configurations.  Mrs. [redacted] also said that they were sending the
transmission out that day to Trans Axle for inspection; this e-mail was sent
around noon on Oct 8th. On Oct 9th around noon, Mrs. [redacted]
sent me a Sales Quote from Trans Axle in Springfield, VA that had in the description
lines of the parts “unit was towed while drive shaft still inacted”, then it
listed all the parts and prices with labor to replace a transmission. I tried
to call Mrs. [redacted] but did not get an answer, so I sent an e-mail response
back   letting her know that this was not a written
report from Trans Axle showing that the transmission failure was due to the
vehicle being towed incorrectly and that I needed a written report from them
stating this. I have not heard back from her since this e-mail was sent to her.
I had one of our old insurance companies call me and tell me that Mrs.
[redacted] had contacted them to get paid for a new transmission that we had damaged
on her truck. Our insurance company for our Heavy Hauling which has nothing to
do with our towing division was also contacted by Mrs. [redacted]. I explained
to the agent what had transpired and that I was waiting on the written
statement from Trans Axle, he agreed that I needed that information before I
could move on to with the insurance company. I have not spoken to nor received
any electronic communication from Mrs. [redacted] since Friday Oct 9th around noon.  It seems that she has not
gotten what she wanted from Trans Axle, so she is trying other avenues to have
us replace her transmission on a 13 year old truck that was towed due to
transmission/clutch issues to start with. We have had to tow trucks like this
in the past due to the drivelines not coming apart and we have never had any
issues with anything breaking.Here are the issues that I am having with this particular
incident. The tractor that was towed is a 2002 [redacted], which puts the
truck at 13 years old & well over 500,000 miles. The driver was broke down
due to transmission issues or clutch issues and then it was driven 3 miles and
around a truck stop yard with these critical issues. Mrs. [redacted] has yet to
get me a written report from Trans Axle stating that the transmission was damaged
during towing.In conclusion, we feel that Mrs. [redacted]’s 2002 Truck most
definitely had transmission and or clutch issues when she called to have the
unit moved. Her driver continued to drive the vehicle after it had failed. We
took all necessary and customary procedures to protect her vehicle. Mrs.
[redacted] elected to have the vehicle towed that distance. There are numerous
repair shops much closer that could have repaired her vehicle. Before the
vehicle was unloaded, she was attempting to blame someone for her
responsibilities. We understand that she is frustrated that her vehicle was out
of service however we had nothing to do with the reason that it failed as the
years in service and the mileage undoubtedly played a large role in the
failure.

Review: ON OCT 7 2015 MY TRUCK BROKEDOWN IN HIGHWAY 95 SOUTH BOUND NEAR EXT 92 NEXT TO TA TRAVEL CENTER I CALLED DORN'S SPECIALIZED TRANSPORT TO TOW MY [redacted] CENTURY TRUCK 2002 AND TRAILER THE TOW DRIVER TOWED MY TRUCK FROM FRONT BUT HE DIDNOT REMOVE THE DRIVE SHAFT AND DRIVE AXLE AND DROVE MY TRUCK FOR 50 MILES IN THAT CONDITION AS A RESULT OF THIS IMPROPER TOWING THE TRANSMISSION GOT EXTREMELY HOT AND STARTED SMOKING SPLASHING OIL ALL OVER THE TRUCK AND ROAD DAMAGING THE TRANSMISSION.

THIS IS WHAT HAPPENED ASPER THE WITNESSES OF MY DRIVER AND OUR MECHANIC AND OTHERS:

We are writing the statement to verify that on October 6 2015 we receive a call from the truck driver [redacted] that the truck started smoking and was extremely hot at exit 143 N bound Highway 95.

We reached there and found that the smoke was coming out from the transmission and transmission was very hot and oil splashed all over the truck and on the road .

We asked him how many miles he drove the truck with this condition they said roughly 50 miles without removing the drive shaft from exit 92 to exit 143.

The tow driver then finally remove the axle shaft from the tire and kept driving till the trailer's tires started smoking then he pulled the truck on the road side and connected the airline from his truck to this truck and he dropped the truck in its yard in Dumfries,Virginia. He followed the us all this time till he drop the truck in the yard and said to pay him and that his insurance company was going to take care of all the damages he caused while towing .

Later on when we call his insurance company we found that the insurance information he gave us was wrong his company was not insured with them for more than a year. The tow driver not only gave false insurance information but also wrote false date on the tow receipt as well.

WE TRIED TO CONTACT THE SUPERVISOR BUT HE IS NOT COOPERATING WITH US HE TOLD US TO TAKE THE TRANSMISSION TO TRANS AXLE WHICH WE DID BUT HE IS IGNORE THEIR REPORT .Desired Settlement: they should repair our transmission which is damaged due to their improper towing.
