Here is the timeline of events with Miss ***: [redacted] & [redacted] I received the original email inquiry from [redacted] on March 27, asking about photographic services for a wedding date of Monday, October 12, After we had spoken by phone numerous times, Miss [redacted] told me she was living in [redacted] at the timeI replied to the email and sent her my wedding pricing and package information, and noted that I gave a military discountSince the Wedding date was on a Monday, I gave a $discount for an “off day/weekday” wedding, as well as a 25% off Military discountI also gave them a few extras like a Mini Engagement Session, Bridal Portrait if it could be arranged, lots of extra help in the planning process We spoke numerous times by phone over the next few months and they negotiated a new package and a new amount, keeping the large discount and $$ taken offAgain, I was happy to offer a customized package and special rate, as this was for a Wedding taking place on a MondayOn July 31, 2015, I met [redacted] for the first time, as she passed through the areaWe met at a Local Coffee shop to discuss the package details and sign the contract In the standard photography services contract I utilize with all my clients, it clearly states:“Payment Policy & Expenses – A non-refundable retainer of half of the package amount is paid to reserve the Wedding DateThe remainder of the fee will be paid, by the client, two weeks prior to the Wedding DateIf the client cancels this contract, before the Wedding Date, No refunds will be given.” [redacted] understood the contract and signed and dated both copies at our meeting, and paid the non-refundable retainer of half of the package amount, at that time.That same weekend I had a Wedding at the same venue as the one she was using for her WeddingKnowing that I was there and the Wedding was starting at said time, Miss [redacted] and her Mom showed up unannounced and out of the blueThey wanted to see a Wedding at the churchIt was very uncomfortable as they were unannounced and not dressed for the occasionHowever, I did my best to be accommodating to ***.On August 17, Miss [redacted] called me to let me know that her Fiance had failed a PT training test/course and he would need to do the course againShe went on to state that they would have to cancel their Wedding for October 12, 2015.The following day, August 18th, I received an emailed from [redacted] that read:“Hey Noah! Thanks for talking yesterday, it was very very helpful! I am officially taking October off the books.”Upon my receipt of this email from ***, cancelling the wedding date of October 12, 2015, the wedding photography contract was considered cancelled and void.The non-refundable retainer clause in the contract states: If the client cancels this contract, before the Wedding Date, No refunds will be given.”A cancelled contract is just that - a cancelled contract.However, I love what I do and am happy to go the extra mile for all of my couples, so I was happy to attempt to work with [redacted] as she chose multiple new wedding dates over the next monthsDuring this time, Miss [redacted] talked about several different “new” wedding datesShe spoke of a November date, December 12, 2015(Saturday), December (Monday), December , 31&1(holiday) and January 1&2, 2016(Fri-Sat - Holiday).I told her that I would not be available for the December 28TH, as I was already booked with another weddingI told her that I was available for the New Year’s dates, but explained there would be an extra charge because of the Holiday.Over the next month, she flip/flopped wedding dates for one reason or another, promising this date with one venue and that date with another venueI kept track of all of her notes and waited to get a confirmation of when (and what city) the wedding would in fact be taking place.She finally requested the Jan 1&The Wedding Ceremony and Reception was to be held at the same venue, in Fincastle, VaI immediately added her wedding date to my schedule and considered it “booked.” As a result, I turned down a New Year’s event at a local University that I have photographed for the last years in a rowOn September 17, 2015, Miss [redacted] contacts me and tells me that the Wedding location has now moved from Fincastle, Virginia, to Savannah, Georgia, miles, roundtripShe goes on to tell me that she wants the same discounted “off day/weekday package” rate for originally negotiated for a local wedding being held on a Monday, and that she will not pay a single penny more! On the same day, I tell her miles roundtrip drive, two nights in a hotel = $$for a weekend date, was $400Total = $+ the balance of her original package.Same day she writes back to let me know “I'm sorry, but there is no way that I would be able to afford”I tell her I will look over the numbers again.I cut out every bit of cost for labor and time, and reduced it down to only my costs for travel and lodging$to cover gas and two nights in a hotel for their Savannah Wedding.More than a month later, On October 21, [redacted] sends me a response:“ [redacted] ’s Dad has passed away.”I was truly sorry to hear the news!At this point, she goes on to tell me that they cannot afford the extra $600, [redacted] ’s Mom is paying for the photography, and I am a horrible person for attempting to charge them an extra $to drive miles and stay in a hotel for two nights to photograph their Wedding!Even though her comments were hurtful AND untrue, I am always out to make every couple’s experience a positive oneWith a death in the family before the wedding, my heart goes out to any couple experiencing a lossSo, I told her I would honor the discounted “off-day/weekday” wedding package priceI’ll also take money out of my own pocket to pay for the travel and hotel room, as long as new contract for the new wedding date is signed within a week.I mailed out the new contract right away, and sent the paperwork certified mail to ensure [redacted] would receive itThe Postman attempted delivery three timesIt was held another week at the post office and [redacted] NEVER picked it up from the Post Office.A month and a half pass and I get no responseDefault to original contract I email [redacted] with wedding photo ideas and locationsI research the Savannah area, I find out what events are going on that weekend, and send [redacted] that information.Still, no response!December 8, I am at the end of my rope, it is just WEEKS before New Year’s, less than a month from the wedding date she has given me, and I still don’t have a contract in place with the coupleI don’t make any other plans for the holidays with my family, nor do I book any other events for that weekend, because I’m still having troubles getting a final answer from Miss ***All I want to do is get a new contract in place and move forward.In an effort to reestablish communication and get the ball rolling, I email her an outline detailing new options for her consideration.#– Keep the original package and pay $for Travel & Hotel#– Keep the original price and apply it to a package, pay no extra#- opt out – I will get an attorney to draft a letter, sign it, return it, and as a good faith extra, I give you $back, half of the NON REFUNDABLE RETAINER#– Do nothing –December 11, Miss [redacted] responds that she has chosen the option to “opt out.”The same date, December 11, 2015, I responded that I will draft up the document, have an attorney look it over, and send it certified mail to ***This process is slated to take a few months due to the holiday season, ***’s Honeymoon plans, and the Attorney’s case workload.Jan – [redacted] , the Groom, a person that I have never met or had communication with throughout this entire process, decides that he is not waiting for the “Opt Out” agreement that his wife selected, and proceeds to leave slanderous and half -truths feedback on every online review site he can find.This ends all communicationDefault to original contract At this point, through honesty and hard work, I have gotten almost all of the reviews removedA resolution to this - Have them remove the remaining reviews, if they cannot be removed, convert them to star reviewsWrite and notarize a letter that they nor any other family/friends will write similar reviews pertaining to this matter, and a refund will be given.noah-- Noah Magnificomaster photographer [redacted] ###-###-####
