I met Dan Druffel in early November to discuss having him plow my driveway and get to get a quote on doing some landscaping around the house. During our conversation I told him that I would be installing concrete steps up the hillside to [redacted]. He suggested that I install stone steppers instead of concrete steps. I told him to get some numbers together and I would consider it. We met again onsite at the beginning of December discuss the landscaping for a 2nd time. During our discussion I brought of my concern of stone steppers being as durable and long lasting as concrete. Dan explained that would set the steps in a crushed limestone or gravel base and stack the steps on top of each other which would make them just as durable as concrete steps. After a few more phone calls and emails regarding this job we can to a verbal agreement on price and layout of the steps by mid December. Due to weather conditions the steps were not installed until early April. About a week after they were installed I noticed quite a bit of erosion around the steps and the appearance of the steps sinking. When I looked closer and dug around the bottom of the stone I could not see any gravel so I immediately called Dan asked him if they did use gravel as he agreed. Dan assured they did in fact use gravel and stated he recalled seeing a pile by the street but he would talk to his installers and get back with me. After trying to get ahold Dan via phone and email I finally received a letter on May 4, once again stating that they did use gravel under the steps. I responded the same day via email that we should meet onsite and remove a few treads to investigate together whether gravel was used or not. I received a call the next morning from Dan and he was adamant again there was gravel underneath all the steps and stated it was not necessary to remove any steps to verify. He went on further about his experience installing steps and that the steps would not move or shift and would be fine once landscaping and grass was installed. On May 9, I had my contractor remove one landing stone and one step stone and we found not a trace of gravel underneath any of the stones. On the same day I sent Dan the pictures of our findings and he responded with his May 11 letter. He reiterated that fact that he used gravel but changed it to now to state gravel was used where it was needed and if I wanted gravel under the steps it would have been $1,000 extra. We have yet to find any gravel used anywhere under any of the steps.
