Dear [redacted],
During the time in question, I was not involved with the filing of insurance claims; my office manager/ biller was.  So I was not aware until I read [redacted]'s complaint and checked with my biller that we were filing, in error, the insurance...

claims with [redacted] instead of [redacted] until October.  To my best recollection, [redacted] did not specifically state this mistake when we spoke on the phone in September.  I am sure that if he had, I would have asked my biller at that time. In September and October, I was very busy preparing for the move of my office scheduled for the end of October.  So I did not file the claim with [redacted] until November.  I never received a response from [redacted] to the November filing.  That is why I was threatening to send his account to our collections lawyer when I sent him a bill at the end of December.  Attached is a letter from [redacted] dated 15 Jan 15.  I suspect that it is in response to a call from [redacted] after he received the 31 Dec 15 statement from me.  Since I received that letter, I have taken no further action, including not sending him to collections.  
But the way, for in-networking providers, the claim must be filed with [redacted] within 90 days of the date of service.  [redacted] was seen on 28 March 14.  In his complaint, he states that he called my office in July, August and September about our filing with the wrong insurance.  That means that he called after the date that we could have filed with [redacted].  He received at least one billing statement before 28 June 14 that showed an incorrect insurance.  Yet, he did not call until July at the earliest.  Even if my office had filed with [redacted] in July, the claim would have been rejected because 90 days had already passed since the date of service.
So what do we do now?
