Revdex.com:I have reviewed the response made by the business in reference to complaint ID *** and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.As an initial matter, I would like to reiterate that I received no response to the email message that I sent to Airtech dated January 20, 2017, the text of which was provided to you as part of Airtech’s response. It appears that MrB*** has copied the text of my email message and inserted his intended responses to each of the paragraphs, a copy of which he then provided along with Airtech’s response. However, these responses were not previously transmitted to me, via return email or otherwise, and I dispute MrB***’ assertion that a prompt response was sent to me. You will note that the “copy” provided by MrB*** has no time or date stamp or any other indication that a reply email message was sent; it is merely a copy of the text of my email message with his own response inserted after the fact. It appears that MrB*** is attempting to create documentation after the fact in an attempt to bolster his positionAdditionally, MrB*** relies on a purported “guarantee” included in a Proposal for Radon Remediation (Proposal) that he has attached to his response as support for his position regarding his refusal to incur costs associated with repair or replacement of the faulty system and his assertion that a short-term test is insufficient evidence that the system is not functioning properly. This Proposal, including the purported “guarantee,” was never presented to me. In fact, you will note that the Proposal is unexecuted and is dated 01/14/2017. This is a full year after Airtech installed the faulty radon mitigation system in my home. This appears to be yet another blatant attempt by MrB***’ to create documentation after the fact to support his position. Further, MrB*** asserts that the “guarantee” is “based on results of a long-term radon test and not on the results of any single short term testing.” Had this been made clear at the time the system was installed I could have delayed construction until a long-term test had been performed, negating the need for any damage to or repair of drywall associated with repair or reinstallation of the radon mitigation system. However, MrB*** did not bother to present a contract to me for review and signature and because Airtech performed a short-term test after installation of the mitigation system and declared the level to be “within the recommendation of the PA DEP” with no recommendation that a long term test be performed, I reasonably proceeded with my planned construction. (See attached email from Sandy B*** / Airtech dated January 19, 2016). Airtech cannot unilaterally and retroactively limit the damages attributable to its failure to properly design and install a mitigation system, nor can it unilaterally and retroactively impose limitations on its warrantyI proactively contracted with a certified radon remediation professional to test and remediate my basement for radon prior to finishing the basement into living space. I did this because I intended to finish the basement into a playroom for my children and a bedroom. I do not take the health of my children lightly and I took measures to protect them from exposure to high levels of radon. I paid Airtech $to install a radon mitigation system. At that time the radon levels in my basement were PCi/L. A year later, after incurring the $cost of the radon mitigation system, radon levels in my basement measure PCi/L. My children have been exposed to radon levels in excess of the EPA’s recommended PCi/L for nearly a year based on Airtech’s assertion that the radon levels in my basement are “within the recommendation of the PA DEP.” (See attached email from Sandy B*** / Airtech dated January 19, 2016). Since additional testing indicates that this statement by Airtech is untrue, I have stopped allowing my children to use the basement playroom and bedroom even thought I incurred a substantial cost to finish this area into living space for them and even though avoiding the space is inconvenient and disruptive. Now MrB*** wants me to delay action for an additional year and perform a long term test. I do not find the additional delay awaiting the results of a long term test to be an acceptable solution. I find it highly suspect that, of the short-term radon tests performed in my basement between January and January 2017, the only test that indicated radon levels below the EPA’s recommended threshold of PCi/L was the short-term test performed by Airtech immediately following installation of the mitigation system, upon which Airtech based its assertion that the radon levels were “within the recommendation of the PA DEP.” (See attached email from Sandy B*** / Airtech dated January 19, and attached radon analysis reports). This alone is reason for me to distrust Airtech and MrB***. Taken in conjunction with MrB***’ assertion that he replied to my email promptly when he did not and his proffering of an unexecuted and post-dated contract as evidence in support of his position, I am sure you can understand why I wish to have no further dealings with MrB*** or Airtech. For this reason, I want my $refunded so that I can contract with an honest and reputable radon remediation professional to address the elevated radon levels in my basement in order to protect my children’s healthThank you and best regards, *** ***

Radon Testing and Mitigation Services3/15/RE: ID ***We installed a radon remediation system at this property in January Post-test results showed levels below 4.0pCi/L which met the recommendation of the PA DEP.The warranty we provide (attached and highlighted) clearly states
that the guarantee is based on results of a long-term test and not any single short-term testIt also states that we are not responsible for any work/repairs that may need to be made to dry wall, flooring etc.I personally spoke with Mr*** about this and he told me “Ms*** is an attorney and she sitting home just waiting to sue us.” I tried to explain how radon works and it is not always the same consistent level even with an active radon systemHe ended the call.Shortly after I received an email from Ms*** and I did replyI have attached the print out to this letter.We have followed all PA DEP guidelines as well as honored our warranty and in addition provided free testing to the customerWe have offered to do the work according to our warranty several times and have been declined by the customer.Sincerely,Sandra B***
