I am rejecting this response because:
I disagree and refute DrYerrington’s response and provide the following to substantiate my statementsI stated in my original complaint that I am the father and this lab test occurred while my son was His current age is irrelevant
If the lab test was a required test as stated by DrYerrington then it would have been covered by the insurance, it in fact was notFurthermore, the lab test in question are not as described by DrYerrington below, it is in fact “81291-MTHFR gene analysis, common variants 81355-VKORCgene analysis, common variants” (See attached January BCBS of TX letter)Furthermore, the reason for the rejection is “Experimental, Investigational, and/or Unproven” (see January BCBS of TX letter), not standard routine test required for medical practice
This was discussed previously, and the deflection is quite unethical in my opinion, and an attempt to misrepresent obvious factsI called the agency American Med Systems, IncDrYerrington is using to collect this denied charge, and they stated over the phone that DrYerrington hired them to collect this claim, contrary to what he said in his response
Also discussed previously was the violation of trust when a doctor pushes unneeded testing on an unsuspecting 21-year-old and is asked to sign a form from someone he is supposed to trust to be looking after his welfare, not trying to line the profits of his medical businessNow he implies Buyer BewareBe assured I am very aware
As far as the statement made about me from DrYerrington is not what actually happened, as he well knowsI told him no to the gene analysis testing numerous times and when his technician put paper work the day of my regular blood work in front of me to sign routinely, I saw the unwanted testing included and made a big deal about it on the spot, (extremely unethical to slip this in to a regular test event) I crossed out the unneeded test, and told the technician I refuse those test, and only agreed to test for Cholesterol and thyroid the same as historical previous test, and during the follwhen I saw the test results that I unequivocally told the technician I did not want, and told DrYerrington the same right on the spot, DrYerrington stated that HE would decide what test I take and do not takeI countered “not without my consent”, at which point he walked out of the room ignoring meNeedless to say that was the last visit to his officeThis was all part of a big push by DrYerrington to get his patients to sign up for *** *** *** gene testing that according to my informal inquiries into the company has a reputation for churning unnecessary test and referrals and is not looked on favorable by the Insurance companies, hence my refusal to take it willinglyThis denied claim substantiates my assertions that insurance does not approve of the testing, and further confirms the lack of integrity in this entire incident

given full disclosure of the fact that since he was seeking medication that is a controlled substance for his diagnosis of attention deficit disorder he would be tested on a regular basis for a toxicology screen which is done on urineWe have used no less than six different labs for toxicology screens and we do this toaensure compliancebto ensure no illicit drugs such as marijuana or "street drugs" are being used concomitantlycto ensure the patient is not taking any drugs that interfere with, compete with, or potentiate the dextro amphetamines the patient was seeking for his A.D.Ddto ensure that if ever the patient comes under investigation by the DEA for suspected drug abuse that the patient and our practice are medico-legally protected through proper documentation and testing that abuse is not occurring under any regimins of our designAs is recommended as a national initiative for reduction of drug abuse.The patient signed the enclosed consent form and full disclosure of which lab we use.Toxicology lab testing is expensive and the patient was clearly told and understood that if the patient portion, after insurance allowable was paid, was beyond his financial capability that he would never have a notice against his credit and that the lab routinely grants grace to those who are financially unable to pay this balance after legal requirements are met to submit and accurate invoice for the "patient portion."The complainant further asserted that his own blood work for wellness was submitted without his knowledge which is falseFurther he also signed a form called "assignment of Insurance benefits" which he clearly understood and agreed toHe also was told unequivocally the same thing Every patient is told, that if ever an E.O.B (explanation of benefits) is received and is beyond their ability to pay that we always intercede on the patient's behalf to request reduction in feeThe lab is an entity that bills separately from our officeNone of these bills are submitted by me or our own billing company.Sincerely,*** ** *** ** *

With regards to the patients first statement, "the staff did blood work for things not related to my health issues". This statement is false. The patient was there for a wellness exam complete physical, as a result complete wellness labs were drawn. The entire process was explained by the lab...

phlebotomist, [redacted]. Please find enclosed the form given to patients who receive blood work in our office. This form explains the patient's financial responsibility and indicates the correspondence received from the lab are not bills but are EOBs (explanations of benefits). The patients are also given an email address they can contact in the event they have any questions about any received EOBs. If the lab fails to uphold the attached agreement, then under these parameters we will intercede on behalf of the patient to rectify the situation. The lab Phlebotomist, [redacted], spoke with the patient on the phone on 01/08/18 and explained everything listed above. The patient was understood and acknowledged that through his conversation with [redacted] his complaint with our clinic had been resolved to his satisfaction.
