I am rejecting this response because it is not factualWe have two signed contracts that stated the work would be performed as specified for $10,as well as additional costs for replacing wood trim at $per square footWe have three different cashed checks demonstrating that we have made a total of $10,Despite this payment nearly 40% of the work specified by the contract was not completedIn addition, work already performed was performed poorly and we now have a roof leak where the work done was not properly flashed and will have to be redoneSubcontractors or workers were never supervised or managed closelyIn addition, a mechanics lien by *** has been plaeced on our property for $2,because they were never paid by the contractorMy family is looking at a loss of $6,dollars due to work not completed and the mechanics lienThis does not even include the damage to our house done by the workers ( I will not go into detail here) and the possibility of other liens by unpaid subcontractorsWe are hoping to work something out with the company so that we can come to some sort of satisfactory arrangement.

This Customer's check was sent in the mail on 10/10/17. Pursuant to Illinois Law, when a construction company rescinds a contract, all monies must be returned within days. At no time was an email sent expressing a refund at any tme prior thereto. In fact, this was explained to
this customer exhaustively. The reason for this is because a construction company this size has to rescind the permit first, then provide to our insurance company and bonding company to release the coverages. Again, this was explained to this customer. I can certainly understand the frustration, as evidenced by the tirade displayed in our office which led to the email referenced, but the facts are that the construction industry in Illinois is heavily regulated and unfortunately Gallagher Construction adheres to such law. Nonethless, the check was sent via certified mail with a return receipt requested as required. Gallagher Construction Group sincerely wishes it could have performed this service for the customer but unfortunately the hurricanes in Texas and Florida have demanded our manpower resources be ustilized elsewhere due to our national contracts forcing us to make the difficult decision to refund this deposit. We look forward to closing this matter out and hope to be of service in the future. Thanks

I communicated with this customer at noon today, literally today, explaining that her cabinets were being unloaded into my warehouse exactly on the date that I said they would be. I had the flooring delivered to the home on Saturday to acclimate and expect installation to start tomorrow or Wednesday followed by the cabinets. I understand that the Revdex.com matter shouldn't be closed until the installation is complete and accepted by the customer but at least this is a current status of events and I am communicating with Ms*** directly. I will keep all parties updated as we progress to finish this project

Ms. [redacted], In the response you just provided you confess to constantly telling me and my staff you accuse us of discrimination all the time.  I have sent five different crew memberss to your house.  We are completing your project for you and busting our butts doing so since we are being forced to dig by hand.  We will complete the fence for you ASAP.  At that time, we will process a refund for the deposit you provided for your patio as this is the first time you requested a refund.  I will not even charge you extra monies for the extra labor required to install your fence.  Once the fence is completed and you sign the project completion form, we will provide a refund for the deposit provided for the patio less the balance remaining on the fence.  I agree given the difficulty experienced on this project the best approach is the cancel the contract for the patio portion and part ways after completion of the fence.  I assume this will be acceptable to you.

I apologize for overlooking this complaint.  Yes we did have an agreement to refund the balance; however, this was also contingent on Gallagher Construction Group receiving back the cancellation of contract which we sent via mail with a return envelope endorced.  We have not received it...

back as of yet.  In order for Gallagher to cancel the contract and process the refund, we have to provide a Notice of Cancellation to our insurance providers to release the bond and cancel the warranty coverage.  Being 100% honest, I did believe we had received it back when speaking to Ms. [redacted] and am truly not trying to cause this customer further grief but the offer to cancel the contract was a gesture of good faith and not required by Illinois Law.  In speaking to Ms.[redacted] she keeps referencing the "agency" so I am wondering if she forwarded the Cancellation to the Revdex.com.  Regardless, we will send another copy for execution and get the matter resolved in short order.  I truly do apologize that I overlooked this complaint as I always respond to the Revdex.com and am extremely proud of our A rating.  I assure all copied on this response that Gallagher will get the matter resolved.  It may not be as quickly as the Customer wishes as we have to follow proper procedure but we will get it resolved.  Thanks.

Unfortunately this Complaint simply isn't factual.  Mr. and Mrs. [redacted] have refused to sign the Change Orders required to complete this project.  In fact, Mr. [redacted] called the company yesterday wanting to find a solution because not only have they refused to sign the Change Orders to...

replace the now clearly visible rotten wood inside the window sills, they currently owe over $12,000 in back pay.  All of this is documented via the attorneys and although when dealing with as many consumers as this company does on a yearly basis, there are always a small percentage of customers that 1) refuse to pay, and 2) want extra work clearly not in the contract included at no cost.  Gallagher has sent probably a half dozen different contractors to the site trying to make this customer happy to no avail.  The matter has currently been handed over to our attorney to file Mechanics Liens for monies owed.

Mr. [redacted]'s recollection of events is grossly innacurate.  Mr. [redacted] signed a contract wherein his roof replacement was being funded by an insurance claim.  We were not made aware of this fact upon accepting the project.  We were aked, and originally agreed to a down payment less than...

that required in the contract as Mr. [redacted] expressed the need for financial flexibility.  We obliged.  Some time later, when it was discovered that the project was in fact an insurance claim, we offered, and Mr. [redacted] agreed to allow Gallagher to act as his agent and negotiate with the insurance company.  Upon receiving the signed insurance authorization from Mr. [redacted], we spoke to his insurance agent wheeein we learned that Mr. [redacted] accepted a lump sum cash settlement and had already been paid in full by his insurance company.  This raised red flags for the obvious reasons as we were asked for leniency on his down payment and now learned that he had already been paid in full by the insurance company.  Having been in business for 20 years, I have the experience to know when my company may be at risk and as such requested Mr. [redacted] pay the balance of his deposit, which he did.  We then ordered the materials which were specified as "[redacted]"  we ordered "[redacted]" shingles.  As it turns out, Mr. [redacted] didn't like the "[redacted]" shingles, he wanted a designer colored shingle (I don't recall the exact name) so we had to return the "[redacted]" shingles and replace them with the designer shingles.  We then asked Mr. [redacted] for an additional payment as the designer colored shingles required payment in full by Gallagher.  Mr. [redacted] obliged.  Gallagher is now ready willing and able to complete the job upon receipt of proof of funds for final payment.  I have been doing contruction a very [redacted] time and will not apologize for protecting my company financially.  Nonetheless, we are completing Mr. [redacted]'s project in short order. Lastly, what was also left out by Mr. [redacted] is that when he felt we could secure him additional monies from his insurance company, he had no issue with the project being delayed.  In addition, Mr. [redacted] went on vacation for two weeks wherein he desired us to wait until his return.  Once it was discovered that Mr. [redacted] took a lump sum cash payment and closed his insurance claim, he then began demanding his roof be completed instantly but unfortunately, with Mr. [redacted] being the 248th residential job completed by my company so far this year, we had to place him in the schedule accordingly as my company has a substantial backlog due to the quality of our work, the warranty provided, and the lengthy history in the Chicagoland area. Again, I am unable to apologize for protecting the financial integrity of my company and assure everyone that our 248th job of the year will be completed with as much quality as the first one and the last one of the season.  Thank you.

My company has admittingly had issues with this customer.  We have tried earnestly to meet her demands and have fallen short in her eyes each step of the way.  When we speak on the phone, it is nice as pie and we agree to everything and then within hours sometimes an email is received...

berating my company and my men.  Sometimes we receive three or four emails a day.  My company was decimated with the flu and we are substantially back logged.  There is nothing I can do about my men being out, as well as my staff, and no matter what Ms. [redacted] wants results, which I completely understand and we are driving as hard as possible to reach them.  We expect to be onsite next week to finish the project and provide the quality we have provided to all of our customers.  The bottom line is my company is back logged, short on manpower due to illness, and are working to recover.  There is nothing more to say than that except that when we are finished the customer will be pleased.  In regard to the threat to call the entire world and smear my company name online, that is a matter best left unaddressed for the obvious reasons; however, I can say that with all of my customers, I simply am not provided one inch of relief with this customer which is the case sometimes when working with customers in their home.  We simply ask that we be given some time to right the ship and work through our back log, and we will.  Ms. [redacted] is a dearly valued customer and we are excited to get the project completed to her satisfaction. As an aside, I have asked for the medical records and receipt from her son's doctor visit and have offered to pay all expenses.  As of today's date, I haven't received anything but remain willing to cover the doctor visit.  It's the least I can do.

Ms. [redacted] complaint is absurd and offensive.  She has alluded to racial discrimination from day one going all the way back to negotiating her contract.  My company has perfoemed work at her property under constant threat and accusation, have had to dig all post holes by hand due to her...

neighbor being uncooperative, and continue to complete the work in spite of her constant harrassment and threats to file racial complaints.  I don't know why this customer constantly makes racial threats but it's ridiculous and bordering on interference of contract.  I have had to replace my men on several occasions due to complaints of her harrasment.  My company completes work for every customer who demands my company regardless of race or religion.  We employ men and women from all ethnic backgrounds and I am putting on record that should this Customer make one more single reference to me or my company being racist I am pulling off this job and will sternly fight this matter at whatever level Ms. [redacted] deems appropriate.  Regarding yesterday, sometimes things happen in life and her crew leaders brakes failed.  Ms. [redacted] was notified and like any good Owner, I instructed my men to resolve the vehicle issue as it was a safety matter and return to the site as soon as possible, which is this morning.I will contimnue to complete the project, as contracted but dislike being called racist.  It's not something any person or business Owner should have to ensure!

I have waited to respond to this complaint until a time I could remain professional so here goes.  In the State of Illinois, each residential construction project requires the Customer to sign the Lisa Madigan Contractor Education Brochure educating consumers as to the laws of the State of...

Illinois.  The Customer whom filed this complaint was provided such brochure and signed the state mandated receipt which is in file.  The referenced brochure provides the consumer with many tips one of them being the law in the state of Illinois as to cancellations.  The law requires that any cancellation be made in writing via USPS mail and postmarked no later than midnight of the third business day following contract execution (excluding weekends and holidays).  In this case, no cancellation was provided from the Customer.What has actually happened here is that the Customer has requested that Gallagher provide references of prior construction projects COMPLETED IN THE SAME NEIGHBORHOOD.  This request was made after contract execution, after expiration of the cancellation period, without being documented in the contract, and candidly without reason.  Gallagher was able to provide dozens of references and addresses to previous projects "close" to this Customer but requiring a reference be made on the specific block is something abnormal and unusual at best.STILL I discussed a refund with this Customer until they became rude and disrespectful wherein I simply chose to follow the law.  I have absolutely no obligation, legal or otherwise, to provide a refund outside of the laws of the State of Illinois and responding to a completely fabricated complaint such as this is truly testing my customer service skills but nonethless I decided to respond with the facts and according to the laws of the state of Illinois as directed by Lisa Madigan's office.
