that DFS is a game of skill, we respect the authority of the NGCB and will comply with their instructions. As of October 15th,Nevada Residents are no longer be able to participate in our fantasy sports contests. The consumer in question has contacted our support staff, however, they have failed to reply to the initial email they received stating "if you do not find the answer to your inquiry below, please respond directly to this email". As they did not reply to the email and continued to send new emails to our staff, they did not receive a targeted reply. At this time, we have submitted a refund request of $4.62 and the consumer can log into their account to view this transaction. The confirmation code of the transaction is [redacted] and the consumer will receive a confirmation email from our Accounting Department once the request has been processed.

On 9/20 *** replied to my e-mail stating, "Dear Mr. ***, Our home office is waiting for the list of subscribers from Draftkings. As soon as they receive the list, they will be contacting each customer individually. We apologize for any inconvenience.Thank you for contacting ***. Sincerely, *** ***Customer Service"Since I made the deposit with DraftKings ALMOST ONE MONTH PRIOR to 9/20, clearly DraftKings is at fault here and is failing to honor its promotion.

On the 11th of November,  New York state AG [redacted] issued letters of Cease and Desist to both Draftkings and [redacted].  [redacted] no longer takes wagers in New York in compliance with the order to Cease & Desist.  Draftkings continues to accept wagers in the state of New York, in violation of the order to Cease & Desist !!!

We do not have a phone line for customer related matters. We receive a very high volume of inquires per day and the most efficient way to address all of them is via email. Phone support, would hinder our ability to fully address all inquiries received on a given day. All customer related inquiries...

are fielded via email and instant chat currently. Any number the consumer was contacting is not monitored by a representative and all users are directed to [email protected] for their questions. The consumer received that error code due to a error within their web browser and has since utilized our services using the balance in their account. This information can be produced upon request.

We apologize if you feel misled in any way regarding this offer. I can assure you, that is not our intention, and any person would feel frustrated if what they received is different from what they expected.  Im Deeply saddened by this whole situation you have no proof of either claims. My father has had one account and one account only. You asked for the id's of everyone we provided them and proved you wrong. May I ask why my mother's account is banned also? We did nothing And now my whole family can't play, and you stole 200$. This is absurd. I have never offered money for referrals and no one has ever multi accounted and you have zero proof. Please re-think your decisions as you have no proof of these absurd claims. If I need to attach all of our id's again email me personally. I Have proved 3 times now that we have 3 people all of 18 with their own account.

I understand that by choosing to accept the business response that my complaint will be closed as resolved. However, I disagree with the business' response stating that the consumer failed to make a withdrawal request.   I made 4 attempts to withdraw the money from my account.   With each attempt the business would not accept the request and would freeze the funds in my account.   This business practice is what prompted my complaint.   So I want to stress that the comment that the consumer failed to make a request is completely false.

It seems apparent that the intent was certainly to mislead. The commercials not only imply but directly state that the promo codes will grant free entry into the Millionaire Maker event week one. The commercials also say no deposit is required, but you said there is a $5.00 minimum requirement. It seems appropriate to think you are purposely misleading people and are hoping that no one will make an effort to fight it because the sums of money are small. However, this is blatant false advertising and you need to rectify this problem immediately.

Additionally, the conusmer has failed to follow the explicit directions in our correspondence which states the following: "Due to high service volumes at the moment, please expect delayed response times. While we are assisting other customers, below you may find the answer to your inquiry. If you do not find the answer to your inquiry, please reply directly to this email."The can review that exact messaging in multiple emails sent, with the most recent being [redacted] Incident #[redacted].Our withdrawal policy is clearly posted on numerous web pages on our site. Any withdrawal requests, after approved by DraftKings, will be credited back to the same credit card or method of payment ([redacted], Gift Card) used to deposit funds on the Website dating back 3-months in chronological order. DraftKings will only release withdrawals to a different credit card or other payment method other than that which was used to make deposit(s) after the aggregate amount of such deposit(s) has already been released back to the credit card(s) or payment method(s) used for the deposit(s). For example, you deposit $50 from a [redacted] card. With that $50 you enter a contest and win another $25. When you withdraw the full $75, $50 of it will go back to that same [redacted] while the other $25 will go back to either a [redacted] account or as a mail check.The consumer simply has to contact our support team, request a copy of the withdrawal confirmation email they received and reply to the initial message shall they receive it.

This is false. I only filed the [redacted] dispute AFTER DraftKings stated that the subscription promotion was not their responsibility, but [redacted]'s, and AFTER [redacted] stated that it was in fact DraftKings failure to provide them with my information 4 weeks after making the required deposit.

The consumer contacted our Customer Support team at 5:05 AM EST this morning and received a reply at 6:06 AM EST. The email they received also states "While we are assisting other customers, below you may find the answer to your inquiry. If you do not find the answer to your inquiry, please reply...

directly to this email." The consumer has failed to reply to that email, thus why they have not received an additional response from our Customer Support team. The Consumer received a total of $840.05 in contest prize winnings this morning between the times of 12:58am and 01:09am. They placed a $700.00 withdrawal request and they currently have a active cash balance of $101.11 and $73.00 on hold for upcoming contests. The consumer can view all of these transactions within their account by going to their My Account page, clicking on the "transactions" tab and then scrolling through the list. We will not be issuing this user any additional form of compensation as they have received all proper contest winnings for their corresponding contests and it appears they are simply confused at this time.

Any withdrawal requests, after approved by DraftKings, will be credited back to the same credit card or method of payment ([redacted], Gift Card) used to deposit funds on the Website dating back 3-months in chronological order. Further, once a deposit source is banned from our database, it will no longer be eligible for deposit.

At time of offer, the consumer was unable to provide the support staff with specifics of the offer he received, therefore he was not offered a free contest. If the consumer can provide documentation of the offer, the merchant will happily honor the promotion or work for a resolution.

We understand that having players in an NBA game that was postponed is an unfortunate situation that does not create the DraftKings experience you were hoping for.  We know that being negatively affected by the postponement is frustrating. We extended an invite to the customer to participate in...

a free $10,000 free roll contest, and refunded his commissions for the affected entries, which we believe is an amicable resolution.

The merchant has refunded the consumers remaining account balance of $17.25. As the consumer willingly utilized the merchants product, the merchant will not be refunding any funds outside of the consumer account balance. The merchant feels that this is a fair and amicable resolution. If any further mediation is required, the merchant will be more than happy to comply.

Despite the consumer's claims we have not received the requested information. There are only two emails on file from this user under the said email address. The user must locate email  Incident #[redacted] sent on Nov 17 11:00 am and attach their ID directly to that email. Once we have...
