On 12/13/our borrower paid *** *** *** *** *** a payment for an application fee of $595.00. *** was unable to “source” this payment per *** Guidelines. The borrower’s loan closed on 1/13/2017. A local Title Company handled the closing of this loanThe Borrower was
misinformed that they would receive a “check” for $after closing, when in fact on the Final Settlement Statement dated 1/12/signed by the borrower, section J, *** gave the borrower a refund/credit of $for their un-sourced application fee that we collected on 12/13/2016. Review: took deposit on remodel contract, work not started, deposit not refunded

contractor took a deposit to start a remodel. the permit was not issued, the work could not be started and after 4 months of requesting our deposit back, he has not refunded our money.Desired Settlement: return of deposit

Business' Initial Response

Customer's claim is not genuine. Customer has breached his obligations under contract by refusing to obtain available permits and has recently terminated that agreement unilaterally. Customer is requesting reimbursement for cut-to-length materials he paid for on a March 29th invoice, and is now trying to characterize that payment as a "deposit". Customer was warned prior to purchase that the materials cannot be returned because they were sized specifically for his project. Customer owes contractor $4776 for services to date plus a cancelation fee. Contractor has offered to retain the materials and offset the final bill by the full value of the materials, but customer remains non-responsive because he doesn't want to pay what he owes. Contractor has also offered to deliver these materials to customer's attorney but customer remains non-responsive, again because he doesn't want to pay his bill.
