GA law OCGA 31-states that a dental practice has the right to charge a reasonable fee for copying and processing dental records in order to provide the patients dental records for transfer to another dental practice or to be given to the patientIt further states that a reasonable fee can be as
high as $Our practice only charges $We are required to keep a copy of the patient records for a period of yearsAll of this was explained to Ms ***Regardless of her past collection issues, our fee is reasonable and fair.Ms*** has signed a records release form and her dental records will be available for pick up after a copying and processing fee of $is paid in cash or certified check

I was told the cost and agreed to pay and was told the cost would be around $258 to be seen that day. I agreed I would pay cash as I was in pain. She told me it was best I find a new dentist and wrote two names down and suggested that I call them and make an appointment. I never said I expected anything for free. I stated the tooth the bridge was attached to was hurting as it did when he put the thing on and I had to returned after he did and he made an adjustment to the bridge believing that resolved the issue.  In 2010 he worked on #5. A couple days after he worked on this tooth I returned in pain in that same tooth #5 and Dr Wilkey had them  call another office to see if he could send me right over to have #5 checked. I left and went straight to the other office. They had to do an emergency root canal on the tooth #5 he had worked on two -three days earlier. 
According to the Georgia Dental Asscoc. in which [redacted] ,the information in the message that was sent from Dr Wilkey's office to the Revdex.com stating records are held for 30 years is not true. It is 10 yrs. 
I was also told yes by GA Law they can request a copy fee and there's a maximum amount they can charge and the law they quoted is also not correct. Dr Wilkey's office stating according to GA Law they can charge $50-$150 for copy fees is also not  true and told me it also also states it can be waived by the Dentist. I have attached the GA Code for the copy rates as provided to me by the GA Dental Assoc. and shows the maximum amounts that can be charged for copy fees.
I have had the same cell number for 10 yrs. It has and has always had voice mail.  As to her response for the last appointment:

I would also like a copy of the returned certified letter terminating me as a patient.  I was never told they had tried to contact me by mail or phone. I was informed that day in that emergency appointment where I was refused treatment and dropped as a patient.  
She stated to me, she would not pay an employee to copy my records since I had made them loose $138 in fees to the credit agency.

In response to the patient's complaint that she was in pain and we refused to see her; 
According to our detailed chart notations- the patient had a bridge prep started in June of 2010, paid a down payment and was scheduled in two weeks to have it placed. During that time her jaw became sore and she was seen at our office where we placed a desensitizing agent on the treated teeth and prescribed medication for inflammation and pain. Within two weeks she was seen at [redacted]l where she was told that her pain was from arthritis in the jaw.She was placed on additional medications by her physician. We saw her in our office at no charge to make sure the pain was not originating from the bridge. We even referred her to a root canal specialist for endodontic evaluation to make sure the teeth were not abscessed. No dental reason for the pain could be established and she mentioned that the doctors at [redacted] prescribed medication that would help with the pain and that they thought it was from a previous surgery. She stated that she was taking four medications for pain. The patient did not return as scheduled to have the permanent bridge placed nor did she complete payment for the bridge at that time. Collection procedures were ongoing monthly and a partial payment was made in Feb, 2011 and May 2011. 
After a year and three months, the patient finally made an appointment to have the bridge cemented. She was out of pain at that time, owed a balance, paid the balance,  and had the permanent bridge cemented. This was 9-12-11.  
Due to her history of collection issues and not following through with treatment and appointments, we wrote a letter of dismissal and mailed it to her address on file which was a [redacted] address. It was returned. We called her cell # and the "voice mail box was not available". We then left a message at the home # we had on file asking for a correct address. We didn't hear back from the patient with a new address.
Two years later the patient called with sensitivity on the upper right area. The appointment secretary at the time didn't see the dismissal information and scheduled the patient an appointment. Upon arrival, the patient updated her address and contact information to her [redacted], GA address. Even though we had dismissed her, we offered to see her for the appointment but explained the charges for the appointment which included a limited examination-D0140 and a perioapical x-ray D0220. The total fee was 68.00. We explained to her in person that she has PREVIOUSLY been dismissed, the letter had been returned, but we would see her this time on a cash only basis. She refused treatment and left the office. She felt that her treatment should be free since she believed the pain was originating from the bridge we had started three years previously.
We believe we went far beyond our obligation as a provider.  We are willing to copy and process the patient's records for the nominal fee of $50.00.
