This response is to the complaint brought to you by *** ***, ** *** *** ***, CT ***. ID *** in the amount of $In we provided fertilizing and lawn cutting services to Ms. *** (a signed copy of the
contract has been attached). On March 1, 2015 we mailed out, via first class mail, our letter regarding the start of the new fertilizing season which gave a deadline date of March 11, to call the office to cancelor modify their existing contract (a copy of which is attached). On April 8, 1:pm we left a message on Ms***'s answering machine that we would no longer be providing lawn cutting services to her but would still provide fertilization services as contractedOn April 24, we arrived at Ms***'s home and applied her first treatment of fertilizer.
On May 7, at 1:pm Ms*** called our office and said that she didn't want our services this year I informed her that the signed contract that she signed on 04/29/(copy of which is attached) renewed continually year after year unless customer contacts our office and cancelsI also told her about the mailing that was sent out in the beginning of March which gave specific dates to call the office to cancel or modify the contractsMs*** told me that she never received my letter and asked me for a copy of the letter and her signed contract to send to her attorney which I mailed to her on the same day(a copy of that conversation is also attached)We feel that DrGreen Lawns did not breech our contract or act inappropriately in this situation given the fact that we gave her ample notification that we would still be providing fertilizing services to her

My wife and I had questions about a section of our lawn . We called Dr. Greenlawn up and the owner came up himself . He answered all of our questions and told us he would take care of it. The next day his tech came and sprayed and fertilized the area of our concern . Thank you Randy ! I will recommend them to everyone .

Review: I signed a contract for the mowing season 2014. It included the weekly mowing and 5 rounds of fertilization for the season. I received a voice message in spring of 2015 that they would no longer be providing lawn care and if I had any questions to call. I did not have questions as their message was clear to me that they will not be providing any lawn service. I hired another company to take over. Several weeks later, much to my surprise, they fertilized (at first I assumed it was my new service but weeks later I received a bill from Dr. Green Lawn). I called and they said I was bound by the renewal clause on the contract. The contract is for mowing and fertilizing. I did not accept or sign a revised contract. It's my position that they wanted to void the contract. If their position is that the contract is binding, They breeched the contact by not providing full service as agreed. There is not a clause that provides for them to alter the contract, I was fine with the contract being cancelled, as I said I got another service and in fact, it cost me $10.00 per week plus tax more.Desired Settlement: I would like them to cease any further collection action and clear the account.

If they persist on my paying the unauthorized service, I would request reimbursement for the additional mowing fees I had to pay for the season as they would be bound by this contract as they did not show up to mow,

Response:

Review: [redacted]

I am rejecting this response because:Once a contract has been signed, then it cannot be changed unless all parties to the contract agree to the modifications. I did not speak to anyone about modifications to the contract. I would not have approved or agreed to any changes.

Sincerely,
