Good evening *** ***,
First, I apologize for the delayed response to the complaint submitted in October Below, I attached the ENTIRE email chains between *** *** and Dream Design Construction.
This contract was signed on 6/22/and the Customer had the right to cancel the contract by 6/30/2014, which is clearly stated in the contract.
As you see below, On 6/30/2014, *** *** emailed to cancel the contract. On that same day, we replied asking him for the reason of cancellation. He stated he wanted a design for his bathroom - we replied back the same day stating that we will provide him the design if he was still willing to proceed with our company and he would have until 7/7/to confirm, otherwise we would return the deposit check immediately.
*** *** is repeatedly stating that we were not responsive and did not provide the design within the time frame. However, designs were sent to him on 6/30/and we were waiting for his response. On July 8th, he emails us again wanting to cancel the contract, but it was already one day after the cancellation date (7/7/14).
I went over to *** ***'s house after this "cancellation" remark and talked over the bathroom remodeling work, went over the floorplan and brainstormed ideas for the project.
We sent him an updated design (per his request) on September 9th which was the LAST meeting we had with him - and he replied back to us positively and asking questions about the shower floor materials, in which we replied back on the SAME DAY explaining what materials we would be using. Six days later, he emails to cancel the contract again.
We did everything on our end to please *** *** and to meet his needs, spending many hours working on the designs and having multiple meetings.
We believe the contract was breached by *** ***.
We are still willing to proceed with the contract and give him the $as a credit towards the remodeling project.

The design you provided shows a rectangle bathtub and a corner bathtubI prefer the corner bathtub and believe that's a better design for the bathroomIf you can provide a detailed design showing the corner bathtub and shower with the bench as well as a tub with jets and a better design for the rectangle, that might help move this along

Initially, you guys did not want to have designer involve for this project since its not a complex job
I already did simple design but if you tell me what layout you guys perfere then I can revise it for you
We are also finishing a master bathroom in ashburn not far from your house
It will be installed witha all marble tiles, granite and custom cabinets

The Contract was signed with [redacted] on June 23, 2016 for her roof and installing 4 window wraps. Total contract price was for $10,000 and she gave us $5,000 as a deposit. Her insurance company already paid her directly for her roof replacement because of the hail storm that damaged her roof....

Insurance paid her approx. $13,000 but she wanted more money from the insurance company. I stated to her that there were some items that the insurance left out and we might be able to do supplement for additional $2,000-$3,000. She asked if our company can help her our for additional items and she was going to move forward with the company. I did 2 separate inspections for her home and sent into documents for additional damages to her home. Insurance adjuster requested to come back out and re inspect the property. We came out and went through all the damages with the insurance adjuster and agreed to the additional damages and the price. This process took approximate 2 months for paperwork going back and forth and doing the re inspection. After additional funds were approved she asked us to hold off on the roof job. Then she started to complaint how she thought roof price and window wrap for $10,000 seams too expensive and wanted us to add new gutters. We agreed to that and ordered the shingle materials. Then she call our company back and wants to cancel the contract because she was have personal issues and she needs to use the funds for her personal use. She did not want to pay any restocking fees for the materials or our time for working on supplement with the insurance company. After she received the additional check she just wanted her money back. I did not want to argue with her so  I even told her the money will be refunded back. I asked if she can wait couple weeks and check will be mailed to her. Right now I don't even know why she has complaint here regards to this matter because I spoke to her last week regards to her check being mailed. She wanted me to bring the check the same day and I told her I couldn't do that. I told her our company worked and waited for 3 months working with her insurance company to get the supplement approved and she cant wait few week for her check to be mailed back? We have no interest in her money and the deposit is being mailed out.

This is a formal complaint against Mr. Yong Y* and Dream Design Construction LLC located at [redacted] VA [redacted] for not meeting the contract terms and for fraudulently cashing an initial deposit of $6,900.00, which was for the renovation of a master bathroom. Mr. Yong Y* obtained money by false pretense by promising that our deposit would not be cashed without our approval. The contract with Mr. Yong Y* and Dream Design Construction LLC was signed on 6/22/14 and was contingent on the approval of the bathroom design and cabinetry. The contract specifically stated that the customer may cancel the contract by 6-30-14 for full deposit refund and that the design must be approved by the customer. When we did not receive the design by June 30th, we emailed and called Mr. Yong Y* to cancel the contract and that we wanted the deposit returned. Mr. Yong Y* provided an explanation that he was busy and would have the information by Friday July 4th. We expanded that this was a holiday and allowed him until Monday July 7th. When Mr. Yong did not provide a response by July 7th we called Mr. Yong and sent an email on July 8th cancelling the renovation and asking for our check to be returned. Mr. Y* explained he was busy and he will have the information to us shortly.

July 17th, 2014: Mr. Y* cashed the deposit check and sends us an email stating he was leaving the next day for his honeymoon and that he ‘could not update the design since he was getting married and he has been busy with the wedding and relatives from Korea’.

Mr. Y* has stated he would return our deposit but continued to delay sending the funds and as of October 3rd stated he would charge a $1,000.00 for the designs and return the balance of the funds within 7 days. That same day, Mr. Yong changed his mind and stated he will not return any of the deposit. The contract does not state there would be a charge for designs.

We had repeatedly asked to cancel the contract and for our funds to be returned. Mr. Yong Y* provide many excuses as to why he could not fulfill the contract terms including getting married and his honeymoon. Mr. Y* stated he would return the deposit and then stated he would charge for the design and finally completely changing his mind to not returning any of the funds. To this date, we have lost $6,900.00 to Mr. Yong Yi and Dream Design Construction LLC under fraudulent pretense and broken contract terms. Mr. Yi confirmed that he has not spent any of our money on materials since we have repeatedly asked for our money back and he has been unable to honor the contract terms.Desired Settlement: We ask that the deposit of $6,900.00 be returned and this case can be closed.
