We would like to respond the complaint referenced above point by point. The complaint is filled with many inaccuracies and half truths. First, the customer states that she brought the vehicle to her mechanic for “a safety inspection”. This statement is very misleading. The customer actually took the...

vehicle to her local [redacted] Center. The Purpose of this visit was not for a “safety inspection” but rather to see if the truck was mechanically sound. By the customer’s own report, the truck was mechanically sound according to her visit. [redacted] did list some things they would “recommend” fixing. We reviewed those recommendations with a legitimate repair facility and found that those recommendations were not needed nor required and found those recommendations to be mostly cosmetic. As a state certified car dealership we are required by Rhode Island Law to have an independent inspection station (which is also certified by Rhode Island Law), inspect the vehicle and repair any mechanical issue that is required by the State of Rhode Island. We complied with the law and the vehicle in question passed inspection and was issued a full two year Rhode Island inspection sticker. Please Note at this point the customer says in her complaint that we wanted to “take our registration and use his inspection station to get a sticker”. Again the customer is being misleading to state “our inspection station”. In fact, we are not an inspection station. We use several independent inspection stations. In this case we were prepared to use an Independent inspection station in Massachusetts in order to have the vehicle inspected and have any repairs done if needed. The customer refused. We then offered to have the customer bring the vehicle back to be checked by a different independent repair facility. The customer refused. We then offered to refund over $200 to mitigate this issue. The customer refused.

The business response was nearly, entirely inaccurate. On 6/9/2015 after looking over the vehicle and reviewing the RI state inspection report, which was just done in May 2015, seeing that it that Passed all testing (pg 1 of attach) we took vehicle for a test drive During test drive in RI we passed BTS Tire & Service Store, called them to request a Used Auto Inspection which they schedule for 6/10/2015@ip, then we returned vehicle back to dealer. We made an offer of $5500.00 pending the used Auto Inspection (I mistakenly thought asking was $5995, but asking was $5495, $5 under my offer and dealer did not correct me). 6/10/2015 my wife and I returned and adjusted our offer, based on the actual asking $5495 and offered $5000 pending the inspection. They accepted. Then we took the vehicle to get the Used Auto Inspection at the location we has passed during our test drive (pg 2 of attach). They had discovered quite a few things that could be repaired and replaced and wrote down below the things that must be repaired and replaced in order to Pass State Inspection, item 1, 2, and 3 include the *items which could be a problem. We asked, “would you buy this car for your son? And they said, “yes overall it was a good truck”; but the findings should be addressed. Then we returned to dealer and gave them a copy of the findings and offered $4000 based on repairs we expected to make. They refused offer and put the vehicle up on their lift in their garage and then the owner came out to “explained” away all of the findings, including, telling up BT Tire added on to make money off of us. Seeing our concern, dealer offered to take the vehicle back if it did not pass inspection. (pg 7 terms of sale). So we bought it for $5000 under those conditions and brought the vehicle  home to [redacted]. 6/11/2015 we registered vehicle and returned dealer plates, as requested. While I was off island returning plate, my wife brought vehicle in for MA State                         Inspection, but the Check Engine light went on. they read her codes P-[redacted] and P-[redacted] and sent her away, stating must get dealer to correct. When she called, dealer told her to bring it back so they could take a look at this problem. Based on my wife’s 1st available day off, 6/16/2015 we brought it into their garage again and told us they'd call when repairs were done. Within 5 or 10 minute after we drove off, they called us asking if we’d registered the vehicle. My wife answered “yes”. Then he said “okay” and hung up. Moments later she answered another call from dealer asking her where registration was. Answer: “we have it with us in folder”. Can you fax it to us” was next? Answer: “no we’re driving”. [redacted] she asked why?. He answered, “so we can take too a MA state inspection station for you” was his answer. She said “thank you, no; we can get it done ourselves”. Moments later, the owner called, stating the vehicle was ready and we could pick it up. So we returned and he explained the Check Engine light was still reading after they had repaired problem prior to our purchase; and we simply needed to drive 100-150 miles to clear it out of system. None of this set right with us but we did what he asked, then brought it to a MA Inspection station in [redacted] after we’d driven the necessary miles and the light stayed off. At the inspection was completed it had completely failed (pg 3-5 of attach). 6/17/2015. I faxed the report to dealer then called him (page 8 faxed report) At this point, the owner got on the phone and I asked to please call and speak with the inspection station. He refused and told me that “the guy just want to make money off of you, so he can buy a new leather couch”. When I insisted that he please call the inspection station; he refused and offered $200 take it or leave. I then told him that, according to the terms, I’d be returning vehicle. He shouted No, it’s too late for that now. As I continued to press the issue he screamed at me, telling me to get a lawyer. Since then we’ve proceed to repair the vehicle (pg 6 of attach) and filed this report, in hopes that we can recover at least the money that was spent repairing the issues directly related to its passing inspection (please review repair invoice) and to hold this dealership responsible for attempted to fraud the MA and RI State vehicle inspection systems
