Dear Sir/Madam,

This correspondence is to file a complaint about Howard Budner & Associates (Optometrist office) for continued harassment and retaliatory behavior. Although I have asked them in writing to refrain from harassing me and my family, they are persisting in doing just that.

In response to a nine (9) month delayed and an erroneous billing statement, on May 17, 2013,

I sent a certified letter (enclosed) to the aforementioned office disputing the charges and clearly stating what I would accept as fair resolution. This letter was met with rude, disrespectful and unprofessional behavior, via telephone, from Howard Budner in the form of bullying.

Shortly thereafter (June), I sent a second certified letter (enclosed) requesting response and resolution via written correspondence or the unprofessional behavior would be reported to the Revdex.com and the Consumer Financial Protection Bureau. After which Howard Budner immediately sent a response spewing hostility and unprofessionalism. After over a year of dealing with the unprofessionalism of Dr. Howard Budner & Associates, the situation was resolved by my health insurance provider.

On September 16, 2013, I formally requested, in writing, that he and all of his associated offices cease and desist in contacting me or any member of my family via any communication method. Additionally, I asked that he and all of his associated offices remove me and every member of my family from ALL contact lists immediately.

Unfortunately, shortly after receipt of this certified letter, Budner & Associates continued to send flyers to me and my family member. I gave him the benefit of doubt and decided that it may have been a mistake with the computer system. However, soon after we received more flyers in the mail. I foolishly let that go as well. But just recently, more mail is arriving from his office. (Only a subset has been enclosed to reduce natural waste) Is this the practice of an ethical business? Is this the practice of a professional? No.

This will be my final effort to work with this immoral, unethical and unprofessional individual and his “business”. What I am requesting and what I will accept as the ONLY resolution to this complaint are the following actions:

- Dr Howard Budner provide a written apology for his (and/or his employees’) unethical and unprofessional behavior regarding his attempt to breach the contract with my health insurance company at my expense

- Dr Howard Budner provide a written apology for his (and/or his employees’) harassing behavior regarding continually contacting me and my family when he was fully aware it was unwanted

- Dr. Howard Budner provide written verification that he has removed me AND my family members, my phone number(S) AND my address from ALL of his contact lists/records, to include but not limited to, phone, email, postal mail, and texts and any other database or listings. Also, it is NOT acceptable to camouflage physical mailings by adding “Or Current Resident" under my name OR using SOLELY “Current Resident” or ANY other method devised to continue harassment - Thus, the statement should include that he has REMOVED MY ADDRESS and will not send ANY correspondence to my address regardless of the addressee

- Dr. Howard Budner provide written verification that he will NEVER contact me OR any of my family members in ANY way, for any reason

- Dr. Howard Budner provide written verification that he understands that any further HARASSMENT (communication OTHER THAN the response addressing ALL issues in this complaint) will be referred to an attorney

I will not be satisfied with, or accept, ANY resolution other than what is listed directly above. I feel that I have given Budner and Associates ample opportunity to behave ethically and professionally. As Mr. Budner, and his offices, have continued to show actions that lack professionalism (harassment of me and my family), I CANNOT accept any other resolution.

I have enclosed copies of relevant correspondence and information. Please advise if you need any further information from me. Thank you sincerely for your time, consideration and assistance in resolving this matter.

Dear Sirs:

Enclosed please find the letter that I sent to [redacted]. It outlines everything. Also included is a copy of the form she signed indicating that she agreed to the charges and would be responsible. She complained to her insurance and the board of Optometry and both found in our favor. We are simply frying-to be paid for our services to which she refuses to pay. With respect to the post cards and mailings her and her daughter have been deactivated months ago. She will not get anymore mailings, phone calls or texts from our office ( as you can see they are not forms of harassment) . I find it amazing the lengths this woman went to avoid her debt. She never spoke to me personally after repeated phone calls. At this point its not worth the aggravation and I am writing off her debt, I will not write her an apology note about anything we have done. She can take it or leave it as this I believe is all she wants

Dear [redacted]:

I am responding to your letter dated 5/17/20] 3 and have left 2 messages for you to call me. While I understand your frustration and concern about the bill I can assure you nothing was done inappropriately or fraudulently. When yon came in you were slotted for a comprehensive eye exam. My associate examined you and found several issues that were non routine and discussed them with you. It is documented in the chan. These issues ( narrow angle glaucoma risk ) along with you being hypertensive required a different examination. He even referred you to another specialist for evaluation for this condition which I hope you had done. For example, you go to your medical doctor for a routine visit and he finds a heart murmur and now you need an ekg and ultrasound and a referral to a cardiologist So he took some photo’s. For the record we as doctors do not go looking at your insurance cards and try to determine what is covered and what is not and examine you accordingly. We are concerned about your health, so please do no insinuate that we did anything inappropriate. In fact we attempted to get a referral from your PCP on several occasions with, no response so that your testing would be covered. The reason your have not heard from us is because we have been waiting for a call from your insurance company to help resolve this issue. Evidence we are working on your behalf.

With regard to your other assertions, enclosed please find a copy of the advance beneficiary notice that clearly outlines your rights and our policies which you signed. Additionally there are posted signs in our office describing the different portions of an eye exam. In the spirit of fairness I would be happy to work out a reduction of the charges provided you contact me personally.

Review: I visited Dr. Budners [redacted] office location on 11/26/12 for an eye exam. When I called to make my appointment I spoke with the office manager, and she and I (I think her name was [redacted]) talked about the insurance procedure and she said she would be submitting the exam to my health insurance to pay for it. The manager asked me to provide my insurance policy number in advance, so she could verify benefits to confirm that I would only be getting the eye exam services the health insurance would pay for.

I submitted this health insurance info prior to my visit. I expressly told the manager I only want an eye exam that the insurance will pay for and she confirmed that insurance would cover the exam.

I arrived on 11/26/12 for my appointment. They examined my eyes for both the contact lense and the reading glass prescription. At some point in the eye exam I asked again about my insurance, at which point I was told that the insurance does not cover the contact lense exams portion of the eye exam so I would have to pay out of pocket for that. I told the exam assistant that the office manager and I had spoken and when I made my appointment, it was for an eye exam covered by insurance.

At this point the eye exam ENDED. They told me they would stop the exam and go no further. I was told by the office manager ([redacted]) that there was a misunderstanding, and this one time they would only charge me and my insurance for the eye glass portion of the exam, and would waive (that is NOT CHARGE ME) for the additional procedures of the exam relating to contact lenses that would not be covered by my health insurance. The manager also explained to me that because I wasn't paying for the contact lense portion of the exam/they were not charging me for the contact lense portion, that they WOULD NOT GIVE ME A CONTACT LENSE PRESCRIPTION. I said thank you and left and office and I appreciated that they were honoring what they promised me on the phone - to provide me with an exam that my insurance policy covered - and thought that was the end of it.

In late August 2013 I got an invoice for THE FIRST TIME since the Nov. 2012 eye exam from Dr. Budner and Associates for the $111.00 or so that the insurance did not pay for. This invoice threatened me with collections if I did not pay it.

I immediately called the office (on approx. August 29) and spoke with a receptionist who told me the office manager had left the practice and that the new office manager wasn't in work that day, but after the Labor Day Holiday they would look into this. (I explained to her - her name was either [redacted] or the new manager's name is [redacted]) about my experience in November 2012 and that I was very unhappy to be getting a bill for services I neither requested nor fully received. She assured me it would be handled.

I didn't hear anything else back from the office until a lawyer sent me a collections notice dated November 15th, 2013 asked for $117 - that is, for $111 with 6% per annum from 11/26/12.Desired Settlement: I would like the bill adjustment that was promised to me in November 2012, so that my balance due is ZERO. I want that in writing.

I would like an apology for being harassed for services I never fully received nor asked for nor agreed to (remember - they never gave me the prescription for eye lenses because they were waiving the fee for it because they were never supposed to have performed the contact lense exam in the first place).
